Contributor: Shirley Houk --------------------------------------------- This Indenture made and entered into this 28th day of July 1864 between Alexander Fitzpatrick a commissioner appointed by the county court of Nelson in a suite in said court pending wherein Nathaniel Bowles is plaintiff and Johnson Thacker and others are defendants. Witnesseth that the said Fitzpatrick in virtue of the powers conferred upon him by the said court in the said suit doth convey to Joseph Dunning the tract of land in the bill and proceedings mentioned and known as the poplar flat containing fifty acres and lying on the south side of Tye River at the mouth of Coxes Creek with all and singular the appurtenances thereto belonging to have and to hold the same free from the claim or demand of any or all of the heirs or representatives of Samuel Gay deceased and free from the claim or demand of them or their heirs forever to the only proper use and behoof of the said Joseph Dunning and his heirs or assigns forever in witness whereof I have hereunto set my hand and seal the day and date first above written.
