NOTTOWAY COUNTY, VA - WILLS - John Mann, 19 Aug 1799 ----¤¤¤---- Will Book 1, Page 416 In the name of God Amen, I John Mann of Nottoway County, being of sound mind and perfect memory do make and ordain this my last will & Testament in manner following that is to wit: I lend to my wife Elizabeth Mann one hundred acres of the tract of land where on I now live adjoining Joseph Jenning's line (formerly Henry Ferguson's) Robert Vaughn's line and Edward Ward's line also one Negro man slave named Dick and one Negro woman Elsy one dark mane colored horse called Mitchell two cows & calves & two young cattle, two sows of pigs two spade sows or barrows four sheep one feather bed and furniture and one third part of my other household furniture & plantation said during her life or widowhood. I give my son Jonathan G. Mann the plantation I purchased of James Mann with two hundred and forty and a half acres of land to be laid: of by a line running from Edward Ward's line near the black pond to Robert Vaughn's line. The remainder of my land I give to my daughter Martha W. Mann, to them & their heirs forever. I give to my son Jonathan G. Mann one Negro named Bartlett on Negro girl named Murrear one Negro boy named David one Negro named Liley one Negro named Poll & also one Negro named Dick at the death or marriage of my wife to him and his heirs forever. I give to my daughter Martha W. Mann five negros to witt, Hall, Jenny, Oliver, Dicy & Clarissa also at the death or marriage of my wife to her & her heirs forever. I give to my son Jonathan Mann one spotted stud bolt & to my daughter Martha W. Mann one rone mare called Rosa. The remainder of my stock of all kinds also the remainder of my estate I give to be equally divided between my son Jonathan G. Mann and my daughter Martha W. Mann. If both of my said children should die leaving no issue behind I give the said land mentioned to my son Jonathan to John Malone Dupuy son of Stephen Dupuy to him and his heirs forever and the land mentioned to my daughter Martha to James Mann son of my brother James Mann to him and his heirs forever. The balance of my personal estate in case my said children should die without issue I give to be equally divided between my sister Judith Dupuy's children (except John M. Dupuy before mentioned) and Elizabeth Mitchell and Milly Mitchell to them and their heirs forever, and lastly I do appoint Stephen Dupuy, James Dupuy, Jr., Daniel Nasser & Robert Vaughn Jun. Executors of this my last will and testament witness whereof I have hereunto set my hand and seal the 19th day of August 1799. [his X mark]Gafford In Nottway County Court, December 4th, 1800: The last will and testament of John Mann deceased was offered for probate by Stephen Dupuy, an executor named & was proved by oaths of George Baldwin and Joseph Gafford at the courthouse on Thursday the 5th of February 1801 on the motion of said Exor. A certificate is granted him for obtaining a probate of this will be having taken the oath of an Exor. With Dabury Morris and Gibs Nance his securities entered and acknowledged on bond according to law. Test. Peter Randolph C. N.C. Truly recorded test. Tho. W. Todd D. C. Notes: Inventory was made February 14, 1801 and presented to court April 2, 1801 (WB 1, p. 435-436) Final Settlement was made May 2, 1810 and presented to court October 4, 1810 (WB 3, p. 53-56) In the Final Settlement is mentioned "James W. Dupuy in right of Martha W. his wife". Stephen Dupuy (1756-1823, d. Pittsylvania County) was the husband of Judith Mann (1758-1820) mentioned above as a sister to John Mann. James W. Dupuy (1787-1850, d. Desoto County, MS) married Martha W. Mann (1795- 1847, d. Desoto Co, MS) about 1808. James W. Dupuy was a first cousin of Stephen Dupuy. Jonathan G. Mann married Elizabeth Dupuy, daughter of Stephen Dupuy, in 1814 in Prince Edward County. No further information. James Dupuy, Jr. was another first cousin of James W. Dupuy and Stephen Dupuy. In October 1809, Elizabeth Mann deeded 160 acres of land "adjoining the lands of Asa Vaughn & others which was allotted to her under a decree of the said court of which John Mann her late husband died seized to have and to hold the said lands with tenements & interest of all kinds which she herself was entitled in right of dower to the aforesaid lands" to James Dupuy (the younger) in return for 160 pounds. This was recorded in Nottoway County on March 1, 1810 (DB 4, Page 43). From Limestone County, Alabama court minutes, p. 72: "May 24, 1824 Application of James W. Dupuy for an order to James G. Mann, to show cause why letters of Administration in the estate of Elizabeth Mann, dec’d, should not be issued to said James W. Dupuy".
