Rentfro, John Hall, Robert Sharp, H. Critz, B. Stovall, J. Hughes & J. S. Gaines -- Gentl. Also a Deed from James Whalen to Richd. Vaughan Acknowledged & O.R. Also a Deed from Wm. Burnett to John Burnett the same. Also a Deed from Jesse Corn to the same the same. A Cert. from under the hand of Wm. Burnett relative to land sold him by Jesse Corn Presented in Court Acknowledged & O.R. Also a Deed from Alexander Murphy to John Finney acknowledged and Liviny Murphy the wife of the said Alexander being Privily examined relinquished her right of Dower & the same was Ordered to be recorded by the Court. Abraham Penn is recommended to the Executive as afit Person to serve as Captain of the Militia of the 2d Batalion in the Place of George Ailsworth removed. A Certificate of the Qualification of Thomas Baker as Lieutenant of a Company of Riflemen 1st Batalion was retd. & O.R. William Adams Qualified as Captain of the Militia of the 1st Bat. & 18th Regiment. FEBRUARY COURT (28 Feb. 1805) John Tatum, foreman, William Witt Jr., Wm. Jones, David Taylor, James Taylor, Jesse Reynolds, John Spencer, Thomas Ayres Jr., Adrian Anglin, Abraham Penn, George Clark, Andrew Joyce, Moses Reynolds, Moses Walden & Thomas Bolling were Swo. a Grand Jury of inquest for the body of this whereupon they withdrew to consult on their Presentmts. A Deed from John Spencer, Daniel Spencer, Wm. Spencer, Jacob Spencer, & Wm. Deal to Jesse Reynolds Proved and Ordered to be recorded. Eli Ferguson Presented in Court his license & the same was Ordered to be recorded. Administration of the Estate of Coss Abraham a free negroe is Granted to Claiborne Shelton who Qualified and together with Eliphs. Shelton his security entered into bond and acknowledged the same accordingly. Samuel Staples, George Fulcher & William Witt are appointed to appraise the estate of Coss Abraham, Decd. & make report thereof to the Court. Wm. Banks Shf. for B. Hector Mcniel v Thomas Mitchell & John Hanby on their Schedule in that case rendered John Sharp a Garn. appeared and it is considered by the Court that the same be laid over until Tomorrow. same v same Samuel Hanby Sr. a garnishe the same. same v same Jona. Hanby a garnishee the same, same for Isaac Adams. same v same Benja. Philpott a garnishee the same & Saml Hanby Jr. same. Edward Lewis appeared in Court and was examined relative to his Wound received in the revolutionary War whereupon the Court were of Opinion that the said Lewis be continued on the state Pension list & his pay be as ___? and it is Ordered that the shff. pay the said Lewis fifteen pounds out of collection for the year 1804, and the same was Ordered to be Certified to the Auditer of Publick Accts. Wm. Banks Shf for H. Mcniel v Mitchell & Hanby. James Nowlin a garnishee being Sworn saith he owes the Deft. Mitchell Nothing & Dismissed. (1 March 1805) James S. Gaines, Gabriel Penn & Robert Sharp Gentl. are appointed Commissioners to settle with all former Sheriffs of this County for all Depositum or monies that may be in their hands and that they make report thereof to this Court. These Commissioners are appointed in the Place of Others that have been appointed for that purpose who failed to comply with the Duties thereby enjoined on them. William Banks Sheriff for the Benefit of H. McNiel v Thomas Mitchell. John Sharp being summoned to declare what he Owes the Deft. being swo. saith he owes him nine hundred & fifteen pounds of Richmond & Manchister Imported (?) Tobacco, with legal Int. thereon from the 14th day of July 1800 till paid & the Costs and Judgmt. thereon accordingly. Attorneys fee excepted. MARCH COURT (28 March 1805) Present: Joshua Rentfro, Hamon Critz, Samuel Packwood & Rob. Sharp -- Gentlemen Justices Elijah Banks Qualified as Deputy Sheriff under Wm. Banks, Shff. George Lackey is Allowed 1 day attend. for Keaton ads Banks et al. Present: Brett Stovall, Saml. Packwood, John Hall & Robert Sharp. Absent the rest. Wm. Banks Sheriff of this County appeared in Court Together with John Hughes, Jona. Hanby, Brett Stovall, John Hall, Greensville Penn, Robert