Record Book 26, pg 295 In the name of God Amen, I James Daughity being in perfect sence and memory calling to mind the certainty of death make and ordain this my last will and testament in form and manner as follows. In the first place I leave and bequeath to my beloved wife Elizabeth Daughity all of my estate for the support of her and family during her life or widowhood and at her death or marriage I give unto James B. Daughity, one negro girl, Sarah Ann. In the next place I give unto Rebecca Wildy one negroe girl Viner, and unto her mother Jane Wildly one negroe James. It is my desire that the balance of my negroes at the death or marriage of my wife should be equally divided among all my children that is to say, James B. Daughity, Baldsa B. Daughity and Jane Wildy. I also give unto Aurilous, son of Samuel B. Daughity, eighty dollars when collected out of my estate which is now in the hands of William A. Yord of Rutherford County in the State of Tennessee. The balance of my estate to be equally divided among my three youngest children, James B. Daughity, Baldsa B. Daughity and Jane Wildy as witness my hand and seal this the 27th day of March in the year of our Lord one thousand eight hundred and thirty in the presents of W. W. Appleby, Thomas Flynt. James Daughity {Seal} --- At a court of quarterly session held for Northumberland County at the courthouse on Monday the 10th of May 1830. This last will and testament of James Daughity decd. was proved by the oaths of Wm. W. Appleby and Thomas Flynt the witnesses thereto and ordered to be recorded. Teste F. Bates cc --- James has service in the Revolutionary War in the Virginia Navy. He served as a Midshipman in the Protector (Sally) from 19 Jan 1777. He was Lieutenant Captain 27 Aug 1778 as shown by the Journal of the Navy Board. He continued service until after 10 Sep 1779 as shown by his pension record. His name in the Navy record appears as Daugherty, Daughity and Duarity. --- Northumberland Co., Va., Order Book, 1830-1835, Pg 30: Ordered that it be certified that it appears to the satisfaction of the court that Wm. B. Daughity, Saml. B. Daughity, James B. Daughity and Jean Wildy wife of James A. Wildy are the only heirs of James Daughity decd. Northumberland Co., Va., Order Book, 1830-1835, Pg 213: Ord'd that it be certified that it appears to the satisfaction of the court that Wm. B. Daughity, Saml. B. Daughitgy, Jas. B. Daughity and Jane Wildy wife of Jas. A. Wildy, brothers and sisters of Baldsa B. Daughity who died under the age of 21 years and Elizabeth Daughity mentor of the sd. Baldsa B. which said Baldsa was one of the sons of Jas. Daughity decd. Northumberland Co., Va., Order Book, 1835-1844, Pg 6: Ordered that it be certified that James Daughity a Lieutenant in the Va. State Navy, Revolutionary War, died about the 27th of March 1830 and estate and that he his will is on record in the county court clerk's office of this county and that Saml. B. Daughity admr. is now living in the state of Mississippi.
