DEED OF TRUST: CAMPBELL TO MEEKS SOURCE: Nelson County Deed Book 10, Page 127 CONTRIBUTOR: Sylvia Ray ------------------------------------------------------------ This Indenture made and entered into this 26th day of February in the year of our Lord eighteen hundred and forty two between Francis J. Campbell, the debtor, of the first part, and Nelson C. Clarkson, as Trustee, of the second part, and Sylvanus Meeks, the creditor, of the third part; witnesseth that the said Francis J. Campbell stands justly indebted unto the said Sylvanus Meeks in the sum of nineteen dollars and fifteen cents due by bond under hand and seal bearing date with these presents and payable on or before the 1st day of October 1842, and for the further consideration of one dollar of lawful money of this Commonwealth paid by the said Nelson C. Clarkson to the said Francis J. Campbell, at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged by the Francis J. Campbell, hath sold and by these presents do hereby grant, bargain, sell, deliver and confirm unto the said Nelson C. Clarkson and his legal representatives the following property to wit: one bay mare, saddle and bridle and martingale, and all the right, title and interest which I have in the property in possession of my father and mother in trust, both at law and equity, and all and every other part of my property and interest to me belonging of every nature and description whatsoever, 1 watch upon trust, yet nevertheless, that upon failure of the payment of the debt of nineteen dollars and fifteen cents before mentioned, which shall be payable on the 1st day of October 1842, with the interest thereon and all legal costs of carrying this Indenture into effect, then in that case it shall be lawful and the said Nelson C. Clarkson shall have power and is hereby timely empowered to take the property in possession and after giving ten days notice at some public place in the neighborhood of the said Francis J. Campbell of the time and place of sale, proceed to sell to the highest bidder for cash the property aforesaid, or as much as will satisfy and pay all legal costs and charges, and to pay the said Sylvanus Meeks the sum of nineteen dollars and fifteen cents with legal interest thereon, and the surplus, if any, return to the said Francis J. Campbell or his legal representatives. Now, if the said Francis J. Campbell shall pay or cause to be paid unto the said Sylvanus Meeks or his legal representatives the sum of nineteen dollars and fifteen cents with legal interest thereon, and all the legal costs and charges of carrying this Indenture into effect so that no default of payment, then this Indenture to be void else to remain in full force and virtue. Campbell personally appeared before us William Massie and Ryland Rodes, Justices of the Peace for and in the County aforesaid, and acknowledged the foregoing Deed of Trust to be his act and deed, did hereby fully explained to him and he had willingly assigned the same and desired it to be certified to the Clerk of said County to be recorded.
