DEED: Benjamin Wright and Wife to David Schultz, 1833 SOURCE: Nelson County Deed Book 8, Page 300 CONTRIBUTOR: Sylvia Ray ------------------------------------------------------------------ This Indenture made this first day of August in the year of our Lord one thousand eight hundred and thirty three between Benjamin Wright and Dicey, his wife, of the County of Amherst and State of Virginia of the one part, and David Shultz of the County of Augusta and State aforesaid of the other part, witnesseth that the said Benjamin Wright and Dicey his wife, in consideration of the sum of three hundred dollars in hand paid to the said Wright and wife by the said Shultz at or before the ensealing and delivery of these presents, the receipt whereof is hereby acknowledged, have bargained and sold and by those presents do grant, bargain and sell unto the said Shultz, his heirs and assigns, a certain tract or parcel of land containing one hundred and three acres situated in the County of Nelson in Virginia on the head branches of the South fork of Tye River and bounded as follows: beginning at pointers on the east brace of the rich hill comes to Thomas Massie running thence S66E28 poles to a mountain mahogany on Massie's line thence new lines N84E40 poles to pointers near a large rock, thence S56E41 poles to pointers N55E92 poles to pointers of bushes in James Campbell's line, thence with the same N43E15 poles to a chestnut N68E48 poles to pointers, thence new lines N5E60 poles to a chestnut, thence N35W9 poles to a chestnut and pointers on Doswell's line, thence S59W68 poles to pointers N35W37 poles to a chestnut S72W60 poles to a mountain mahogany, thence new lines S2E41 poles to a hickory and thence S35E2 poles to the beginning, and also one other tract or parcel of land containing eighty one acres situated in the County and State aforesaid and on the head waters of the south fork of Tye River as aforesaid and bounded as follows, to wit: Beginning at a chestnut at an old mill in Thomas Doswell's line thence a new line S48W20 poles to pointers S55W26 poles to a cottonwood S26W100 poles to a sugar tree S23E12 poles to birch N70E61 poles to a chestnut in Thomas Doswell's line and thence with the same N61W95 poles to the beginning with all and singular the advantages and appurtenances whatsoever to the said tracts or parcels of land belonging or appertaining to the only proper use and behoof of him the said David Shultz, his heirs or assigns forever, to have and to hold the said tracts of lands and tenements thereto, it amends all singular the promises herein before mentioned and every part and parcel thereof with every of their rights, members, and appurtenances unto him the said David Shultz, his heirs and assigns forever and they, the said Benjamin Wright and Dicey his wife, for themselves and their heirs the said lands with all and singular the promises and appurtenances before mentioned unto the said David Schultz, his heirs and assigns free from the claim or claims of them the said Benjamin Wright and Dicey his wife, their heirs and of all and every person or persons whatsoever, shall, will, and do warrant and forever defend by these presents. In witness whereof, the said Benjamin Wright and Dicey his wife, have hereunto set their hands and seals on the day and year first above written. His Benjamin (X) Wright {seal} Mark Her Dicey (X) Wright {seal} Mark Augusta County to wit: We James Alexander and Robert Steele, Justices of the County aforesaid in Virginia, do hereby testify that Dicey Wright, wife of Benjamin Wright, a party to the annexed deed bearing date the 1st day of August 1833, personally appeared before us in our County aforesaid and being examined privately and apart her husband and the deed aforesaid fully explained to her, she acknowledged the same to be her act and deed and she had willingly signed the same and that she did not wish to retract it and that she wished us to certify said acknowledgment to the Clerk of the County Court of Nelson. This deed for land was this day presented in said Court duly certified by two Justices of the Peace for the County of Augusta and the same together with the relinquishment of dower of Mrs. Dicey Wright, also returned duly certified by the same Justices is ordered to be recorded.
