Deed: Kincaid Whitehead Source: Nelson County, VA Deed Bk 16, Page 293. Contributor: Shirley Houk This Deed made the 30th day of April in the year A. D. one thousand eight hundred and sixty four, Between Seaton H. Loving Commissioner for the purpose appointed, of the one part, and Kincaid Whitehead of the other part all of the County of Nelson. Whereas by an order of the circuit court for Nelson County pronounced on the 27th day of April 1864, in the Chancery cause then pending in the name of John W. Coffey & others Plaintiffs against Matilda Coffey & others defendants, it was among other things decreed and ordered as follows; and the Court doth further adjudge order and decree that Seaton H Loving be and he is hereby appointed a commissioner for the purposes, whose duty it shall be, to convey by deeds with Special Warranty, to the several purchasers of the several tracts of land in the proceedings mentioned, as follows, viz: To Francis J. Campbell the 24 ½ acre tract, to the widow & the heirs of John W Coffey deceased (he being dead) the 26 acre tract, to Mary S. Parrish the 50 acre tract, to Garland Coffey the 55 acre tract (originally bought by Cosen W Parrish & by his widow, the said Mary S Parrish, resold to said Garland Coffey, to Kincaid Whitehead the 198 ½ acre tracts and to said Garland Coffey the 67 ½ acre tract, at their respective costs. Now this deed witnesseth that in consideration of the premises, and the further consideration of two dollars to him in hand paid, at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, he the said Seaton H. Loving commissioner as aforesaid has granted, and by these presents, doth grant with special warranty, unto the said Kincaid Whitehead a certain tract or parcel of land lying on the north fork of Tye River in said county containing one hundred and ninety eight & a half acres, being one of the tracts of land belonging to the Estate of Edmund S. Coffey deceased and sold by commissioner appointed for the purpose, and is the same tract purchased by said Edmund S. Coffey of John Thompson, and a portion of the lands in the bill and proceedings mentioned. Witness the following signature and seal: S. H.
