AGREEMENT OF DIVISION OF ESTATE: John Camden, deceased SOURCE: Nelson County Will Book C, Pages 482-485 CONTRIBUTOR: Sylvia Ray ------------------------------------------------------------ Be it known to all whom it may concern that we James Camden, Wiatt Camden, Chappell Davenport for himself and Nancy his wife late Nancy Camden, William W. Camden, John F. Camden, Benjamin Camden, John Hight for himself and Elizabeth his wife late Elizabeth Camden, and John F. Camden as attorney in fact for Joseph Eskew who intermarried with Sally Shields late Sally Camden, being the only heirs and legal representatives of John Camden, deceased. Being desirous of settling and dividing the personal estate of the said John Camden, deceased, share and share alike, in order to accomplish that objective have agreed upon the different sums advanced by the Intestate John Camden, deceased, to the different Legatees as above named and we have also agreed and mutually consented that George Williams, William M. Waller, Alexander Marr and David S. Garland shall appraise the slaves belonging to the Estate of the deceased and out of the slaves so valued assign to such of the said Legatees as shall be deficient so many of the said slaves as will make their respective lots equal or as near as may be, and in order to make the lots equal, bonds from the Legatees in a sum not exceeding one hundred dollars payable within twelve months shall be taken and received for any deficiency in their respective lots. It is also understood that Wiatt Camden and George G. Wright the administrators of the said John Camden, deceased, shall retain for the purpose of satisfying the demands against the Estate of the Intestate five negroes-Creasy, Ephraim, Harrey, Addaline, and Willy, which are left in their hands as assets, and that on the first day of January next they are to take into their possession two negroes George and Susan, two negroes that are now the subject in a suit brought by William L. Dickie against the said administrators. These negroes are to be held subject to the final determination of the said law suit and these negroes with the five first named slaves with their heirs are to be accounted for by the said administrators in the final settlement of their accounts. It is understood and agreed that the accounts against the different Legatees for advances shall stand as follows, viz: Benjamin Camden $ 1590.15 William W. Camden $ 2178.82 John F. Waller, Alexander Marr, and David S. Garland shall after valuing the property belonging to the Estate of the Intestate which has not been retained by the administrators they shall equalize the lots of the different Legatees, share and share alike, and it is further agreed and understood that the Legatees aforesaid will, all will and truly abide by and perform on their respective parts all the covenants contained in this agreement and that the assignment and division made in pursuance of this agreement shall be regarded as final and obligatory between the contracting parties for the true performance of which they bind themselves, their heirs, executors or administrators.
