First I give my soul to God who gave it hoping that the merrits of my blessed Lord & Savior Jesus Christ to inherit eternal Blis and give my Body to the earth to be buried at the disiretion of my Executor hereafter I shall name. Item I give & bequeath to my Son William Cox one hundred acres of land beginning at Gahagon Corner ?? Chapman between plantation and his and so to Chapman line and to where he begun to him and his heirs forever. Item I give & bequeath to my Son Tyre Cox one hundred acres of land beginning at Chapmans line and my son Williams corner along Chapmans line as far as my land and cros in till he can turn to take his brother William line to the beginning but if he should die without heirs of his body lawfully begotten then my desire is it should be sold and divided amongst the rest of my children and after my wife decease and if he shall have and heir to him and his forever. Item I give & bequeath to my Son Care Cox one hundred acres of land joining of Mountague line and long by Rae line so along my line not taking any part of the plantation and so to his brother Tyre line to where it begun and after the decease of my wife to him and heirs forever. Item I give & bequeath to my Son Tolver Cox one hundred acres of land whereon my plantation is and so from his brother Care line and so to Terry Run and by Gahagon line and so to his brother William line and so to the beginning and my desire is my other three sons shall lay of their lands and the said Tolver shall have the more or less and after the my wife decease to hold the same to him and heirs forever. Item I lend to my well be love wife all the rest of estates after my debts be paid with the last three hundred acres during her life and the land to them that I already gave it and the rest to be divided amongst my sons that has no land to them and their heirs forever. I ordain my loving wife Martha Cox to be my whole Executors and she shall neither be tied to give Security nor to bring the said estate to be precod and disaloling all wills and testaments before to be void and this only to be in full force and value as witness my hand the 20th day of June 1751. Signed and sealed and delivered in presence of us James Mitchell her Eliz Mercy William Cox mark Thomas Gahagon Will presented to court on Thursday the 28 day of May 1752. Additional Comments: There has in the past been some misunderstandings about the content of this will. William was the brother of James Cox, and James had willed to William 400 acres of land that William was living on at the time. When William wrote his will he bequeathed all of the 400 acres to his 4 sons. However, he "lend" to his wife the use of 300 of those acres until her death. William's oldest son, William Jr., was to have his 100 acres immediately. The other 3 sons, Tyre, Toliver, and Care (Cary), would not have use of their land until their mother died - "--and after the decease of my wife to him and heirs forever."
