Submitted by Carol Barron carolbarron@juno.com ============================================== Orange County Order Book 1803-1804, p 118-120, date page 24 Oct 1803 In Chancery Thomas Harris, John Harris, Lewis Harris, James Payne and Elizabeth his wife and Lewis Walker and Mary his wife - Plts against Sabra Harris widow of Thomas Harris deceased, and Frances Harris widow of Lindsay Harris deceased, Pleasant Hunter and Jane his wife, Elizabeth Harris, David Harris, Susanna Harris, Lucy Harris, William Harris, Hesekiah Harris, Matilda Harris, Brockman Harris and Francis Harris - Defts The commissioners appointed by aformer orders in this cause to divide such estate of Thomas Harris deceased as was divided to the said Sabra for life and by her given up to be divided amongst her children having made their report accompined by a plat of the several portions of land and which are in the following works and figures to wit "Pursuant to advice of the county court of Orange "hereunto we the subscribers being commissioners under the aforesaid acres have proceeded to divide that part of the estate of Thomas Harris deceased divided to his widow Sabra Harris during her life, and by her relinquished in favor of her children to be equally divided among them, and do report as follows. That about the latter end of the year 1801 at the request of all the children of the aforesaid Thomas Harris deceased we proceeded to divide among them the lands and slaves belonging to the estate of the said Thomas Harris deceased and decided to be divided by this acres which were relinquished or given up to them the said children by the aforesaid widow Sabra Harris and which division as directed by the decree hereto annesed was as follows viz. To Lindsay Harris "he being present and consenting to the same eighty one acres of land and valued at two hundred and seventy three pounds seven shillings and six pence To Thomas Harris seventy five acres of land valued at one hundred and ninety six pounds seventeen shillings and six pence To John Harris eighty seven acres valued at two hundred and sixty one pounds and the remaining part of the said land viz. sixty four acres including the dwelling house was reserved for the use of the aforesaid widow Sabra Harris acquisable to a plat herewith filed, the parties all being present and consenting to the division as made according to the bounds directing the decree but these bounds reducing the lots of lands unequal in value they were equalized to the satisfaction of all parties by the subsequent division of the personal property in the manner following viz: Out of twelve slaves given by the said widow to Lewis Harris was allotted five slaves, Andersen, Ambrey, Phobe and Milly with her child valued at two hundred and forty five pounds: To James Payne in right of his wife Elizabeth three slaves to wit, Nat, Hannah and Rhody valued at two hundred and forty five pounds: To Lewis Walker in right of his wife Polly four slaves to wit, Sam, Ann, Alice and child valued at two hundred and forty five pounds all being present and consenting the residue of the personal estate given up by the said widow sold for one hundred and twenty two pounds seventeen shillings and sixpence which with the valuation of the land and negros made total sums of fifteen hundred and ninety eight pounds two shillings and sixpence; this sum divided among all the children of the said deceased Thomas Harris made a dividend of two hundred and sixty six pounds ten shillings and five pence for each which amount or dividend was paid and delivered to the children or legatees of Thomas Harris aforesaid to the complete satisfaction of each individual thereof, including Lindsay Harris deceased who was present and signifying his acquiefsoned and consent to the same: given under our hands and seal this 22nd October 1803 Thomas Ellis, John Alcock, Caleb Lindsay And the court do decree and order that the said repr to be confirmed and that the parties respectively to whom portions have been alloted bequieted in their respective parts of the lands divided and of the slaves and other estate divided assigned them, and that the defts who are infants have liberty to show cause against this and the order formerly made in this cause at any time within six months after these respectively arrive to the age of twenty one years, and further ordered that the cost of this suit be paid out of the estate of the said Thomas Harris deceased and that the parties have leave to apply further order if necessary for carrying into effect the former decree in this cause.
