Deed: Joel Hight, 1848 Source: Nelson Co., VA Deed Bk 12, Pg 318 Contributor: Carol Harlow ---------------------------------------------- This Indenture made this 3 day of June 1848 between Joel Hight of Nelson County of one part, and Jacob Warrick of said County of another part, and Thos. J. Massie of the said County of the other part, whereas the said Thos. J. Massie is security (in conjunction with John H. Campbell and George H. Campbell) for the said Joel Hight in the sum of _____ dollars in an injunction bond executed by said Hight at the Clerks Office of Nelson County Superior Court, upon injunction granted said Hight by the Judge of the Circuit Superior Court of Law & Chancery for Nelson County against John Steele of Augusta County, Admr. with the will annexed of George Hight-decd. dated ___ day ___ 1845 which bond is on file in the said Clerks of Nelson County and sued upon by the Admr. the injunction having been dissolved & c - and the said Joel Hight being desirous to secure and save the said Thos. J. Massie against all responsibility and danger as security on said bond, therefor this Indenture witnesseth that the said Joel Hight, as well for and in consideration of securing the said security upon the payment of said bond as the sum of one dollar to him in hand paid by the said Jacob Warrick at and before the sealing and delivery of these presents, the receipt is hereby acknowledged, hath granted, bargain, sold, released, and confirmed and by these presents doth grant, bargain, sell release and confirm unto the said Jacob Warrick his heirs, and assigns, the entire tract of land on which the said Joel Hight now resides, lying and being partly in the counties of Nelson Rockbridge and Augusta, but mostly in Nelson County containing one hundred and fifty acres, more or less, also one other tract of land lying and being in the County of Rockbridge containing eighty acres more or less -------- together with all and singular the improvements and appurtenances thereto belonging or in any wise appertaining and the reversions and remains unto and profits thereof, to have and to hold the said tracts of land, with the appurtenances unto the said Jacob Warrick his heirs, and assigns forever, provided nevertheless that if the said Joel Hight his heirs Exors. or administrators shall and do well and truly pay or cause to be paid unto the said John Steele administrator as aforesaid the bond as aforesaid, or by other lawful means, save, keep harmless and indemnified the said Thos. J. Massie his heirs Exor. and Admr. from the payment of said bond, and all costs, damages or charges, as security aforesaid, then and from thenceforth, as well this present Indenture, and the estate hereby granted, as the said bond, shall cease, determine and become absolutely void, anything herein contained to the contrary not withstanding.
