I Warner Cox of the county of Albemarle and state of Virginia being at present of sound mind and memory but feble in bodily strength and calling to mind the Uncertainty of life, and knowing that it is the lot of all men once to die do make this my last will and testament in manner and form following (viz) First and above all things I recommend my soul to God, and as to the wordly estate it has pleased the Almighty to bestow upon me, my just debts being first paid out of the same I dispose of it as follows, Item 1st It is my will and desire for the whole of my estate both real and personal to be valued by three disinterested men and its my will for my five children to pay my beloved wife Leah Cox legal interest on the one third part of it, each child paying his proper sum as long as she lives, the interest to be paid annually. I also give to my wife one servant to be chosen by her out of the sum of my Negroes not heretofore disposed of. I also give her choice of my horses. I also loan her my Brickhouse with the privilege of wood and water as long as she lives, then to go to Matthew or Sally Cox to whom I loan the undivided land upon which it stands as a part of that loan. Item 2nd I loan unto my daughter Eliza and her husband George Loflin the tract of land I purchased of the Austins estate it being the land upon which they are now living and all its appertinances and being in the county of Albemarle estimated at between two hundred & thirty or forty acres. I also loan them a Negro girl named Charlotte & her increase to be valued at six hundred dollars as an advancement to be estimated or considered a part of their legacy and at their deaths I give it to their children. I also give unto Eliza the bed and bedding already furnished. I also give to my beloved wife Leah Cox one good Bed and Bedding. Item 3rd I loan unto my daughter Virinda and her husband Manson Wood the tract of land I purchased of Peter Gibson estimated at seventy five acres with all its appertinances and lying in the County of Green also the tract I got of my fathers estate lying in said County of Green estimated at fifty eight and a half acres with all its appertinances also one Negro boy named Billy to be estimated at six hundred dollars as an advancement to be considered a part of their portion of my estate and at their deaths I give it to their children. I also give unto Virinda the bed and bedding already advanced. Item 4th I loan unto my son Taswell Cox & his wife Sally Cox the tract of land I got of [Samuel??] Estes estate lying in the County of Green and all its appertinances estimated at two hundred and thirty acres and at their deaths I give it to his children. I also loan him a Negro boy named Humphrey and as he is dead I shall charge him with three hundred dollars as an advancement to be considered a part of my estate and a part of their legacy. I also give them the bed and bedding already advanced. Item 5th It is my will and desire that the tract of land I purchased of Ira Browns estate shall be equally divided into two lots making them as near in value as may be and I loan one to Matthew and Martha and the other I loan to Sally Cox to be determined by ballot. I also loan to each of them a Negro girl during their natural life and at their deaths I give it to their children to be estimated at six hundred dollars a piece and I give to Matthew and Sally a good bed and bedding a piece. Item 7th [*] It is my wish for the rem& of my servants not already disposed of to be put into five lots making them as near in value as can conveniently be done and I wish my five children to draw for choice and I loan to each of them the lot that they may be draw in the same manner I do the land during their natural life and at their deaths I give it to their children. It is further my will that all the rem& of my estate not already disposed of shall be sold upon a credit of nine months the purchaser giving bond and such security as the Executor of this will may require. It is further my will that the valuation of each lot of land and the valuation of each lot of servants falling to either legatee shall be made equal in value out of the funds being added together arising from the sale of the perishable property and should that not be sufficient it is my will that it shall be made up out of the lots having too much unless the legatee having too much will pay back the overplus and should it amount to more than a sufficiency to make them equal after paying all just debts and expenses attending the sale I wish it disposed of in the same manner as my other estate and as I have frequently known attempts made to over throw wills now if this should be done by any of my children I revoke that part of my will leaving them one fifth part of my estate during their natural lives and I direct it to be added to the others that are satisfied. And I do hereby constitute and appoint my son Matthew Cox sole Executor of this my last will and testament hereby revoking all others heretofore made, given under my hand and seal this twenty ninth day of May eighteen hundred and fifty six signed sealed published and declared to be my last will and testament in presence of Thomas Durrett Sr his William Catterton Warner X Cox Collin Catterton mark Additional Comments: Transcribers note: the will appears to jump from Item 5th to Item 7th without an Item 6th being written.
