DEED: Daniel Mays, son of Jesse, deed of trust, 1817 SOURCE: Nelson County, VA Deed Book 2, page 591 CONTRIBUTOR: Valerie Burd ----------------------------------------------------------- This Indenture made and entered into this 26th day of May 1817 between Daniel W. Mays of Nelson County of one part, Robert J. Kincaid of said County of a second part, and Lavender London of a third part; Witnesseth that the said Daniel Mays in order to secure indemnify and save harmless the said Lavender London, in becoming his security in two Bonds bearing equal and even date herewith one to James P. Garland & Co. for the sum of Sixty eight Dollars and fifty cents payable the 15th day of November next with interest from the date thereof and one to Solomon Matthews & Co. for one Hundred and Ten Dollars and sixty seven cents payable the 1st day of May next with interest from the 26th day of March last and for the further sum of one dollar to him in hand paid by the said Robert J Kincaid at and before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained and sold and do by these presents grant bargain and sell alien enfeoff and confirm unto the said Robert J. Kincaid his heirs or assigns forever ~ sell his right title and interest in and to the Estate of Austin Mays Decd., his brother, and of his father Jesse Mays Decd and sell the crops of every every description, which he now has, or is now growing ~ with all the appurtenances thereunto belonging. ~ To Have and to Hold the said hereby Conveyed Estates or interests therein and the Crops aforesaid to him the said Robert J. Kincaid, his heirs or assigns forever, and the said Daniel W. Mays for himself, his heirs and etc doth hereby convenant and agree to and with the said Robert J. Kincaid his heirs & etc. to warrant and forever defend a good and sufficient right title and interest theretor free from the claim or claims of himself his heirs & etc. and of all and every person or persons whatever. Upon this special Trust nevertheless that if the said Lavender London shall have to pay or become liable to pay both or either of the herein named debts at the times they shall become due, then it shall be lawful for the said Robert J. Kincaid, his Executors or etc. to expose the said hereby conveyed estates or interest therein and the crops aforesaid to the highest bidders at public sale for cash, at the most convenient public place to said estate and most convenient for delivery of said crops after having advertised the time of such sale ten days previous thereto at the Courthouse doors of Nelson County including one Court day, and out of the monies arising therefrom to pay and satisfy the money said lavender London may have to pay as aforesaid and the costs of this instrument and the surplus if any to pay to the said Daniel W.
