Boston Exd & Deld to Chas Lea Augt 1767 This Indenture Tripartite made this Thirteenth day of April One Thousand Seven hundred and Sixty Seven Between Bernard Moore of the County of King William Esqr only acting Executor of the Will of John Spotswood Esqr decd and Guardian of his Son Alexander Spotswood of the First Part. Edmund Pendleton and Roger Dixon of the Second Part and Joseph Boston of the County of Orange of the Third Part. Whereas by an Act of Assembly passed in the Fourth year of the Reign of his present Majesty King George the Third Intituled an Act to direct the Sale of Certain Entailed Lands whereof John Spotswood Esqr died Seized, for the payment of the Debts due from him and the Estate of Majr General Alexander Spotswood, it is among other Things Enacted that the sd Bernard Moore or the acting Executor or Exors of the Will of the said John Spotswood or the Guardian for the Time being of the said Alexander Spotswood the son should be and he or They was and were thereby impowered [sic] with the Consent and approbation of John Robinson Esqr Edmund Pendleton, Roger Dixon and John Campbell Gent. or any two of them, To Sell and dispose of Such and So much of the Entailed Lands whereof the said John Spotswood died Seized (the Mine Tract Excepted) as he or they should Judge most Convenient and Necessary (So as that the whole of Money by Sum ^ to be raised from ^ Such Sale did not amount to more than Six Thousand pounds) for the best price that might be got for the same and Convey Such Lands so Sold to the Purchaser or Purchasers who Should from Thenceforth hold the Same respectively to them and their Heirs forever, and that the money arising from Such Sales Should be applied as in the said Act of Assembly is more particularly directed And Whereas at a Sale of Part of the said Lands made by the sd Bernard Moore with the Consent of the Trustees aforesaid. the aforesaid Joseph Boston became the purchaser of one hundred and Thirty Six acres herein after particularly Described for the Sum of Thirty four Pounds which was the best Price that Could be got for for the Same Now This Indenture witnesseth that Pursuant to the [p. 152] Power given to the said Bernard Moore in and by the said [Titled] Act & For and in Consideration of the said Sum of Thirty Four pounds to him in hand paid by the said Joseph Boston and applied to the uses in the said Act directed. The receipt whereof the said Bernard Moore doth hereby acknowledge He the said Bernard Moore with the Consent and approbation of the aforesaid Edmund Pendleton and Roger Dixon Testified by their being parties to and Sealing and Delivering these Presents; hath Granted, Bargained and Sold and by these presents doth grant Bargain and Sell unto the said Joseph Boston his Heirs and assigns forever the aforesaid One Hundred and Thirty Six Acres of Land. (Part of the said Entailed Lands and not of the Mine Tract Situate lying and being in the County of Orange and Bounded as followeth to wit, Beginning at a white oak Corner to John Petty, Thence North Fifty degrees East one hundred and Forty four poles to a hickory and red oak Corner to Sleet thence with her line North Fifteen degrees West Fifty eight poles to a Mulberry and Locust Corner to Sleet and Willis, thence North Forty four and a half degrees East forty poles to a Chesnut Corner to John Boston thence South Seven and a half Degrees East Fifty two Poles to a hickory thence South Twenty five and a half Degrees West Eighty poles to a Chesnut. Thence East Twenty eight poles to two Chesnuts. Thence South Twenty two degrees East thirty poles to one whiteoak and two hickory Saplins. Thence South West Twenty poles to two white oaks in Cols? Spotswoods line, thence with the said line South Sixty four degrees West One hundred and Eighty poles to a red and white oak in or near the said Lines. thence North Thirty degrees East Sixty Seven poles to the Beginning. with all ways, waters, profits, improvements, Priviledges & advantages whatsoever to the Same belonging and the Rents, issue and Profits thereof To have and to hold The said Land and remises hereby Conveyed with the appurtenances unto the said Joseph Boston his heirs and assigns forever. To his and their own proper use. And the said Bernard Moore for himself and his Heirs doth covenant and Grant to and with the said Joseph Boston his heirs and assigns that he the said Bernard Moore hath not made Committed done suffered or willfully omitted, and that he will not do make Commit Suffer or willfully omit [page 153] A[ny] matter or thing whatsoever whereby or by means of which the said Joseph Boston may be prejudiced or his Title or Interest in the lands hereby Conveyed or any Part There of In Witness whereof the said Parties have hereunto Set their hands and Seals the say and year first above written.
