DEED FOR LAND: Jesse Wright to Daniel Wright and Nancy Wright SOURCE: Nelson County Deed Book 8, page 555 CONTRIBUTOR: Sylvia Ray ------------------------------------------------------------------- This Indenture made and entered into this 1st day of February 1838 between Jesse Wright Sr of the one part and Daniel L. Wright and Nancy Wright of the other part, all of the County of Nelson and State of Virginia, witnesseth that for and in consideration of the natural love and affection which I, the said Jesse Wright have for the said Daniel L. Wright and Nancy Wright, the receipt of which is hereby fully acknowledged, doth give, grant, and confirm unto the said Daniel L. Wright and Nancy Wright and their heirs forever, free from the claim or claims of any person or persons whatsoever, five certain tracts or parcels of land lying and being as hereafter named, the first tract or parcel of land herein named, lying in the County of Amherst on the North Fork of Piney River containing by estimation eighty one acres be the same more or less, or by Patent, bearing date at Williamsburg the 10th day of September 1755 and bounded as followeth viz: Beginning at George Taylor's corner Hickory on the south fork of Piney River, tens north 72 degrees, west 161 poles to a chestnut, thence new lines at 60 degrees East 162 poles to a chestnut oak, thence South 61 degrees East 55 poles to a chestnut oak and then South 10 degrees East 40 poles to a red oak on the North fork, thence, down the same as it meanders 150 poles to the beginning. Also another tract or parcel of land lying in said Amherst County containing by estimation eighty seven acres, be the same more or less and bounded as followeth viz: Beginning at a hickory by the River, running from thence North 70 degrees West 330 poles to a red oak, thence along the lines expressed in the Patent, to a Branch, thence down the same with John Massie's line to Crawley's Creek, thence down the Creek to the River, thence up the river, as it meanders, to the beginning. Also another tract or parcel of land lying and being in the County of Amherst and containing by estimated six acres, be the same more or less, Beginning at a chestnut corner to Jesse Massie, thence his line South 80 degrees West 18 holes to pointers corner to John Camden, thence his line North 31 degrees East 100 poles to a chestnut oak and locust corner to Jesse Wright and thence with his line South 16 degrees West 96 poles to the Beginning. Also another certain tract or parcel of land lying in the County of Nelson, formerly Albemarle, according to poles containing by estimation, one hundred acres be the same more or less lying on the North side of Piney River and bounded as followeth. Beginning at a white oak and running up the River 280 poles to a White Oak, thence North 45 degrees East 82 poles to a chestnut and dogwood, South 11 degrees East 200 poles to pointers and South 45 degrees West 82 poles to the beginning. Also another tract or parcel of land, lying and being in the County of Nelson, formerly by patent Amherst County, containing by estimation fifty acres, be the same more or less, and bounded as followeth, Lying on both sides of Mayfield's Creek, a Branch of Piney River, Beginning at a spanish corner to Campbell Goode with his line South 83 degrees East 86 poles to a chestnut oak on said Goode's line, thence a new line North 4 degrees East 10 poles to a chestnut on Phillip Davis' line and with them to North 30 degrees West 44 poles to a Red Oak North 31 degrees West 14 poles to pointers thence new lines, North 53 degrees West 24 poles to a White Oak South 71 degrees West 52 poles to Black Gum, North 82 degrees North 30 poles to a White Oak near Mayfield's branch, corner to John Camden and Jesse Wright and with his line, South 10 degrees East 32 poles to a white oak, South 5 degrees West 8 poles to pointers South 5 degrees East 12 poles to the Beginning. To have and to hold, the said tracts or parcels of land with all their appurtenances, in fee simple, to them and their heirs forever with the following conditions, viz: That I, the said Jesse Wright, am to remain feasible possession of my Manchion House, and other houses that I may stand in need of and any reasonable portion of land that I may want for to cultivate with my hands; also a reasonable portion for pasturage of my stock during my life and after which the said Daniel L. Wright to receive two thirds of the before mentioned tracts or parcels of land, at value, and the said Nancy Wright the other third of the before mentioned tracts of land, at value, with all the appurtenances to each one's division according to the portion. It is understood that the said Nancy Wright has the privilege of choosing her third part of the before mentioned land where she may please with all its appurtenance at salvation, and in cases the said Daniel L. Wright and Nancy Wright should not agree in the value of each one's portion of the before mentioned land, then in that case for the value to be ascertained by the Judgment of three disinterested persons, whom they may choose themselves, if they think proper, it is understood that the said Daniel L. Wright is to have the benefit and controls of two thirds of all before mentioned tracts, that is, two thirds of that portion which the said Jesse Wright may not cultivate or use of pasturage. Wright, Justices of the Peace, for the County aforesaid, in the State of Virginia, do hereby certify that Jesse Wright, a party to the foregoing deed bearing date 1st day of February 1838, personally appeared before us in our County aforesaid and acknowledged the same to be his act and deed and desired us to certify the said acknowledgment to the Clerk of he County Court of Nelson, in order that the said deed may be there recorded.
