All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Linda Deppner http://www.genrecords.net/emailregistry/vols/00012.html#0002870 November 6, 2009, 11:54 pm Written: March 28, 1755 Recorded: March 28, 1755 Orange County, Virginia Deed Book 12, pages 277-278 This Indenture made the Twenty eighth day of March in the year of our Lord God one Thousand Seven hundred and fifty five Between Thomas Smith & Elizabeth his wife of the county of Orange of the one part and James Taylor of the County of Caroline of the other part Witnesseth that for & in Consideration of the Sum of Sixty four pounds six Shillings by the said James Taylor to the said Thomas Smith in hand paid before the sealing and Delivery of these presents the Receipt of which he doth hereby Acknowlege [sic] they the said Thomas Smith and Elizabeth his wife hath Granted Bargained sold enfeoffed and Confirmed and by these presents Doth grant bargain sell enfeoff & Confirm unto the said James Taylor his heirs and assigns forever all That Tract or parcel of Land Containing One hundred Acres be the same more or Less Situate Lying & being in the County of Orange aforesaid which was Purchased by the said Thomas Smith of Benjaman Smith and conveyed by Deeds of Lease & Release Recorded in the said County Court of Orange and bounded as followeth to wit: Begining at a Gum Poplar & White Oake Corner to James Taylor Thence North Seventy Degrees East Seventy poles to two Red Oaks and Hickory another Corner of the said James Taylor thence North ten Degrees west one hundred ninty five Poles to a Hickory in Colo. Francis Taliaferro's Line thence South Seventy Degrees west one hundred and two Poles to a Hickory and Red Oake in Colo. George Taylor Line thence with the said Taylor's line South twenty Degrees East one hundred and Ninty five Poles to the Begining, together with all houses gardens orchards woods ways waters privileges proffits and advantages whatsoever to the same belonging or in any ways appertaining and the Reversion & Reversions Remainder & Remainders Rents Issues & Proffits Thereof and all the Estate Right title Interest claim & Demand in Law or Equity of the said Thomas Smith or Elizabeth his wife in or to the said Land and Premises or any part thereof. To have and to hold the said Land & premises hereby Bargained and Sold & every part thereof with the appurtenances unto the said James Taylor his heirs & assigns forever to his and their own proper Use and The said Thomas Smith doth hereby Covenant & Grant for himself and his heirs to and with the said James Taylor his heirs & assigns that he the said Thomas Smith and his heirs the said Land & premises hereby Conveyed and Every part thereof unto the said James Taylor his heirs & assigns against him the said Thomas Smith & his heirs and all and every other person whatsoever Shall and will warrent and forever Defend by these presents. In witness whereof the said Thomas Smith and Elizabeth his Wife hath hereunto set their hands and seals the day and year first above written. Thomas (mark*) Smith (L. S.) Elizabeth (mark**) Smith (L. Sealed & delivered in Presence of us [no names are written here] Be it remembered That on the day of the date of the within written Deed full and Peaceable possession & seisen of the Lands and Premises within mentioned was Given and Delivered by Turf and Twig part thereof by the within named Thomas Smith to the within named James Taylor to hold to him and his heirs according to the within Deed in presence of us. Thomas (mark*) Smith At a court continued & held for Orange County on Fryday [sic] the 28th day of March 1755. This Indenture was Acknowledged by Thomas Smith & Elizabeth his wife parties thereto she being first privately examined as the Law directs & also a Memo. of Livery & Seisen endorsed thereon was acknowledged by the said Thomas & ordered to be Recorded. Test Geo. Taylor Clerk * Thomas Smith's mark is a letter T with a smaller letter S written over it. ** Elizabeth Smith's mark is a backward letter S with a vertical line through it.
