Submitted by Carol Barron carolbarron@juno.com ====================================================================== In Chancery - Orange County Order Bk, p 83, 84, 25 Aug 1803 Thomas Harris, John Harris, Lewis Harris, James Payne and Elizabeth his wife and Lewis Walker and Mary his wife – Plts against Sabra Harris widow of Thomas Harris deceased and Frances Harris widow of Lindsay Harris deceased, Pleasant Hunter and Jane his wife, Elijah Harris, David Harris, Susanna Harris, Lucy Harris, William Harris, Hesekiah Harris, Matilda Harris, Brockman Harris, and Frances Harris - Defts On the motion of the Plts, Frances Harris is by the court afsigned guardian to the infant defendants, to defend them in this suit; whereupon this cause this day came on to be heard by consent, on the bill, answers, exhibits filed and agreement of counsel on both sides. An consideration whereof it is decred and ordered that the division of that part of the estate of Thomas Harris deceased devised to his widow Sabra Harris for life, and by her given up to be divided amongst the children of the said Thomas Harris deceased and according divided amongst them as evidenced by the exhibits called in the bill an obligation or agreement confirmed and that Thomas Ellis, Dabney Minor, John Alcock Sen., Joseph Alcock, Nathaniel Mills and Caleb Lindsay or any three or more of them be appointed commifsioners to value the land so given up by said Sabra Harris, so as to divide the same in four equal portions and to allot to the defts who are representatives of Lindsay Harris deceased that part whereupon the said Lindsay lived to include his plantation and to be bounded by the Lick Branch, John Wright's line up the ridge road and from the ridge road to the Spring Branch to include the house John Harris lived in and down the Spring Branch so as to include one fourth part of the said land, and that they do lay off and allot to Thomas Harris another fourth part to begin at the mouth of the Spring Branch at the river, thence down the river to the mouth of the Lick Branch, thence up the said branch to the place Lindsay Harris's line comes to the said branch, thence along the said Lindsay Harris's representatives line to the spring branch thence down the same to the beginning, and to include the house the said Thomas Harris now lives in; and to lay off and afsign to John Harris one other third part, to begin at the mouth of said Spring Branch at the river thence up the river to the new bridge, thence up the road along the line of Thomas Ellis, thence to crofs the plantation whereon the said Sabra Harris lives below the house to the Spring Branch thence down the same to the beginning; And to lay off and afsign to the said Sabra Harris the remaining fourth part of the said land, beginning at the spring branch at John Harris's corner thence up the said branch along the line of Lindsay Harris's representatives to the bridge road, thence up the said road to Ellis's corner, thence down Ellis' line to John Harris's corner, thence acrofs the plantation with the said John Harris's line to the Spring Branch to include the house in which the said Sabra Harris lives; and the court do further order and decree that the said commifsioners or any three of them do value that part of the slaves of the said Thomas Harris deceased, which have been given up by the said Sabra Harris, and afsign as many of them, as shall be equal in value to a fourth part of the said land to each of the Plts. Lewis Harris, James Payne and Lewis Walker, in lieu of their portions of the said land, so as to make the shares of the said Lewis Harris, James Payne and Lewis Walker in slaves equal to the shares of the representatives of the said Lindsay Harris, Thomas Harris, and John Harris in land, and if upon valuation of the said slaves, it shall be found that they are not sufficient for that purpose, then it is decreed and ordered that the said Thomas Harris the surviving executor of Thomas Harris deceased do sell at public auction for ready money the rest of the estate of given up as aforesaid by Sabra Harris, and out of the proceeds of the sale, pay to the said Lewis Harris, James Payne and Lewis Walker any difficiency on their shares of the said slaves as aforesaid, and divide the residue of the money arising from the said sale, between the said Lewis Harris, James Payne, Lewis Walker, John Harris, the representatives of Lindsay Harris deceased in right of said Lindsay and himself in equal portions; And it is further decreed and ordered that at the death of the said Sabra Harris that the said commissioners or any three of them, do sell at public auction on twelve months credit, that part of the land and slaves which are retained by the said Sabra Harris, and take bonds with security of the purchases and afsign the same one sixth part to the said Thomas Harris; one sixth to the said John Harris, one sixth to the said Lewis Harris, one sixth to the said James Payne, one sixth to the said Lewis Walker and the remaining sixth part to the representatives of the said Linsay Harris deceased; and that the said Thomas Harris the surviving executor of Thomas Harris deceased, do sell in like manner at the death of the said Sabra, the other property by her retained, other than the lands and slaves, and take bonds with security of the purchasers, and collect the money and pay the same, or afsign the bonds in the same proportions and to the same persons as aforesaid; and that the commifsioners make report thereof to the court in order to a final decree and liberty as reserved to the defendants who are infants to shew cause against this decree at any time within six months after they respectively arrive to the age of twenty one years.
