Thomas Smith Sen'r. has lately departed this life and the sd. Thomas being old and infirm and not expected to transact his own business to so much advantage as through the agency of another and likewise for preventing those anxieties and inquietudes which too frequently result from a Situation like the one on which the contracting parties are placed the sd. Thomas Contracts and agrees that on the twentieth of November ensuing The whole estate in the possession of the Sd. Thomas shall be equally divided except the land he the Sd. Thomas lives on the bed of the sd. Thomas and the horse Jack and the Crop now growing. The Land and property last recited after the death of the said Thomas shall from thenceforth become the property of the sd. James. The crop now a growing shall be at the disposal of the said James and deemed his property the sd. James contracts on his part to support the said Thomas his Father in a decent manner of which good men shall approve and to demean himself towards the said Thomas as becomes a child during the life time of the said Thomas. The said James shall be at liberty to sell the land in the life of the said Thomas with the counsel of the said Thomas all the estate of the said Thomas except as before excepted is to be equally divided between the said Elizabeth Brockman Thomas Smith William Brockman George Smith & the sd. William Smith the said Thomas however first to account and pay unto the common stock thirty five pounds that sum being advanced by way of a piece of Land given by the sd. Thomas Sen'r. to Thomas Jun'r. The parties last mentioned shall be intitled to all the property of whatever Kind or degree except that particularly excepted in fafour [sic] of James and are hereby authorized & empowered to collect all debts due the said Thomas or the deceased wife of the said Thomas and are to pay the debts due from the said Thomas.
