Tuggle do make this my last Will and Testament as follows. After my decease I desire that my body shall be decently intered at some suitable spot on my own premises to be selected by my Wife and that a plain marble shape or pillar 4 sided and resting upon a marble slab be erected over my Grave as a Momument to my Memory, and that the following inscriptions be placed upon the 4 sides of the pillar to wit on one side the date of my birth “born Oct. 20th 1816” on the Second, the date of my death, on the third side “Graduate of Hirnfsden Syndney College Sept. 1835” and on Medicine at the Medical Department of the University of Pennsylvania in Philadelphia in March 1838. On the fourth side I direct that this inscription be placed “A Man whose aspiration and purpose in life was defeated by physical disabilities” who can resist the laws of the Almighty? I direct also that a neat iron railing shall enclose the whole and a sufficient space of ground as counting for my whole family and that this space thereof shall be paid out of my estate. 2nd I will and direct that all of my just debts be paid and promptly paid. 3rd After the payment of all debts, I will and bequeath to my wife Lucy Jane Tuggle in consideration of the love and affection which I have to her, and the confidence that I have in her Judgment and integrity, the whole of my estate both real and personal, perishable and imperishable, including Lands and Negroes; horses and stock of every description, plantation utensils and fixtures, Bonds and Money, State Stock Bonds of SS R Road Co and all other evidences of debt or property including all expectancies or interest whatsoever, only during her widowhood with the following instructions and provisions to wit I will and direct that all of my children shall receive a liberal and classical education and the expenses thereof to be paid out of my estate. I desire also that each of my children as they respectively become of age or marry shall receive such advancements in money or property as my wife in her discretion may deem proper and judicious, taking care that the advancements be made out of any portion of my estate except my State Bonds and SSR Road Bonds or the interest accrued thereon; and I hereby clothe my wife with full and complete powers in making said advancements to confer the right and title to each all of them in full simple or to bestow it upon my children during their lives and afterwards to their posterity; or to place it in the hands of Trustees, for their benefit, or to dispose of said advancements for their use and benefit in any other manner whatsoever that she may deem most judicious and proper for each particular child. 4th I will and direct that my State Stock and Bonds of South SR Road Co. and the interest accrued thereon shall be untouched for any purpose whatsoever except it become necessary for the support of the family or the education of the children: and in that event I desire that the interest thereon shall only be used, with the instructions that it be replaced from the other proceeds of the estate as soon as convenient and that said stock and Bonds with their accruing interest be constantly reinvested in good, sound stocks; or if my wife should at any time deem it more judicious, a portion of said interest may be invested in real estate to be managed and subject to the same provisions and instructions as the Stock and Bonds themselves. I wish it to be distinctly understood however, that in this 4th article of my will concerning my stocks and interest theron, there is nothing meant or designed as prohibiting my wife from using said interest on bonds and state Stocks for her own use of benefit should it become necessary so to do, only desiring that she shall replace these, provided it can be done conveniently. 5th I will that in the event my wife Lucy Jane Tuggle, should conduced to marry again. She Shall have only that portion of my Estate to wit, one third part thereof which the laws of Virginia assigns her during her natural life, and the balance of my estate I bequeath to my [sic] My children to be equally divided among them all. And I will and require also that in the event of my wifes marrying again, she shall return and replace to my Estate any part or portion of my State, Bonds or S S R Road Bonds or interest accrued thereon, which she may have used for her own benefit previous to said second marriage, before her dower shall assigned her. 6th I give and bequeath at my decease my watch with directions that a handsome gold case be put on it to my son John B. Oliver Tuggle, and I give and bequeath a gold watch of equal value to my son Wilfred Tuggle at the same time to the former I give my Clocks to the latter, my Guns and Pistols 7th I hereby nominate and appoint my wife Lucy Jane Tuggle the sole Executrix of this my last Will and Testament, and having great confidence in her integrity and discretion require no Security at her hands but I enjoin upon her faithfully to execute and carry out the requirements of this my last act and deed.