Sharp, Gabriel Penn, George Penn, Wm. Carter & Haman Critz his securities & entered into Bond and acknowledged the same for the Collection of the Revenue tax of 1804, according to Law. Hardin Hairston is appointed Surveyr. of the Road from the Henry Line to Greensville Penns and the list filed be his Gang. Ordered that Hezekiah Mankin be appointed Surveyor of the Road in the Place of Robert Sharp from the forks of the Road below Tatums to the forks opposite Robert Halls & the list filed be his Gang. John Hughes Qualified as Capt. of the Artilery according to law. Samuel Hughes do. as second Lieutenant of Artilery do. John Hughes & Gabriel Penn is appointed to settle the Acct. Current of the Administration on the Estate of Frederick Fitzgerald deceased and make report thereof to the Court. APRIL COURT (25 April 1805) Present: Brett Stovall, William Cloud, Jonathan Hanby & Robert Sharp -- Gentlemen Justices Michael Duffy presented in Court his license as Pedlar & the same was Ordered to be recorded by the Ct. Patrick Desmond the same the same. (26 April 1805) Chilton v Bolts, a Jury Sworn to wit, Joseph Newman, George Lackey, Jos. Keaton, Jarrad Branson, William Adams, Abraham Penn, Wm. Allen, Archibald Shelton, Moses Hurt, John Keaton, Peter Epperson & David Taylor. Verd. ret. for the Deft. Isaac not guilty & also Verdt. retd. v John for $13. & Judgment thereon accordingly with Costs. John Lee appeared in Court and produced his Credentials of his Ordination also of his being in community with the Baptist Society. Whereupon he took the Oath of Allegiance to the Commonwealth and also of his faithful performance as a Minister of the Gospell, and together with George Lackey & Wm. Adams, his security, entered into bond and acknowledged the same according to Law. MAY COURT (30 May 1805) Present: William Carter, Brett Stovall, John Hall, and Robert Sharp -- Gentlemen Justices An Inventory of the Estate of Archelaus Hughes decd. returnd & O.R. Jedediah Carter is appointed Surveyor of the Road from the Creek at Taylors to the Middle fork of Mayo in the Bull Mountain in the Place of Townly Rigg & the list filed be his Gang. Thomas Bolling is appointed Surveyor of the Road from the Creek at James Taylors to James Murphys and the list filed be his Gang. An Inventory of the Estate of Coss Abraham a free negro ___(?) retd. and O.R. A Certificate from under the hand of Robert Sharp a Justice of the Peace as to the Qualifican. of Captain Jesse Tatum as a Militia officer returned & O.R. Also a Certificate from under the hand of Wm. Cloud a Justice of the Peace as to the Qualification of John A. Grigg a Lieutenant of the Militia retd. & O.R. Also an Other Certificate from the same as to the Qualification of Wm. Carter as Ensign of the Militia also was returnd and O.R. Hezekiah Mankin is continued Surveyor of the Road from the fork Roads on this side of Edward Tatums old Place by David Hanby and Eliphaz Sheltons to Samuel Staples Style through the Street of Taylorsville. And it is Ordered that he together with his former list of hands Elum Newman Eliphaz Sheltons hands all the hands and Sitizens of the Town of Taylorsville, and all hands within the said Bounds be his Gang and that they do clear and keep the same in repair according to law. Samuel Crutcher Sr. is appointed Surveyor of the Road from the D. Backbone near Josiah Farrisss to the Mouth of Mrs. Penn's lane and the list filed be his Gang. Francis Nowlin is appointed Surveyor of the Road from James Murphy to Saml. Staples Style in the Place of Alexander Murphy and the former list and all hands within their bounds be his Gang. James S. Gaines Gabriel Penn and Robert Sharp Gentl Commissioners appointed to settle with Delinquent Sheriffs are each allowed two dollars to be paid out of the Moneys arising from Delinquent Sheriffs as pr Settlement. James S. Gaines Robert Sharp and John Hughes or any two of them are appointed to examine the Clerks office and make report as to the situation thereof to the Court. William Banks Charles Foster & Robert Sharp or any two of them are appointed to Examine