I Thomas Hurst of Wicocomoco in the County of Northumberland and Colony of Virg.a being sick and weak in body but in perfect since & memory thanks be to God and Calling to mind the Mortality of my body, do make Constitute and ordain this to be my last will and Testament in manner & form following. Imp.s I bequeath my Soul to God who gave it me in hopes of a future reward, and my body to the Earth to be buried according to the Discretion of my Exors hereafter named, and my Worldly Estate I dispose of in the following manner & form. Item. I Give and bequeath unto my Loving Wife Elizabeth all my whole Estate of Lands, Negroes and whatever Estate also I am now possessed of during her Natural life: And after her decease I give and bequeath as follows. I Give and bequeath to my Son Thomas Hurst one Negroe Girl Milly & one Negroe boy Dick to him & his heirs, with the Increase. Item. I Give to my Daughter Elizabeth two Negroes. Viz.t a Girl Chloe & a boy Jarvis & the Increase. Item. I Give to my Son Kemp Hurst the Plantation I now live on and the Plantation I purchased of Eliz.a Waddy adjoining it to him and his heirs forever. Item. I Give to my Son Isaac Hurst the Plantation he now lives on, which I Purchased of John Berry Containing One hundred & forty eight Acres to him & his heirs forever. Item. I Give and bequeath all the rest of my Estate of Negroes, and Personal Estate to be Equally Divided (after the decease of my loving Wife) amongst my four Children, Kemp, Isaac, Thomas, and Elizabeth Hurst. Item. It is my Will and Desire that in Case that either my Son Thomas or my Daughter Eliz.a Should die before they attain to the age of Twenty one or day of Marriage, that the Negroes that I bequeath to them as Legacies go[to] the survivors. Item. It’s likewise my desire that in Case that either of my four Children Should die without heirs or attain to the age of Twenty one years or Marriage that that part of Estate which I Bequeathed amongst them, that it should be Equally Divided amongst the Survivors. Item. It’s my Will and desire that my Estate be not appraised but be Inventoried. Item. I do Nominate and appoint my loving Wife Elizabeth the Excrx. & my two Sons Kemp and Isaac Hurst Excrs. of this my Last Will & Testament. In Witness whereof I have hereunto set my hand fixed my Seal this 24th day March 1760. Signed Sealed & Declar’d by Thomas Hurst to be his Last Will & Testament. In Presence of us: Thos. Hurst (Seal) Thos. Gaskins Sukey Hurst George Landsford. At a Court Held for Northumberland County the 12th day of August 1765. The Last will and Testament of Thomas Hurst decd was Presented in Court by Kemp Hurst and Isaac Hurst two of the Exors therein named, who made Oath thereto according to law, And being Proved by the Oath of Thomas Gaskins Gent. one of the witnesses thereto was Admitted to Record. And on the motion of the sd. Exors. Giving Security a certificate is granted them for obtaining a probate thereof in due form. Teste. Tho. Jones Co. C.
