Deed: Henry B. Coffey, 1862 Source: Nelson County VA Deed Bk 16, Pg 334 & 335. Contributor: Shirley Houk This Deed made this 22nd day of December in the year A. D. one thousand eight hundred and sixty two between Seaton H. Loving Clerk of the County Court of Nelson County of the one part and Henry B. Coffey of the said County of the other part. Witnesseth. That whereas the said Henry B. Coffey became the purchaser of the following tract of lands sold for errears (sic) of taxes under the laws of the Commonwealth of Virginia and whereas by the laws of said Commonwealth the Sheriff of Nelson County was directed to sell all delinquent lands taxed by law on which the taxes had not been paid or which had been taxed and liable to be sold for the non payment of taxes, as more particularly described by the Statute laws of Virginia, reference to which is here made for greater certainty, as bearing on the land hereinafter mentioned and without reciting the said laws. And whereas Dennette (?) A. Witte Sheriff of the said county did after having done and performed all things acquired by the Sheriff in such cases to be done and performed by the said laws of the Commonwealth previous to the day of sale herein after named, did on the 24th day of September 1860 (that day being court day, held at the court house of Nelson County, at the place required by law, at said court house), __posed to public sale according to law, the following tract of land, among a number of other tracts, sold for the non payment of taxes, to wit: one tract of one hundred and two acres taxed in the name of Wm. Coffey deceased, as Lot No. 2, Estate of Edmund Coffey (it should be Lot No. 3) for the non payment of taxes in and for the years 1857, 1859 amounting to $2.69 (two dollars & sixty nine cents) and the said Henry B. Coffey having become the bidder for the whole tract at the price mentioned, and no person being willing to pay the taxes hereon for a less number of acres or quantity of land, the said tract of land was __?__ off to him the said Henry B. Coffey as the purchaser for and on the terms aforesaid. And whereas it is represented to the said Seaton H. Loving Clerk as aforesaid, that the said tract of land, (nor any part thereof) has been redeemed or offered to be redeemed, in the mode required by law, and no person having deposited with said Clerk any certificate of redemption of said tract of land sold as aforesaid. And whereas the time of redemption has fully expired, and the said Henry B Coffey having required of said Seaton H. Loving Clerk as aforesaid to make him a deed to said tract of land in the manner prescribed by law, he having complied with the terms of sale on his part. Now for and on consideration of the premises, and in pursuance of the powers vestide (sic) in me by law, and the further consideration of one dollar to me in hand paid by the said Henry B Coffey. Before the sealing and delivery hereof I, Seaton H. Loving Clerk of the county court of Nelson County do hereby grant and convey to the said Henry B. Coffey, his heirs executors administrators and assigns forever, all such title and estate in and to the aforesaid tract of land purchased as aforesaid and (according to a plat and division of the lands of Edmund Coffey deceased, recorded in Will Book D. page 71 in this office) bounded as follows, to wit: Beginning at a Beech at H on the north side of the North Fork of Tye River near the mouth of Pannels Branch and running thence N53 E49 po. to pointers at I thence N76 E88 po. to a Chesnut (sic) S. 33. E 45 po. to Pointers S 35. W 136 po. to Chesnut (sic) Oak, S 60 W. 90 po. to a fallen down White Oak on the north bank of said River at K, & thence up the north banks of the same as it meanders 155 po. to the beginning, it being Lot No. 3 and contains 102 acres, as was, at the day of sale thereof herein before recited vested in the said William Coffey deceased. To have and to hold the said tract of land to the said Henry B. Coffey, his heirs __?__ But the said Seaton H. Loving Clerk as aforesaid, merely executing the power under the authority aforesaid, undertakes to convey no warranty whatever concerning the same. Witnesseth the following signature and seal.