the Surveyors office and report the situation thereof to the Court. Wm. Carter is appointed Surveyor of the Road from the North Carolina line to the flower (?) Gap at the Grayson line & the list filed be his Gang. William Burnett is continued Surveyor of the Road from John Turners to the top of the Bull Mountain and his former list and all Lawful hands within said Bounds be his Gang. Samuel Staples Robert Sharp & Eliphaz Shelton or any two of them are appointed commissioners to let to the lowest bidder the Repair of the Courthouse in such a manner as they may think more efficient and right & make report thereof to the Court. Ordered that Norman Staples, David Stephens, Stephen Phyne, Thomas Parr, Thomas Baker, George Hairstons hands at the Mayo Quarter be added to Harden Hairstons Gang or list of hands, also Peyton Howell. Ordered that Hardin Hairston as Overseer call upn James Dearman, Wm. Adams, and James Thompson and their Gangs to make such repairs to the ford of the Mayo at Brewers old Place as may necessarily be required and to return again to their respective Roads. JUNE COURT (27 June 1805) Present: Gabriel Penn, Samuel Packwood, John Hughes and Robert Sharp -- Gentlemen Justices Joseph Willis is continued as Constable done at his request. Joseph Cummings is continued Constable who Qualified accordingly and together with Gabriel Penn & Wm. Witt his security entered into bond and acknowledged the same according to Law. Robert Sharp is recommended as Lieutenant of the Rifle Company in Place of Abram Penn promoted & Frederick Shelton Ensign of the same Company belonging to the second Batalion. Frederick Shelton in the Place of Robert Sharp Promoted. JULY Court (25 July 1805) Present: Charles Foster, Thomas Whitlock, Gab. Penn, John Turner, Robert Sharp & Jos. Stovall -- Gentlemen Justices. David Taylor foreman, Robert Hall, Beveridge Hughes, William Witt, David May, James Boling, John Keaton, William Sharp, William Harris, Moses Reynolds, Jesse Reynolds, G. Branson(?), John Finney, Abraham Hawks, Thomas Ayres & John Chapman were Swn. a Grand Jury of inquest for the body of this whereupon they withdrew to consult on their presmnts. Thomas R. Hall is appointed Constable who Qualified accordingly and together with George Lackey & John Chitwood his security entered into Bond and acknowledged the same accordingly. Commonwealth v Breden contd. Present Gab. Penn, Gentl. same v R. Sharp, the same v Eliphaz Shelton each Dismissed. Charles Foster, George Penn, & Hamon Critz are recommended as Sheriffs. (27 July 1805) Allen v Combs __(?) not guilty Saunna Sol(?) & refered to Wm. Carter, George Penn, Gabriel Penn, Samuel Hughes & Robert Sharp, the Gent. Justices now sitting in Ct. and it is Mutually agreed by the Parties that the aforesaid Gent. shall act in this Dispute as Arbitrators and their award to be considered as a final Judgt. of the Court. And accordingly the award is returnd in favh. of the Plt. for twenty dollars and Costs and Judgment thereon accordingly. Robert Sharp & Samuel Hughes are appointed commissioners to let to the lowest bidder the repair of the County Jail agreeable to the Plan now delivered there[on] and make report thereof to the Court of this proceding. AUGUST COURT 1805 (29 August 1805) Present: Samuel Packwood, Brett Stovall, John Hughes, Robert Sharp -- Gentlemen Justices A Deed from Joseph Reynolds to Richard Sharp acknowledged & O.R. Also a Deed from James Farral to the same, Proved by 2 Witnesses & O.R. Also a Deed from James Moles, Mary Foley, Christopher Foley and James Ferrall to the same. Proved by 2 Witnesses also & Ordered to be Certified. A Power of attorney from John Campbell to William Campbell Proved & O.R. Ordered that the Overseers of the Poor bind out Obadiah Daniel, Orphan, Aged six years first of last June, According to Law. James Turner, John Turner, David Harbour, & Wm. Burnett or any three of them are appd. appraisers of the Estate of Stephen Akins decd. & it is Ordered that they return an Inventory thereof to the Court according to law. William Banks Gt. Shf. of this County returned