Coffey, 1854 Source: Nelson Co., Virginia - Deed Book 14, Pages 146-148 Contributor: Carol Harlow and Shirley Houk ------------------------------------------------------------- This indenture made this 2nd day of September in the year of our Lord one thousand eight hundred and fifty four between William W Coffey of Nelson County and State of Virginia of the one part and Peter J. Hight of the same County and State aforesaid of the other part. Whereas the said William W Coffey is indebted to John B. Luntsford of the same County and State aforesaid in the sum of three hundred dollars current money of Virginia the payment of which sum with legal interest thereon from this day the said William W Coffey is william (sic) desirous effectually (sic) to assure and secure to the said John B. Luntsford this indenture therefore witnesseth that the said William W Coffey as well in consideration of the _______ aforesaid as if one dollar paid to him in hand by the said Peter J. Hight the receipt whereof the said William W Coffey doth hereby acknowledge hath granted bargained sold and conveyed and by these presents doth grant bargain sell and convey unto the said Peter J. Hight his heirs and assigns the tract of land recently bought of the said John B. Luntsford together with all the personal property belonging to the said William W Coffey viz one sorrel mare and her increase, one sorrel colt, one yoke of red steers, one red cow and one red spotted heifer with their increase, four red and spotted calves, two beds and bedsteds (sic), two tables, one bureau, one safe, one clock, one set of chairs, six pieces of castings, one saddle, one shotgun, twelve head of sheep with their increase and twenty five spotted and black hogs with their increase, three plows and five hoes and his present crop of tobacco to have and to hold the aforesaid land and personal property to the said Peter J. Hight or his heirs and assigns and to his proper use and behoof forever in trust nevertheless if the said William W Coffey his heirs Executors and administrators shall on or before the 2nd day of September one thousand eight hundred and fifty five will and truly pay to the said John B. Luntsford his heirs administrators or assigns the sum of fifty dollars with legal interest thereon from the aforesaid 2nd day of September one thousand eight hundred and fifty four and the other two hundred and fifty dollars to be paid in five equal yearly payments each bond to draw interest from the aforesaid 2nd day of September one thousand eight hundred and fifty four, then this indenture and everything herein is to come void but if the sum of three hundred dollars with the interest due thereon or any part thereof shal (sic) be or remain unpaid then the said Peter J. Hight his heirs or assigns shall and may sell and dispose of the aforesaid tract of land and personal property at publick (sic) auction to the highest bidder for ready money having given at least twenty days notice of the time and place of sail (sic) in some publick newspaper printed nearest the place of sale and that the proceeds of such sale after paying the execution of this trust shal be applied by the said Peter J. Hight his heirs or assigns towards the discharge and payment to the aforesaid John B. Luntsford of the aforesaid sum of three hundred Dollars with the interest which may be due thereon and the surplus of the said proceeds if any their shall be is to be paid to the said William W Coffey or his assigns and the said William W Coffey for himself his heirs and assigns and administrators doth hereby covnant (sic) promise and grant to and with the said Peter J. Hight his heirs or assigns that he the said William W Coffey his heirs and assigns shall and will warrent and forever defend the aforesaid land and personal property unto the Peter J. Hight his heirs and assigns against all and evry (sic) persons whomsoever claiming or to claim in witness whereunto the said partys (sic) hereunto have to these presents set their hands and seals the same day and year first in this indenture written. Hight {seal} William Coffey Nelson County to wit} I Nathl Bowles a Justices of the peace in the county aforesaid in the State of Virginia do hereby certify that William W Coffey a party to a certain deed bearing Date on the 2nd day of September 1854 and hereto annexed personally appeared before me in my County aforesaid and acknowledge the same to be his act and deed and desired me to certify the said acknowledgement to the Clerk of the county court of Nelson in order that the said deed may be recorded given under my hands and seals this 14th day of October 1854.
