Presley was returned to Bacon's Assembly in June, 1676, where, when some member remarked that a certain measure was "customary", Presley replied: "Tis true it has been customary; but if we had any bad customs amongst us, we are come here to mend them", which set the House into laughter. After the restoration of Berkeley, Presley was a member of the royalist legislature, but is remembered for his saying that he believed "the Governor would have hung half the country, if they had let him alone".
