Will: Samuel Parrish, 1838 Source: Nelson Co., VA Will Book F, Page 213 - 214 Contributor: Carol Harlow ------------------------------------------------------------------------------------------------------------- I Samuel Parrish of the county of Nelson and State of Virginia being of sound mind and disposing memory, and calling to mind the uncertainty of life and certainties of death, do make and constitute this to be my last will and testament revoking all other wills heretofore made by me. 1st--At my death my desire is that all my just debts be paid and all my funeral expenses also in the most convenient way that my executors may think proper whom I shall hereafter name. 2nd--I give and bequeath to my beloved wife, if she shall be the longest liver, during her natural life, the plantation on which I now live, and the following negro salves, Leury, Fanny, Eliza, one work beast, 2 milch cows, ten head of hogs, one yoke of oxen and as much household and kitchen furniture and plantation utensils as she may think proper to keep. 3rd--If my son Cosen thinks proper to keep the negro boy John which he has in possession, he is at liberty to do so by accounting to the rest of the legatees for six hundred dollars to be taken of his portion, otherwise return said boy to my estate. 4th--If my daughter, Lurandy thinks proper to keep the negro girl Dafney which she has in possession, she is at liberty to do so by accounting to the rest of the legatees for four hundred dollars to be taken out of her portion, otherwise return said girl Dafney to my estate. 5th--My desire is at my death that the whole of my estate both real and personal & otherwise of every nature and description which is not heretofore mentioned be equally divided between my children, Parks H Parrish, Willis R Parrish, Cosen Parrish, Powhatan Parrish, Lurandy intermarried with Benjamin Hughes and the children of my daughter Rocksy who has intermarried with Jesse L Hatter, said children to have one sixth part of my estate, equally divided between them to be kept in the hands of my trustees for their benefit and should my daughter Rocksy come to want for the necessities of life my desire is that my Executors & Trustees shall appropriate the income of the part left to her children during her natural life. 6th--My wish and desire is that the portion left to my children Parks H Parrish, Willis R Parrish, Cosen Panish, Powhatan Parrish, and Lurandy who intermarried with Benjamin Hughes be kept in trust, but in their possession and for them to enjoy the benefit & annual income during their natural life and at their death to be equally divided between their children. 7th--The portion of my estate left to my wife, during her natural life, at her death to be equally divided between my children as before mentioned in the same manner heretofore mentioned. 8th--I do hereby appoint my son Parks H Parrish, Cosen Parrish executors & trustees to this my will and testament as witness my hand and seal this 8th day of August 1838. Samuel Panish (seal) Witnesses Sylvanus Meeks Fitzgerald Jolm Everett Wm B Clarkson Clause 1st--The portion of property left to my son Powhatan Parrish in the foregoing Will should he have no legitimate children, said property shall return to my estate at his death and be equally divided between the other legatees in the same manner as the rest of my estate, in trust as afforsaid, also the said Powhatan Parrish shall account with the rest of the legatees at the division and payout of his portion to them sixty dollars which sum I have advanced for his benefit as witness I have hereunto set my hand and seal, the 20th day of February 1841.
