Source: Nelson County, VA Will Book "D", p.473 Contributor: Sam Shelton ---------------------------------------------------- James Clarkson of Nelson County, died March 5, 1836 Will of James Clarkson, Nelson County Will Book "D", p.473: I James Clarkson of the county Of Nelson do hereby make my last will and testament in manner and form following to wit: I give to my wife Elizabeth Clarkson for her use during her life, the house and land on which we reside, with all the appertenances, negroes Diley(Dicey?), Lilly, Lucy, Nancy, Solomon and Jack, the black(unclear), the young bay mare, and her riding horse, commonly called old Dick, three choice cows, and as many of the young cattle as she wants, as many of the hogs as she wants, and of the sheep what she wants. It is my will also that she shall have a sufficiency of household and kitchen furniture, and plantation tools, gear and whatever else that belongs to the plantation, that m(a)ly be necessary for her convenience and comfort. I hereby give to my daughter Susanah Jones one horse to be selected in value as near as may be to make her in that kind of property equal with the rest of my children. I hereby give to my son John a negro slave Richmond, which is to be charged to him as a part of his legacy of my estate, and it is my desire that John should be charged with no money but to him, further than what he thinks he should be charged with, and that without interest. It is my will that John shall have one feather bed and furniture to make him equal with the rest of my children in that kind of property. I give to my son Nelson one negro slave named Joe, to be charged as a part of his legacy of my estate. I hereby direct that my executors(to be hereby named)shall sell as much of my estate as will pay all my just debts, that in doing so they shall sell as much property as in their opinion will do least injury to the estate on a credit not less than. It is my will that all the slave which I have given to my children be valued at what they were worth at the time they were given, making the present value of slaves the standard, and that the balance of my slaves not heretofore disposed of be so divided that there shall be alloted an equal share to Nelson, John, Peter, Davy, Sally, William and Susannah, taking into account what they have received heretofore. It is my will that that portion of my estate alloted to my son Peter be held in trust by my son Nelson, and I do hereby appoint Nelson as trustee and require that he shall pay Peter annually the nett proceeds of his property, and no more. At his death the property to go to his legal representatives. It is my will that that portion of my estate alloted to my daughter Sally be held in trust by my son Nelson, for the benefit of her and her heirs. It is my will however that she shall only draw the nett proceeds annually during her life, and at her death to be equally divided among her children. It is my will at the death of my wife that the balance of my estate be divided equally among my children or their legal representatives to go to them under the same restrictions as relates to my son Peter and daughter Sally as I have given to them their property before mentioned. And lastly I do hereby constitute and appoint William Massie and Nelson C. Clarkson executors of this my last will and testament, hereby revoking all former wills or testaments by me made. In witness whereof I hereunto set my hand and affix my seal this 28th day of Sept 1832. I give to my grandson James the son of John a negro boy the title to which I do hereby confirm and no notice of him is to be taken of him by my executors. I have directed Nancy to be added to the slave(sic)for my wife, and her name in (unclear)for that purpose.
