Witnesseth, that the said James Smith and Patsey his wife hath bargained and sold unto the said Peter Hubert all their right and Title to a certain Parcel or Tract of Lands Lying and being in the County of Orange and State aforesaid on Clevelands Run Containing two hundred Acres More or less and Bounded by the lands of James Barbour, John Douglass, & Mich'l Walters Dec'd, To have and to hold the said Land and premises with all its singular Benefits & Appurtenances and the said James Smith & Patsey his Wife doth only agree to Warrant and defend for themselves their heirs & it being specially agreed between all the afore said parties that if James Barbour or any other person (besides said Smith or his heirs) makes any claim on the aforesaid Land the said Smith or his heirs is not to Warrant or defend. In Witness Whereof the said James Smith & Patsey his Wife hath hereunto set their hands and seals the day and year above written. The Consideration Money for the above land being five hundred pounds, the receipt of which the said James Smith & Patsey his wife doth hereby acknowledge in presence of Charles Yancey Augustine Smith William Alexander John Smith James Smith (Seal) Patsey (her X mark) Smith (Seal) The Commonwealth of Virginia to Samuel Black and Charles Yancey Justices of the peace of Albemarle, Gentlemen: Greetings. Whereas James Smith and Patsey his Wife, by their Certain Indenture of Bargain and sale bearing date the 13th day of May 1801 have sold and conveyed unto Peter Hubert the fee simple Estate of and in a certain Parcel or tract of Land lying and being in the County of Orange containing Two hundred Acres more or less, and bounded as in the said deed is expressed And Whereas the said Patsey cannot conveniently travel to our County Court of Orange to make acknowledgement of the said conveyance, Therefore we do give unto you, or any two or more of you, power to receive the acknowledgement, which she the said Patsey shall be willing to make before you of the conveyance aforesaid, contained in the said Indenture which is hereunto annexed: And we do therefore command you, that you do personally go to the said Patsey and receive her acknowledgement of the same, and examine her privately and apart from the said James her husband, Whether she doth the same freely and voluntarily, without his persuasions or threats and whether she be willing that the same should be recorded in our said County Court of Orange aforesaid, and when you have received her acknowledgement examined her as aforesaid, that you distinctly and openly certify us thereof in our said County Court under your seals sending then there the said Indenture and this Writ; Witness Reynolds Chapman Clerk of our said County Court, the 28th day September 1801 and in the 26th year of the Commonwealth.
