DEED: James M. Hight Deed of Trust, 1853 SOURCE: Nelson County Deed Book 13, Page 494 CONTRIBUTOR: Sylvia Ray ------------------------------------------------------------ This Indenture made this 17th day of March 1853 between James M. Hight of the first part, and Robert Whitehead of the second part, witnesseth that the said James M. Hight doth grant unto the said Ro Whitehead the house and lot of land situated in the town of Jonesborough on which the said Hight now resides containing about three and three quarters acres, and bought of the heirs of Thomas Jones in trust nevertheless to secure the amount of an execution in the name of said Hight against a certain Robert C. Jones, on which there is a delivery bond in the hands of Joseph S. Harris, deputy for Joseph H. Shelton, Sheriff of Nelson which execution was issued upon a decree in favor of said in a certain injunction case pending in the Circuit Court of Nelson County in the name of said Hight against said Jones for the sum of $212.64 with interest from the 1st day of January 1850 and costs and which was transferred to Richard J. Cockes Trustee in a deed executed to him by Ellis and others: to which decree and execution the said Jones being entitled to a certain offset required and due before said transfer, and he threatening to enjoin, authority has been given to said Hight to settle and control said execution and decree, upon his agreement to execute this deed so as to effectuate the object had in view by said transfer which is filed in said cause by Hight vs Jones and to which reference is hereby made. Should suer Hight not settle said execution as contemplated and return to said Whitehead the authority in writing so to do then this Indenture to be void otherwise to remain in full force.
