B. Heinemann Written: 1768 Will of James Daugherty Made 10/2/1768 - Proved 3/11/1771 Northumberland Co, Va Record Book 6, pgs 170-171 In the name of God Amen, I James Daughity of North. County being in good health thanks to God for it, but considering the frailty of human nature do make this my last will and testament in form and manner following: Item. My will desire is that all my children that is not already learned if male children be kept at school the term of eight years and not to be put to school until they shall come to the age of seven years and if female children then to keep them at school four years and to be in the school then when they shall come to the age of eight years and the afors. children to be maintained and their schooling paid out of my estate without making any charge against therefor it. Item. I give to my son James Daughity the plantation I bought of John Hobson to him and his heirs forever. Provided my wife will agree to take her dower out of that I have given to my son James but is she refuses so to do then I give and bequeath to my son John Daughity all my land to him and his heirs forever. Item. I give to my wife Betty Daughity and to each of my children that is not already married and to ever of them one feather bed and furniture, one calf, two pewter dishes, one sow and pigs, one ewe and lamb to make them equal to that I have given my daughter Betty Warnom? to them and their heirs forever. Item. My will and desire is that the two negroes that I sent to my daughter Betty Warnom? and do order that they be brought back viz Solonad and Isaac and appraised with the rest of my estate and that the two negroes Solonad and Isaac with all the rest of my negroes and all my other estate that I have not already given to be equally divided between my wife and all my children and to them and their heirs forever. Except my wife's negroes then my will and desire is after death may be divided among my children as afors. Item. My will and desire is that my daughter Sarah Daughity shall have liberty to work her negroes on the land that I have given to my son John Daughity and to live upon the land herself during her maiden life. Lastly I Constitute and appoint my friend William Parker and my son John Doghity and Toulson Parker to be my Executors of this my las will and testament in Witness thereof I have unto set my hand and affixed my seal this 2nd day of October 1768. Signed and delivered in he presents of us Richard X Walker, Hannah X Walker James Daughity {Seal} --- At a court held for Northumberland Co., the 11 day of Mar. 1771 this last will and testament of James Daughity dec'd was presented in court by John Daugthity and William Parker, two of the executors therein named, who made oath thereto according to law, and being proved by the oaths of Richard Walker and Hannah Walker, witnesses thereto was admitted to record on the motion of the Exe's. giving security, certificate is granted therefor obtaining a probate thereof in due form.
