DEED OF TRUST: Campbell to Wright SOURCE: Nelson County Deed Book 7, Page 521 CONTRIBUTOR: Sylvia Ray ------------------------------------------------------- This Indenture made and entered into this 22nd day of July 1833 between Francis Campbell of the County of Nelson and State of Virginia of the one part, William Wright and Hezekiah Jones of said County of the second part, and George G. Wright assignee of Henry Campbell Sr. of the third part, witnesseth, the said Francis Campbell for and in consideration of the sum of one dollar to him in hand paid at and before the ensealing and delivery of this Indenture, the receipt whereof is hereby acknowledged and for the further consideration that the said Francis Campbell stands justly indebted to the said George G. Wright in the sum of one hundred and eighty dollars by bond bearing date 15th of July 1833 and payable on or before the 1st day of June 1834 and to carry interest from date, and the said Francis Campbell being willing and desirous to secure said debt with all interest and cost thereon hath given, granted, aliened, ensured and confirmed, and by these presents doth give, grant, bargain, sell, alien, ensure, confirm and deliver to them the said William Wright and Hezekiah Jones, heirs and assigns forever the following property to wit, both real and personal (to wit): one hundred and ninety one acres of land lying on Elk Creek, it being the land on which said Francis Campbell now lives on, Lucinda a negro woman and Philles her child, one negro boy child about three years old named Cephus. Upon trust nevertheless that in case the said Francis Campbell shall fail or make default on the payment of the debt aforesaid on or before the first day of June 1834, then in that case the said William Wright and Hezekiah Jones, or either of them shall if requested by the said George G. Wright, proceed to sell the property aforesaid, both real and personal, with its increase, or any part thereof sufficient to discharge the debts aforesaid and all other expenses incident to the execution of this trust with highest bidder for cash, having first given fifteen days previous notice of the time and place of sale by advertisement at the Courthouse door of Nelson County on some Court day, and from the proceeds sale first pay and satisfy all cost attending the drawing, recording and executing this deed, then pay and satisfy if the proceeds of sale amount to so much, the debt aforesaid and if the proceeds exceeds the debt, interest and costs aforesaid, the excess to the said Francis Campbell or his legal representative, and it is further understood that in case the said William Wright and Hezekiah Jones should depart this life before the sale of the property aforesaid, their executors or administrators or either of them shall be at liberty and are hereby vested with right and power to execute this trust, and in case the said Francis Campbell should fail or refuse to deliver the property or any part thereof to the said William Wright and Hezekiah Jones or their executors aforesaid as the case may be at such time and place as may be appointed for the sale whereof, the said William Wright and Hezekiah Jones, or their executors aforesaid shall sell the property although it may be absent and the said Francis Campbell hereby ratifies and confirms such sale.
