DEED: Camden to Camden, 1844 SOURCE: Nelson County Deed Book 10, Page 344 CONTRIBUTOR: Sylvia Ray ------------------------------------------------------------ This Indenture made and entered into this 12th day of January one thousand eight hundred and forty four between William W. Camden of the County of Nelson and State of Virginia of the first part, John S. Camden and William Wright (Trustees) of the second part; and John F. Camden of the County of Nelson and said State of the other part; Witnesseth: That whereas the said William W. Camden stands justly indebted to the said John F. Camden in the sum of seven hundred and four dollars and twenty cents by bond bearing even date with this Instrument; and the said John F. Camden stands as security for the said William W. Camden on a bond due to Christopher S. Estes, and which bond suit has been brought and a Delivery Bond taken by the Sheriff, which Delivery Bond amounts to the sum of one hundred dollars and seventy eight cents, and the said John F. Camden is security for the said W. W. Camden on one other bond due to Softus & Jones, on which said Bond, suit has been brought, and delivery bond taken by the Sheriff, which said Delivery Bond amounts to the sum of three hundred and fifty nine dollars and fifty seven cents; and the said John F. Camden has entered as security in Delivery Bonds on this day in the following cases to wit: Wiatt Jones against W. W. Camden, the sum of two hundred and ninety two dollars and twenty one cents; Thomas J. Massie against W. W. Camden for the sum of one hundred and twenty nine dollars and fifty four cents; Nelson C. Clarkson against W. W. Camden for the sum of ninety seven dollars and one cent; Wiatt Jones for and against W. W. Camden for forty eight dollars and fifty six cents; Merriweather N. Loving against W. W. Camden, and John Hill forty seven dollars and seventy eight cents; James A. Campbell against W. W. Camden, and Sylvanus Meeks for sixty eight dollars; Christopher S. Estes for and against W. W. Camden for the sum of sixty four dollars and eighteen cents; the payment of all which sums the said W. W. Camden is willing and desirous to secure to the said John F. Camden. Now this Indenture Witnesseth: That for and in consideration of the promises and in consideration of the sum of one dollar lawful money of Virginia, in hand paid by the said John S. Camden and William Wright to him, the said W. W. Camden at and before the ensealing and delivery of these presents, the receipt whereof is hereby acknowledged, he the said W. W. Camden hat given, granted, bargained, sold, and confirm, and do by these presents give, grant, bargain, sell and confirm unto the said John S. Camden and William Wright, and their heirs forever, the following tracts or parcels of land, lying and being in the County of Nelson and State of Virginia, to wit: One tract or parcel of land containing 238 acres, be the same more or less, being the same tract on which said W. W. Camden now resides, bounded by the lands of John F. Camden, William L. Dickie, and others, also one other tract containing 19 acres be the same more of less, adjoining the lands of John Camden, deceased, and others; also all his (W. W. Camden's) interest in a tract or parcel of land containing by survey 300 acres lying on the head waters of Shoe Creek in the County of Nelson; also his interest in the lands belonging to the estate of John Camden, deceased, which is at this time undivided, lying in the County of Mason on the waters of the 18 Mill Creek, which said interest is 10.8 acres; also all his claim, right, and title, to four slaves and their future increase, namely to wit: Priscilla, Sarah, Nelson, and Glouster, also one clock, four feather beds and furniture, one side board, one bureau, one looking glass, and all other household and kitchen furniture, also all his plantation utensils of every description, three head of horses, eleven head cattle, and his stock of hogs with their increase, his crop of tobacco now if the house, crop of corn and fodder now on hand, also all his crop of small grain now seeded which will be reaped during the year 1844; to have and to hold the said tracts or parcels of land and the before mentioned property, with all the appurtenances thereto belonging, or in any wise appertaining to the only proper use and behoof of them, the said John S. Camden and William Wright, to themselves, their heirs, shall, will, and do warrant and forever defend by these presents, the aforesaid tracts or parcels of land, and aforesaid property free from the claim or claims of him, the said W. W. Camden and his heirs, or from the claim or claims of all and every person whomsoever, to the only use and behoof of them the said trustees, to wit: John S. Camden and William Wright, upon this special trust nevertheless: That should the said William W. Camden make default in the payment of the debts, interest and cost of the above mentioned debts, then, in that case it shall be lawful for the said John S. Camden and William Wright, trustees to this Instrument at any time when called on by the said John F. Camden to proceed to sell to the highest bidder at publick auction, for cash, in any market that the said John S. Camden and William Wright may think fit (without advertising), three of the slaves, to wit: Sarah, Glouster and Nelson; should the said slaves not bring a sufficiency to satisfy and pay all the above mentioned debts, for which the said John F. Camden has this day bound himself for and should the said W. W. Camden make default in the payment of the balance of the security debts on the 1st of March next, then in that case, it shall be lawful for the said trustees to proceed to sell in the same manner as above, the above named slave, Priscilla; should that not pay the deficiency of the security debts the said trustees are authorized to proceed to sell to the highest bidder for cash, on the premises whereon the said W. W. Camden now resides, having advertised the same thirty days previous to the day of sale thereof, the aforesaid tracts or parcels of land and other property mentioned in this deed, or so much thereof as may be necessary to satisfy the security debts aforesaid, with legal interest, cost and attending the same, and also pay the debt due to said John F. Camden for settlement this day; and the surplus if any, remain to be paid to the said William W. Camden or his legal representative, should the said W. W. C. make no default in the above mentioned debts with interest and cost; then this Indenture to be void, else to remain in full force and virtue.
