On a special plea by the defendant a previous action brought on behalf of the dead boy’s estate was dismissed. The defendant has now entered a new special plea, alleging that the case comes under the provisions of the Virginia Workmen’s Compensation Act, and that for this reason the court is without jurisdiction. This question will be argued at a date yet to be fixed by the court. John W. Oast Jr. is attorney for the parents in the action, while the firm of Hughes, Little and Seawell represent the defendant concern. The youth was a student at the Paul Laurence Dunbar school, and it was reported at the time of his death that he had just taken his first job. While attempting to operate the lift, he was crushed to death between a steel beam and the floor of the elevator.
