DEED: James M. Hight Deed of Trust, 1851 SOURCE: Nelson County Deed Book 14, Page 41 CONTRIBUTOR: Sylvia Ray ------------------------------------------------------------ This Indenture made and entered into this 6th day of January 1851 between James M. Hight and Jeals his wife of the one part, and Hugh S. Brent of the other part and all of the County of Nelson and State of Virginia, witnesseth that the said James M. Hight and Jeals his wife, for and in consideration of the sum of $260 to them in hand paid at and before the ensealing and delivery of these presents, the receipt whereof is hereby fully acknowledged, have granted, bargained, sold and delivered and do hereby grant, bargain, sell, deliver, alien, enfeoff, and confirm unto him the said Hugh S. Brent, a certain tract or parcel of land containing 64 acres, lying and being in the County of Nelson on the west fork of Ruckers Run and bounded as follows to wit: Beginning at pointers S 10-3/4 degrees E 194 poles stake N 32-1/2 degrees W 152 poles, pointers on a small pine and hickory sapling N 56-3/4 degrees E 99-1/2 poles Chestnut oak amongst pointers N 46 W 22 poles white oak stump and clayed saplings N 67-1/2 degrees W 46 poles Chestnut N 41-1/2 degrees E 29 poles pointers S 81-3/4 degrees E 43 poles to the beginning, the same being that portion of the estate of Lawrence Wills, deceased, allotted to the said James M. Hight by Littleberry N. Ligon, Robert H. Anderson, and John H. Hill, Commissioners. To have and to hold the hereby conveyed tract or parcel of land together with all and singular the improvements and appurtenances in anywise thereunto belonging to him the said Hugh S. Brent, his heirs or assigns forever and the said James M. Hight and Jeals his wife do for themselves, their heirs, executors and administrators covenant and agree to and with the said Hugh S. Brent, his heirs but that to the hereby conveyed tract or parcel of land they will warrant and forever defend a good and sufficient right, title, and interest to him the said Hugh S. Brent, his heirs and assigns forever, free from the claim or claims of them the said James M. Hight and Jeals his wife, their heirs and assigns to and from the claim and claims of all and every person or persons whatever either at sale or in equity. In testimony whereof the said James M. Hight and Jeals his wife have set their hands and seals the day and year first written. James M. Hight {seal} Jeals Hight {seal} Nelson County, to wit: We, Robert H. Anderson and Floyd L. Whitehead, Justices of the Peace in the County aforesaid and in the State of Virginia, do hereby certify that Jeals Hight, the wife of James M. Hight, parties to a certain deed bearing date the 6th day of January 1851, and hereunto annexed, personally appeared before us in our County aforesaid and being examined by us privily and apart from her husband and having the deed aforesaid fully explained to her, she the said Jeals Hight acknowledged the same to be her act and deed and declared that she wished not to retract it. Whitehead, Justices of the Peace in the County aforesaid and in the State of Virginia, do hereby certify that James M. Hight, party to a certain deed bearing date the 6th day of January 1851, and hereunto annexed, personally appeared before us in our County aforesaid and acknowledged the same to be his act and deed and desired us to certify the said acknowledgment to the Clerk of the County Court of Nelson in order that the said deed may be recorded.