into Court his list of Insolvent lands also Insolvnt property which were examined by the Court Allowed and Ordered to be Certified to the Auditor of Public Accts. Turner Foster Qualified as Deputy Sheriff according to law unto Wm. Banks Gt. Shff. Beveridge Hughes is appointed Surveyor of the Road from John Turners to the top of the Bull Mountain in Place of Wm. Burnett & the list filed be his Gang. Robert Sharp & Samuel Hughes & Isaac Dodson are added to the Commissioners formerly appointed to settle the Acct Currt. of the Estate of Frederick Fitzgerald Decd. And it is Ordered that they or any three of them do settle the said Acct. & make rept thereof to the C[ourt]. OCTOBER COURT 1805 (31 October 1805) Present: Charles Thomas Gabriel Penn, B. Stovall, John Turner and Robert Sharp -- Gentlemen Justices An Account Current of the Estate John Lackey deceased by Peter Saunders Admr. retd. & O.R. Also a Deed from Moses Reynolds to John Adams Acknowledged and Susannah the wife being privily examined relinquished her right of Dower & the same was O. to be recorded. John Nancey & Salley Harbour to Saml. Harbour Prvd. & O.R. Taylor assee v Peter Epperson, Judgmt confessed according to specialty & Costs subject to __? Present Charles Foster, Wm. Carter, Gabriel Penn, & Robert Sharp, Gentl. absent the rest. (1 November 1805) James Taylor, Robert Sharp, & Samuel Hughes or any 2 of them Gent. are appd. to view the repairs of the County Jail & make report thereof to the Court. A Certificate from under the hand of Brett Stovall a Justice of the Peace as to the Qualification of Abraham Penn as Captain of the Militia, Samuel Hanby Sr. as E[nsign] and also Richard Thomas Ensign, was returned & Ordered to be recorded. Charles Foster Gentl. Produced in Court a Commission from his Excellency John Page Governor of this Commonwealth appointing him Sheriff of this County baring date Richmond the 24th day of August 1805 & in the 30th year of the commonwealth. Whereupon he entered into three bonds together with George Penn & Others his security, one for the true and faithfull performance as Shff. and an Other for the Collection the Public taxes and the Other for the collections Officers fee's fines etc Conditioned as to law, which was acknowledged accordingly. NOVEMBER COURT 1805 (28 November 1805) Present: Samuel Packwood, James S. Gaines, John Turner, and Robert Sharp -- Gentlemen Justices Charles Foster Gent. Presented his commission as Sheriff of this County and Qualified to the same according to law. Turner Foster is admitted his Deputy and also Qualified accordingly. William Sharp Sr. is appointed Surveyor of the road in the Place of Richard Sharp from the top of the Bull Mountain below the said Sharps Place up to the ford of Sycamore at the Widow foleys, and the list filed be his Gang. Major Hancock is Appointed Surveyor of the road from the top of the Bull Mountain to the Branch at the lower(?) end of Foleys old Field, & the list filed be his Gang. DECEMBER COURT 1805 (26 December 1805) Present: Joseph Stovall, John Hughes, Samuel Hughes, Robert Sharp -- Gentlemen Justices Mathew Sandifur Qualified as Deputy Sheriff according to law. The last Will and Testament of Shadrack Going was exhibited in Court Proved by the Oaths of David Picklesimer & Henry Adams, 2 of the Witnesses thereto subscribed to be the Act and Deed of the said Shadrick & the same was Ordered to be recorded by the Court. John Conner appeared in Court, Produced his Credentials of his ordination and of his being in regular communion with the Baptist Church Qualified according to law and entered into bond with security conditioned accordingly. James Taylor & Robert Sharp Gent. are appointed to View the repairs of the Courthouse and make report thereof to the Court. Moses Godard Qualified as Constable and entered into bond with security accordingly. James Taylor & Robert Sharp two of the Gent. commissioners appointed heretofore to view the repairs done to the Jail & Courthouse reported in to Court that on examination they found the same compleated according to Contract of S.
