DEED: Francis J. Campbell Deed of Trust SOURCE: Nelson County Deed Book 14, Page 153 CONTRIBUTOR: Sylvia Ray ------------------------------------------------------------------ This Deed made this thirteenth day of September 1854 between Francis J. Campbell of the first part, Thomas P. Fitzpatrick and Charles N. Patterson of the second part, and Penn & Witt and James S. Penn of the third part, witnesseth that the said Francis J. Campbell in order to secure the payment of the following debts to wit: to Penn & Witt the sum of one hundred and nineteen dollars and nine cents due by bond the 1st day of September 1854, and to James S. Penn the sum of fifty nine dollars and eleven cents due by bond payable the 1st day of January next, and for and in consideration of the further sum of one dollar to him in hand paid by the said Fitzpatrick and Patterson, the said F. J. Campbell has this day granted, bargained and sold and by these presents doth grant, bargain and sell to the said Fitzpatrick and Patterson the following property to wit: One brown mare, two cows, seventeen head of hogs, household and kitchen furniture, and plantation tools, and future increase of the mar and cows, his present growing crop of tobacco, to have and to hold to them and their heirs forever, upon trust nevertheless, and upon this consideration that in case the said F. J. Campbell shall fail to pay the debts aforesaid, it shall be lawful for the said Fitzpatrick and Patterson or either of them, at any time after the 1st day of June next, having advertised the time and place of sale at least ten days, at some public place in the neighborhood of the said F. J. Campbell, sell to the highest bidder for cash the whole of said property herein before stated, or so much thereof as shall satisfy and pay the amount remaining due and unpaid of the debts aforesaid, the cost of recording this deed and of making said sale and any balance that may be remaining in their hands pay over to the said Francis J.
