DEED OF TRUST: Francis Campbell SOURCE: Nelson Co., VA Deed Book 8, Page 52 CONTRIBUTOR: Sylvia Ray -------------------------------------------------------- This Indenture made and entered into this 12th day of May 1834 between Francis Campbell of the County of Nelson of the first part, Edmund F. Coffey and Powhatan Parrish of said County of the second part, and Nancy Coffey wife of said Francis Campbell, Polly Campbell, Nancy Campbell, Elizabeth Campbell, Manerva Campbell, Malina Campbell, Francis J. Campbell, and Edmund J. Campbell of the third part, witnesseth that whereas the said Francis Campbell is desirous to secure to his wife the said Nancy and her children a home and suitable support, and he not owing more than what he considers is present crop of tobacco on hand will pay, hath deemed it proper to make this conveyance particularly as he received the greater portion thereof with his wife from her father's estate therefor and in consideration of the promises, and the sum of one dollar to the said Francis Campbell in hand paid by the said Edmund F. Coffey and Powhatan Parrish the receipt of which is hereby acknowledge so the said Francis Campbell hath granted, bargained and sold and by these presents doth give, grant, bargain and sell unto the said Edmund F. Coffey and Powhatan Parrish the following real and personal property to wit: 200 acres of land on Elk Creek, a branch of Tye River in the County of Nelson, the same land whereon the said Francis Campbell now resides and adjoining the lands of the estate of John Demasters and all others, also one location or entry made for fifty acres adjoining the above tract hereby conveyed, also one negro woman named Lucinda and her two children Cofus and Sarah, also one big mare and colt, four head of cattle, ten head of hogs, and all the household and kitchen furniture of every description and plantation utensils and the increase of the slaves and stock and every part and portion thereof, to have and to hold the same and every part and portion thereof free from the claims of all person or persons whomsoever. Upon trust nevertheless that the land and other property hereby conveyed shall remain in the possession of the said Francis Campbell during his own life and that of his wife and be subject to their management and control so far as it may be necessary that they should take control for the good government of the family and they shall have the income arising from the labour of the slaves, the work or rent of land and stock of all descriptions for a support and maintenance and after the death of the said Francis Campbell and Nancy, his wife, the property hereby conveyed shall be equally divided by the Trustees aforesaid among the several children of the said Francis and Nancy, but if any one or more of the children should marry or leave the family then the said Trustees, by and with any suitable advancement to such child or children, but they are to be accountable therefor at the final division of the estate. The object of this deed is to secure the property herein conveyed from being improperly squandered or wasted wherefor the legal title is vested in Trustees and the said Francis Campbell for himself, his heirs do hereby forever warrant and defends a good title to the property and land aforesaid.
