DEED: Francis J. Campbell Deed of Trust SOURCE: Nelson County Deed Book 14, Page 333 CONTRIBUTOR: Sylvia Ray --------------------------------------------------------------- This Deed made this 27th day of September 1855 between Francis J. Campbell of the first part, and Thomas S. Fitzpatrick and Charles N. Patterson of the second part, and James S. Penn and Penn and Witt of the third part, witnesseth that the said Francis J. Campbell in order to secure the following debts to wit: a debt to James S. Penn due by bond bearing date the 27th day of September 1855 and carrying interest from the 1st day of July last for the sum of thirty five dollars and thirty one cents and further to secure a debt to said Penn due by bond bearing date the 13th day of September 1854 and carrying interest from the first day of January 1854 and further to secure a debt to Penn and Witt for the sum of one hundred and nineteen dollars and nine cents due by bond bearing date the 13th day of September 1852 and bearing interest from the 1st day of September 1854 and for and in consideration of the further sum of one dollar when in hand paid by the said Fitzpatrick & Patterson the said Francis J. Campbell has this day granted, bargained and sold and by these presents doth grant, bargain and sell to the said Fitzpatrick and Patterson the following property to wit: all his cop of corn fodder and shucks and his crop of tobacco made the present year and one brindle cow to have and to hold to them and their heirs forever upon trust nevertheless and upon this consideration that in case the said Francis J. Campbell shall fail to pay the aforesaid debts it shall and may be lawful for the said Fitzpatrick and Patterson or either of them, at any time after the 1st day of January 1856, having first advertised the time and place of sale at least ten days at some public place in the neighborhood of the said Campbell, to sell to the highest bidder for cash the whole of the within here mentioned property or so much thereof as shall be sufficient to pay the cost of recording this deed and making such sale and then first pay the debts to the said James S. Penn and them the debts to Penn and Witt and the remainder, if any, pay over to the said Campbell or his legal representatives.
