The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net ************************************************************************** Page 222 Thomas Dean, November 1, 1838: Nottoway County, Virginia In Indenture made this 16th day of October in the year one thousand eight hundred and thirty eight between Beverly Hood of the first part, Thomas Dean of the second part and Richard A Wills of the third part. All of the county of Nottoway. Whereas the said Beverly Hood is indebted to the said Richard A Wills in part of the purchase of the tract of land herein conveyed to the said Thomas Dean, the sum of two hundred and thirty nine dollars fifty five cents. One hundred dollars thereof on the first of January 1840. One hundred dollars on the first of January 1841 and thirty nine dollars fifty five cents the balance thereof on the first of January 1842, and intending to secure to the said Richard A Wills the payment of the said several sums of money when the same shall become due. This indenture witnesses- that in consideration of the premises aforesaid and in further consideration of the sum of five dollars to the said Beverly Hood in hand paid by the said Thomas Dean the reciept whereof is hereby acknowledged. The said Beverly Hood hath this day bargained and sold and by these presents doth bargain sell and convey to the said Thomas Dean his heirs and assigns a certain tract or parcel of land situate lying and being in the said county of Nottoway containing one hundred and seventy five acres, be the same more or less it being the land on which the said Richard A Wills at present resides and which is deeded to me by William Wills to which deed reference is made for boundaries etc. To have and to hold the aforesaid tract of land with all its appurtenances to the only use and behoof of him the said Thomas Dean his heirs and assigns forever. Upon this trust and confidence nevertheless, that should the said Beverly Hood will and truly pay to the said Richard A Wills, the sums of money herein mentioned when the same shall severally fall due, then this indenture is to be void and of no effect, otherwise the said Thomas Dean in appre- ciation of either of the parties to this deed shall sell so much of the land herein conveyed for ready money as may be sufficient to pay the sums herein mentioned, due to the said Richard A Wills, when the same shall become due- first only advertizing the time and place of such sale at least fifteen days previously at the most Public places in the neighbor- hood. In testimony whereof the parties aforesaid have hereunto set their hands and affixed their seals the day and year first written.
