All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Tosca Simms tkwhsimms@hovac.com March 24, 2009, 11:28 am Source: Will Book 1, Pages 542-3 Written: July 31, 1802 Recorded: December 2, 1802 In the name of God Amen...the thirty first day of July in the year of our Lord one Thousand Eight Hundred and two I Joel Tanner of Nottoway County being at this time in as much health of body mind and memory as I generally have been for severall months past for which I desire to be thankfull to the lord, but considering the mortality of the body & knowing that it is appointed for all men Once to die have thought felt do make and ordain this as my last will and testament and first of all I commit my soul to God who gave it hopeing it will be received into the everlasting Kingdom of Glory and my Body to the Earth to be buried in a desent manner at the discretion of the Executors hereafter named and as to my Worldly Property wherewith the almighty hath blesed me I give and dispose of the same in the manner and form following..to wit..... Item I give to my grandson Joel Tanner, son of Thomas Tanner all my wareing apparel also my Riding saddle and bridle to him and his heirs forever..... Item I lend to my beloved wife Lucy Tanner the plantation and Lands thereunto ajoyning where I now live also all my household and kitchen furniture together with all my stock of Horses Cattle sheep and Hoggs also all my Negro property namely Chloe, Jenny, Jack Make, Billey, Peter Fanney and Becky during her my said Wife's Natural life (.) after her decease.....I Lend to my Daughter Martha my Negro girl named Beckie and her increase after she takes possession to my said Daughter Martha during her Natural life (.) after her decease I Will that the above lent Negro girl and her increase be equally divided between my two grand Daughters namely Lucy Ann Gressitt/Garsett? and Elizabeth Coleman Green's which division I give to my two said grand daughters and to their heirs forever....N3?....and whereas that my Daughter Martha and her husband Jessee D. Green hath under taken to surport me and family with Needfull food and Payment according to our different Chariacters(?) in Life and taken off all care and fateague both without upon (?) and within and still so continueing as long as I and my wife live then after my wife's decease I give unto my Daughter Martha the lands and plantation whereon I now live together with all my household and kitchen furniture to her and her heirs forever. I give to my son David Tanner after the decrease of my Wife one Hundred Dollars to be Raised out of my Estate which I give to him and his heirs forever..... I give to my son Joseph Tanner abond of his to the amount of one Hundred and five pounds with Interest thereon from my death to the death of my Wife, which said Bond and Interest thereon I give to my said son & his heirs forever..... My will is that my old negro Woman named Chloe have her choice whome she likes best to live with of my children and that child she Chuseths I give her so long as she liveth be it son or Daughter...and hope she be used well for My Sake..... Item My will is that the residue of My Estate not before lent or given be equally divided between my sons David and Thomas Tanner and My Daughter Martha Green which said division I give to my said chidlren and to their heirs forever.... Lastly I appoint and ordain my two Respectable Nabours Capt Daniel Verser (?) and Capt Isaac Winfree My lawfull Executors of this my last Will and Testament Revoking and disavowing p 543 All former Wills by me made and acknowledge this to be my last Will and Testament. Witness hereof I the said Joel Tanner Hath Set my hand and fixed my seal this day & year above written signed sealed and acknowledged. Joel Tanner (Seal) In presence of Isaac Winfree Daniel Verser Dolley Winfree Brightwell Rather Enterlind before assign In Nottoway County Court December 2nd 1802 This last Will and testament of Joel Tanner deceased was offered for proof by Daniel Verser and Isaac Winfree the executors therein named was proved by the Oaths of Isaac Winfree Daniel Verser and Brightwell Rather three of the witnesses thereto and ordered to be Recorded and on the motion of the said Verser and Winfree who refused to qualify as executors, a certificate is granted them for obtaining administration with this will annexed they having taken the oath prescribed by law and with Richard Jones the Security entered into and ackownledged above according to law. Teste Peter Randolph C N C Truly Recorded Teste Additional Comments: Another item about Joel Tanner found in a book called "Orders #2 Begun July 6 1797 & Ended at May Court 1801" A deed indebted from Joel Tanner to Joseph Tanner a commission for make a privy examination & takeing the relinquishment of Right of Dower of Lucy Tanner, wife of the said Joel, in the land conveyed as aforesaid were proven by the Oath of one witness & ordered to be certified.
