DEED: Garland TO William W. Camden, 1834 SOURCE: Nelson County Deed Book 8, Page 420 CONTRIBUTOR: Sylvia Ray ----------------------------------------------------------- This Indenture made the 4th day of April between Spotswood Garland, clerk of the County Court of Nelson County in the State of Virginia or the first part, and William W. Camden of the same County of the other part, whereas Floyd G. Harris, deputy for John Digges, Sheriff of Nelson County, in pursuance of the 11th Section of an Act by the General Assembly entitled "An act concerning delinquent and forfeited lands, and providing for the sale of lands returned delinquent hereafter for the non payment of taxes", did return to the September terms of the County Court of Nelson in the year 1834, a list of all lands and lots (other than those not ascertainable according to law) within the said County delinquent for the non payment of taxes due thereon, which list is in the form by the said act prescribed, and at the foot of which he, the said Floyd G. Harris, in open court made and subscribed the oath prescribed by the said act and the Court of said County having examined the said list and being satisfied that it contained the tract, directed their clerk to certify the same is the auditor of public accounts and to preserve the original in his office, a fair copy of which said list and verification, the said clerk delivered to the said Floyd G. Harris, in which list is contained among others, a tract of land of the description following: Name of person - Estate of Wilson G. Nicholas, Residence - Albemarle, Quantity of land - 23425, Description and local situation of the land - On the Blue Ridge, Distance and bearing from the Courthouse - N.W. 14 miles, Amount of tax - $3.75, and whereas the said Floyd G. Harris, deputy Sheriff as aforesaid on the 27th day of October 1834, having previously thereto made out these fair copies of the list and verification aforesaid and within ten days after making the return aforesaid, set up at the Courthouse door of said County one copy of said return and having within the period aforesaid set up the other two copies at two of the most public places within said County with a notification in writing subjoined to all and each of the said copies that unless the taxes charged upon the lands and lots in said list mentioned should be paid on or before the day of the sale that the said land and lots, or so much thereof as shall be sufficient to satisfy the taxes due thereon, with five per centum to the Sheriff for his trouble in making sale of the same, would on the first day of the next October Court at the Courthouse of the said County, be sold at public sale and in pursuance of the 12th section of the act aforesaid and pursuant to the notification aforesaid, proceed before the front door of the said Courthouse to offer for sale the tract of land aforesaid, where upon the said William W. Camden became the purchaser of nineteen acres of the said tract of land for the sum of four dollars and thirty seven cents, that being the amount of the taxes charged thereon and five per centum to the Sheriff for his commission, and whereas the said Floyd G. Harris, deputy Sheriff as aforesaid in pursuance of the 15th section of the Act of Assembly before recited on receiving from the purchasing aforesaid the amount of purchase money aforesaid (besides his fee allowed by the 16th section of the same act) granted to the said purchaser a receipt for the same according to the form prescribed in the 15th section aforesaid and in pursuance of the 17th section of the same act of Assembly, the said Floyd G. Harris, deputy Sheriff as aforesaid, within thirty days after the completion of the sales in manner described by the said act of Assembly, made out and returned to the clerk's office of the County aforesaid, a distinct list of all the lands and lots by him sold for the non payment of taxes due thereon according to the form in the said 17th section of the said action prescribed, and made oath, subscribed the oath in the said 17th section also prescribed before, Robert S. Kincaid, Esquire, a Justice of the Peace for the said County, which was attached to the said list, and therewith filed in the clerk's office of the said County which list last aforesaid contains the aforesaid tract, or part of which was sold to and purchased by the said William W. Camden, and whereas the heirs or representatives of the said Wilson C. Nicholas hath failed to redeem the nineteen acres of land sold as aforesaid according to the provisions of the act of Assembly aforesaid, and whereas the said William W. Camden in pursuance of the 21st section of the same act of Assembly hat had the quantity of land, to wit: Number of acres purchased by him as aforesaid surveyed and laid off at his own expense by the surveyor of this County, the said survey commencing on one of the lines of the tract designated by the said William W. Camden, not including the improvements on the same, and being in one body the length whereof is not more than double the breadth, a fair plat and certificate of which survey has been returned to the Court of the said County of Nelson, examined by them, found correctly made in conformity with the act of Assembly aforesaid, where upon the said Court ordered the same to be recorded in a Book to be kept for that purpose by the clerk who has recorded the same accordingly in, and the said William W. Camden within six months after the expiration of the period of redemption by the said act of Assembly allowed, hath applied to the said Spotswood Garland, clerk as aforesaid, for a deed for the nineteen acres of land purchased and laid off as aforesaid: Now this Indenture witnesseth that I, the said Spotwood Garland clerk of the County Court of Nelson County, in pursuance of the powers vested in me by the act of Assembly before recited, for and in consideration of the premises aforesaid, and the sum of one dollar to me in hand paid by the said William W. Camden before the sealing and delivery hereof, the receipt of which is hereby acknowledged, have granted, bargained, sold and conveyed and do hereby grant, bargain, sell and convey unto the said William W. Camden, his heirs, executors, administrators, and assigns forever all such title and estate in and to the aforesaid tract of nineteen acres of land purchased and laid off as aforesaid, and bounded according to the plant and survey aforesaid as follows: Beginning at a chestnut near said Camden's line and running thence S 80 degrees W 30 poles to a chestnut oak marked "H" corner to said Camden and with his line N35 degrees W 13 poles to pointers on a double chestnut on a flat part of a high ridge corner to Wiatt Camden and with his line N 6 degrees E 20 poles to a chestnut oak and small black gum in said Wiatt Camden's line, thence new lines N 33 degrees E 57 poles to pointers on the east side of a spur of the Priest Mountain, S 57 degrees and E (crossing a drain) 44 poles to a locust stump near the north edge of said drain, in the old line of the said Wilson C. Nicholas and thence with the said old line, S 33 degrees W 59-6/10 poles to the beginning, as was the day of the sale thereof here in before recited in the estate of the said Wilson G. Nicholas. To have and to hold the said tract of nineteen acres of land to the said William W. Camden, his heirs: But the said Spotswood Garland merely executing the power under the act aforesaid to convey such title and estate only as was vested in the estate of the said Wilson G. Nicholas, makes no warranty concerning the same whatever. In testimony whereof the said Spotwood Garland hath hereunto set his hand and affixed his seal the day and year first above written. Camden, nineteen acres of land in said County sold October the 27th 1834, for the non payment of taxes on 23425 acres of land charged to the estate of Wilson G. Nicholas for the year 1834 and purchased by the said William W. Camden as will appear by the annexed receipt of Floyd G. Harris, deputy Sheriff, for John Digges, Sheriff of Nelson County. The aforesaid nineteen acres of land laid off in conformity to an act of Assembly in the case made and provided, and bounded by the true meridian as follows: Beginning at a chestnut near said Camden's line and running thence S 80 degrees W 30 poles to a chestnut oak marked "H" corner to said Camden and with his line N35 degrees W 13 poles to pointers on a double chestnut on a flat part of a high ridge corner to Wiatt Camden and with his line N 6 degrees E 20 poles to a chestnut oak and small black gum in said Wiatt Camden's line, thence new lines N 33 degrees E 57 poles to pointers on the east side of a spur of the Priest Mountain, S 57 degrees and E (crossing a drain) 44 poles to a locust stump near the north edge of said drain, in the old line of the said Wilson C. Nicholas, deceased, was this day returned into Court and being examined and found to be correct and the same is ordered to be recorded.
