DEED: Edmund J. Campbell SOURCE: Nelson County, VA Deed Book 11, Page 148 CONTRIBUTOR: Sylvia Ray ---------------------------------------------------------- This Indenture made and entered into this 24th day of February in the year of our Lord one thousand eight hundred and forty five between Edmund J. Campbell the debtor, of the County of Nelson and State of Virginia, of the first part, and Sylvanus Meeks as Trustee, of said County and State of the second part, and Robert C. Jones, and Jones and Clarkson, and Robert C. Jones & Company the creditor of the said County and State of the third part, witnesseth that whereas, the said Edmund J. Campbell stands justly indebted unto the said Robert C. Jones, and Jones and Clarkson, and to Jones & Company in the sum of fifty dollars and fifty five cents due by bond, and two executions under hand and seal bearing date, the bond 24th day of February 1845, the execution 11th May 1843, and payable on demand, for and in consideration thereof aforesaid and for the further consideration of the sum of one dollar of lawful money of the Commonwealth to him, the said Edmund J. Campbell, in hand paid by the said Sylvanus Meeks at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged, he the said Edmund J. Campbell hath sold and by these presents doth hereby grant, bargain, sell and deliver and confirm unto the said Sylvanus Meeks, his heirs, executors, administrators, and assigns, the following property to wit: one mingo horse, two head cattle, eight head hogs, one bed, bedstead and furniture, and all the other part of the household and kitchen furniture and plantation utensils, and the crop depending for the year of 1845 of every description, also all the right, title and interest of the said Edmund J. Campbell, both at law and equity, in the estate of his father and mother, Francis and Nancy Campbell. To have and to hold to the only proper use of the said Sylvanus Meeks, and the said Edmund J. Campbell for himself, his heirs, executors, administrators, and assigns will forever warrant the right and title of the aforesaid property free from the claims and demands of all and every other person or persons whatsoever only to the said Sylvanus Meeks, his heirs, executors, administrators, and assigns, now and forever. Upon trust, yet nevertheless, in case the said Edmund J. Campbell shall fail to pay to the said Robert C. Jones, and Jones and Clarkson, and Robert Jones & Co., or their legal representatives the debts, as aforesaid, with legal interest thereon until paid, and all legal cost and charges of this Indenture, or any attempt to move or sell, or convey the property as aforesaid, or any part thereof, then in either case it shall be lawful for the said Sylvanus Meeks, and he is hereby timely empowered to take the property, as aforesaid, in possession and after having first given ten days previous notice of the time and place of sale by advertisements at some public place, in the neighborhood of the said Edmund J. Campbell, then sell to the highest bidder for ready money the property aforesaid, or as much as will be sufficient to satisfy and pay all legal cost and charges of this Indenture and carrying it into effect, and then pay to the said Sylvanus Meeks, or his legal representatives, the aforesaid debts of amount fifty dollars and fifty five cents, with legal interest thereon from the date 24th day of February 1845, until paid, and the balance, if any, return unto the said Edmund J. Campbell, or his legal representatives. Now if the said Edmund J. Campbell shall keep the property as aforesaid together until default of payment, or shall pay to the said Sylvanus Meeks, or his legal representatives, the aforesaid debt with legal interest and cost of this Indenture on or before the 24th day of February 1846, so that no default on his the said Edmund J. Campbell's part, then this Indenture to be void or else to remain in full force and virtue. As witness, our hands and seals this day and date first written. Edmund J.
