Will Book __, Page 117 CONTRIBUTOR: Dennis Truslow ------------------------------------------------------------ Last Will and Testament of Richard Lee (25 September 1848) I Richard Lee of the county of Nelson being of sound mind and disposing memory do declare ordain and publish this my last will and testament, in the manner and form following viz.- It is my will that all my just debts be speedily paid. I do leave to my beloved wife Nancy all my slaves together with all my real estate with my household and kitchen furniture, stock of all kinds, plantation utensils and all other personal estate during her natural life or widowhood and after her decease or the happening of the other contingency, it is my will and desire that my Exr. (Executor) hereinafter named shall sell the whole of my Real Estate upon one two and three years credit to the highest Bidder or Bidders first having advertised the time and place of sale at the court house door of Nelson County and at some public place in the neighborhood of the land at least three weeks before the day of sale requiring bond with approved security with a lien upon the land to secure the payment. To grant conveyance or and the proceeds arising from such sale to be equally divided among the whole of my Daughters viz., Jane Morris Susannah Trusler Pheby Gray Nancy Bridge Mildred Rachel, Judith Rebecca and Malinda, that portion which will be due to my daughter Susannah Trusler I convey in trust to Doctor Haws N. Coleman for the use and benefit of my said Daughter Susannah and her children and it is expressly my desire that her husband Joseph Trusler should have no control over that nor any other part of my estate neither is it to be liable for the payment of his debts. It is my will and desire after the decease of my wife Nancy or in case of the contingency above mentioned the whole of my slaves together with all my Personal Property of every description whatsoever be sold upon twelve months credit and the proceeds to be divided equally among my five single Daughters viz. Mildred, Rachel, Judith, Rebecca and Malinda. Lastly, I do hereby nominate and appoint my friend Doct. Haws N. Coleman Exr. (Executor) to this my last will and testament hereby revoking all other and former wills by me heretofore made. In testimony whereof I have hereunto set my hand and affix my seal this twenty second day of January in the year of our lord One Thousand Eight-Hundred and Thirty Five. Hughes mark At a court held for Nelson County the 25th day of September 1848 this instrument of writing purporting to be the last will and testament of Richard Lee dec.d was produced in said court and proved by the oath of Lawrence Gianniny a subscribing witness thereto and the hand writing of James B. Hughes another subscribing witness thereto was proved by the oath of Ryland Rodes and ordered to be recorded, and on the motion of Hawes N. Coleman the executor therein named who made oath thereto and together with William H. Diggs his security entered into and acknowledged a bond in the penalty of $6000.00 conditioned according to Law, certificate is granted him to obtain probate of said will in due form.
