Will of Peter Winn, 1839 - Nottoway Co. VA In the name of God amen I Peter Winn of the County of Nottoway being of sound mind and [ ? ] memory do make and ordain this my last will and testament in manner and form following to wit -- Imprimis. It is my will and desire that all my just debts should be first paid. Item 2nd I give and bequeath to my two nephews (sons of my brother Charles Winn of North Carolina) Andrew J. Winn and Peter Winn all the interest which I have in the dower estate now held by mother Jane Winn for life, and in the event of either of my nephews Andrew J. Winn and Peter Winn should die before arriving to lawful age, then and in that case I will & direct that the survivor of them shall have and bear the whole of the interest given to them in the dower estate now held by my mother Jane Winn for life to him & his heirs forever. Item 3rd I give and bequeath to my beloved mother Jane Winn all the balance of my estate Viz. my negro man Phill my interest in negro man Lewis all bonds and money & every other kind of property whatsoever to her & her heirs forever__ Item 4th I will and direct that after the death of my mother Jane Winn my executor herein after named shall make sale of the portion of my mothers dower, to which I shall be entitled, if he may think proper & divide the proceeds thereof equally between my said two nephews Andrew J. Winn and Peter Winn them & their heirs forever__ Item 5th I do hereby constitute and appoint my friend Timothy Wortham executor of this my last will & testament, and direct that no security shall be required of him in qualifying as executor aforesaid. Perry Timothy Wortham In Nottoway County court December 5th 1839 This last will and testament of Peter Winn decd was produced in court and offered for proof was proven by the oaths of William Pincham, R. Kennon Smith and William H. Perry three of the subscribing witnesses thereto & ordered to be recorded. And in the same court the 7th day of May 1840 On the motion of Timothy Wortham the executor therein named, who took the oath and entered into bond (without security none being required) in the penalty of four thousand dollars and [ ? ] according to law a Certificate is granted him for obtaining a probate of the said will in due form.
