DEED: Camden to Lewis Tindall, 1832 SOURCE: NELSON COUNTY WILL BOOK 7 - Page 585, 586 CONTRIBUTOR: Sylvia Ray ---------------------------------------------------------------- This Indenture of bargain and sale made and entered into this 19th day of December 1832 by and between John B. Camden and Elizabeth his wife, Marbell Camden and Mary his wife, and Peter G. Camden and Ann B. his wife, parties of the first part, all of the Town of Stanford, and State of Kentucky, and Lewis Tindall party of the other part, resident in the County of ___(nothing entered)___ and State of Virginia, witnesseth, that for and in consideration of the sum of seven hundred and fifty dollars to them in hand paid before the sealing and delivery hereof, the receipt of which is hereby acknowledged and for the further consideration that said Lewis Tindall executed his promissory notes to said Camdens, one note for the sum of three hundred and seventy five dollars, payable on the first day of January 1834, the other note for the same sum payable on the first day of January 1835, making in all the consideration of fifteen hundred dollars, they the same Camdens have bargained and sold unto said Lewis Tindall and they do by these presents sell, convey and confirm unto him, his heirs and assigns; a certain tract or parcel of land, lying in the County of Nelson on James River known by the name of Greenway and being the same land that came to said Camdens by the Last Will and Testament of their grandfather, William Camden-since deceased, together with all and singular the appendages and appurtenances thereunto belonging or in any wise appertaining to have and to hold the same unto him the said Lewis Tindall, his heirs and assigns forever, and the said John B. Camden and Elizabeth his wife, Marbell Camden and Mary his wife, and Peter G. Camden and Ann B. his wife, for themselves and their heirs the said tract of land with all and singular the appendages and appurtenances thereunto belonging unto the said Lewis Tindall, his heirs and assigns, free from any claim or claims of any person or persons whomsoever, do warrant and defend by these presents. In witness whereof, the said John B. Camden and Elizabeth his wife, Marbell Camden and Mary his wife, and Peter G. Stemmons and Harvey Wheat, two of the Commonwealth Justices of the peace in Lincoln County Kentucky do hereby certify that on the day of the date hereof the foregoing deed of Indenture was acknowledged before us by John B. Camden and Elizabeth his wife, Mary Camden wife of Marbell Camden, and Ann B. Camden wife of Peter G. Camden, and by John B. Camden attorney in fact for Marbell Camden to be their act and deed for the purposes therein mentioned, they the said Elizabeth Camden wife of John B. Camden, and Mary Camden wife of Marbell Camden having by us first privily examined separate and apart from their husbands and the deed explained to them declared that they freely and voluntarily signed and acknowledged the same and relinquish their right to dower to the land therein conveyed and declared that in making such acknowledgment and relinquishment of dower they were not influenced to do so by threats, coercion, or persuasions of their husband but that the same was done freely and voluntarily and wish not to retract there from and the said Ann B. Camden wife of Peter G. Camden having been by us first privily examined separate and apart from her husband and the deed explained to her declared that she freely and voluntarily signed and acknowledged the same and relinquishes her right of inheritance to the land thereon conveyed she granted and declared that in making such acknowledgment and relinquishment she was not influenced to do so by the threats, coercions or persuasions of her husband, but that the same was done freely and voluntarily, and wished not to retract there from. And each of the forms correct consent that this deed of Indenture may be recorded in the clerks office of the County Court of Nelson County in the State of Virginia where the promises lie. Kentucky Lincoln County Court I, Thomas Helm, Clerk of the County Court Lincoln in the State of Kentucky and who am duly authorized by the laws of this State to receive the acknowledgment of deeds and do hereby certify that on the day of the date hereof this deed of Indenture was presented to me in my office and acknowledged by John B. Camden in his oversight and as attorney in factor for Marbell Camden to be his act and deed for the purposes therein mentioned. And I do further certify that Martin A. Stemmons and Harvey Wheat whose names are subscribed to the proceeding certificate are acting Justices of the peace in Lincoln County Kentucky, duly commissioned and qualified and that full faith and credit and right to be given their official acts. In testimony whereof I have hereunto subscribed my name and affixed the seal of my office this 19th day of December eighteen hundred and thirty two. Thomas Helm, clerk L.C.C. Kentucky Lincoln County Court I, John Davis, Senior and presiding Justice of the peace of the Lincoln County Court in the state of Kentucky do hereby certify that Thomas Helm whose name is subscribed to the foregoing certificate is the Clerk of the Lincoln County Court and that his certificate is in due form of law and entitled to full faith and credit in any court in a sister State.
