The last will and testament of Thomas Winter was Presented into Court by John Heath David Ball Junr. and John Hughlett three of the Executors therein named who made Oath thereto according to law. And being proved by the oaths of George Ball Gent. and George Dameron two of the witnesses thereto was admitted to record. As also a Certificate from under the hand of George Ball Gent. in Relation to the sd. Will: And on the motion of the Said Executors Certifcate is granted them for Obtaining a Probate thereof in due form Whereupon they together with Thomas Gaskins Gent. and Henry Hurst their Securities entered into and Acknowledged their bond in the Penalty of Five Thousand pounds currnt. money for thier due & faithful Administration of the Estate of the sd. testator & Perform’ce of his Will. William Townsend) until he arrives to the age of Twenty one years. In Consideration of which the said William Mott is to learn him the trade of a Bricklayer. And to find and provide for the sd. Haynie Townsend during the said term good and Sufficient Cloathing, meal drink washing and Lodging. For the due performance of which the said William Mott together with Ewell Alexander his Security Acknowledged themselves bound to the Court now Setting in the Sum of Five thousand pounds of Tobacco. Page 159 16 June 1763 The jury yesterday sworn to try the Issue joined between Hunters Campbell & Comp Plts and William Trussell Deft. this day brot in a Verdict for the Deft. on which the Court order’d them to withdraw and find a Special one. and after some time they again returned with a General Verdict for the sd. Deft. Whereupon the Plts prayed and had leave to withdraw a Juror & did withdraw the sd. Mathew Neale And the rest of the Jurors from giving any further Verdict are Discharged, And thereupon a Case was agreed bythe said Parites in Lieu of a Special Verdict in these words, to wit. “We agree that the company of Militia in which the sd. William Trussell was Inlisted, for sometime before and on the Day the Deft. was Arrested at the Suit of the Plts., was ordered to meet and Muster at a place not more than Thirty or forty yards distand from the dwelling house of the said William Trussell, and in which for the said William Trussell then kept Ordinary. We agree that the Aforesd. Arrest made on the sd. William Trussell at the suit of the aforesaid Plts. was made on him in his sd. dwelling House before Nine of the Clock in the forenoon of the day on which the sd. Company of Militia was order’d to meet to be Mustered, And that none of the Officers of the sd. Company of Militia did meet on the said day until between Eleven & Twelve of the Clock after the said Arrest was made on the said William Trussell. And that the sd. company of Militia was order’d to meet by Twelve O.Clock, the day that the said Arrest was made. We Agree that on the day of the sd. Muster the sd. William Trussell employed one William Bussell to assist him in his Ordinary who was at the time of the Arrest made at the house of the said Trussell having Come there that day for the purpose of Assisting him. We agree that William Bussell sold Liquors that day over the road And that William Trussell sold Liquors in his house at same time. We agree that William Trussell was Excused by his Commanding Officer from exercising always on his agreeing to supply the Company with Water, but that he was always Called as one of the Company. We agree if the Law be for the Plt. that Judgment shall be for them, Otherwise for the Defend’t, And thereupon the Suit is Continued till the next Court for the matters of Law arising thereon to be argued.
