SMITH TO THORNTON This indenture made the twenty sixth day of July in the year of our Lord One Thousand Seven Hundred and Forty Six between JOHN SMITH, Jun. of the County of Orange of the one part and FRANCIS THORNTON of the County of Spotsylvania, Gent, of the other part. Witnesseth that the said JOHN SMITH for and in consideration of the sum of fifty pounds current money to him in hand paid by the said FRANCIS THORNTON the receipt whereof the said JOHN SMITH doth hereby acknowledge and himself therewith fully satisfied, contented, and paid hath granted, bargained, and sold, and by these presents doth grant, bargain, and sell, unto the said FRANCIS THORNTON his heirs and assigns forever, all that tract or parcel of land, containing one thousand acres lying in the County of Orange aforesaid on both sides the new mountain road, and is the same land which the said JOHN SMITH purchased of JAMES BARBOUR, Gent. And all the estate right title, interest, claim, and demand of him the said JOHN SMITH his heirs or assigns in or to the said land and premises. To have and to hold the said one thousand acres of land with all and every the appurtenances thereto belonging and every part and parcel thereof unto the said FRANCIS THORNTON his heirs and assigns forever to the only proper use and behoof of this FRANCIS THORNTON, his heirs and assigns forever and to no other use, intent or purpose whatsoever. Provided always that if the said JOHN SMITH, his heirs or any person for him shall pay or cause to be paid unto the said FRANCIS THORNTON his heirs or assigns, the sum of forty six pounds, fifteen shillings and three pence current money, with lawfull interest thereon from the _____th day of February in the year of our Lord One Thousand Seven Hundred and Forty Four until the said debt is fully paid and satisfied together with all costs of _____ in recovering this said debt for which the said THORNTON has lately recovered against the said SMITH Judgement in the court of the said county of Orange and all Sheriffs fees or go?lers fees becoming due since the said recovery, within two years from the date hereof, that then the Estate hereby granted to the said THORNTON, by the said SMITH shall cease, determine and be void as if this Indenture has never been made. In witness whereof this JOHN SMITH hath hereunto set his hand and seal the day and year first above written.
