Grigg, Jh. Hall, Robert Sharp, and John Turner -- Gentlemen Justices. The last Will and Testament of Bethany Haines was exhibited in Court Proved by the Oath of 1 Witness & O.R. William Calhoon Produced his License and was ordered to be recorded Oct. 1st. A Deed from Jonathan Isom to Joseph Reynolds Proved & O.R. Adams Sr. assee v Sharp Continued. William Hancock is appointed & Sworn Constable and entered into bond accordingly. Stephen Chilton is appointed Constable in the Place of David Picklesemer, entered into bd. & acknowled. the same according to Law. FEBRUARY COURT (27 February 1806) Ordered that Nelley Turner who was formerly bound unto John Smith be rebound & the Indenture be Transferred to Philip Buzzard the same being done by consent of par.... David Harbour foreman, William Witt, James Taylor, David Taylor, Daniel Martindell, Richard Sharp, Richard Thomas, Jarrad Branson, Mitchell Thompson, Augustine Thomas, Thomas Banks, David Ross, John A. Har..., Andrew Joyce, John Crum, Joel Willis, & William Hannah, were sworn a grand Jury of inquest for the body of this county whereup they withdrew to consult on their presentments. Hannah Going Widow and relict of Shadrick Going deceased appeared in Court and relinquished all her claim which was provided for her by the last Will and Testament of her deceased Husband and claims her thirds of the Decdents Estate which he died seized which was allowed her by the.... Robert Sharp, John Hanby Jr. and Matthew Sandifur are added to the former Coms appointed in the suit of Donalds Exors v Buford et al to lay of and sell the land mentioned in the Decree and any three of them are sufficient to carry the same into effect. Brett Stovall Gentl. is permited to solemnize the rights of Matrimony in this County under the Act of Assembly in that case made & provided who entered into Bond with security and acknowledged the same accordingly. Also took usual Oaths as is provided in those cases. Gabriel Penn, James S. Gaines & Robert Sharp, Gt., are appointed commissioners for the Purpose of settling with Wm. Banks late Shff of this County and make report thereof to the Court. MARCH COURT (27 March 1806) A View of a Road and also the report thereof from the head of Shooting Creek to the Waggon ford where it crosses said creek leading to Col. Saunders returned And it is Ordered that Hugh Boyd call on Wm. Sneed and his Gang and that they do clear the same according to law and then to return again to their respective roads again. A Deed from John Medley and Wife to William Rickman Proved & O.R. On the Petition of Edmund & Phillip Penn, Infant Heirs of Abraham Penn deceased, Gabriel Penn their Brother is appointed their Guardian, who entered into bond with security conditioned according to law. An Acct. of sales and division of the Estate of Abraham Penn decd. retd. & O.R. Adams v Sharp on a Petition & Summons continued. Ordered that the hands belonging to Col. Hairston at his Plantation bought of Rentfro be added to James Eppersons list of hands. Hardin Hairston Qualified as Deputy Sheriff for Charles Foster Gent. Sheriff of this County. Samuel Hanby Sr. is recommended as Lieutenant of the 2d. Batalion of Militia in the Place of Eli Bellar removed. Present Wm. Carter, Wm. Banks, John Hughes, George Penn, Thomas Whitlock, Robert Sharp & Brett Stovall, Gentlemen Justices. John East is also recommended as Ensign in Place of Saml. Hanby Promoted of the same Batalion. William Frans is also recommended as Lieutenant of the rifle company of the 1st Batalion in the Place of Thomas Baker resigned, and Frederick Critz is also recommended as Ensign in the said Wm. Frans's Place who is Promoted. Adams v Sharp on a Petition Judgment confessed according to specialty & Costs. Stay exon. till July Court next. William Carter, One of the Exors named in the last Will and Testament of Shadrick Going deceased appeared in Court and Qualified according to law and together with John Hughes his security entered into bond & acknowledged the same accordingly. Nathl. Smith, James S. Gaines and Samuel Hanby Senr. are appointed to appraise the Estate of Shadrick Going decd. and return an Inventory thereof to the Co[urt]. APRIL COURT (24 April 1806) ...a Deed from Richard Sharp to Jesse Corn Jr. acknowledged & O.R. Also a Deed from Eliphaz Shelton to Joseph Newman, Francis Nowlin & Claiborne Shelton same. Also a Deed from Benjamin Philpott to Saml. Staples Acknowledged & O.R. Corn v Lyon. John Tugle Spl. Bl. Judgmt confessed according to specialty & Costs. Stay exon. till the last of Oct. next. A Deed from John Lee to E. Dehart furth. Proved & O.R. On the Mo. of Joshua Haynes leave is Granted him to keep Ordinary at his house in this County, & Give Bond with security according to law. A Deed from David Ross to John Koger Acknowledged & O.R. Also A Deed from George Dodson to Joel Chitwood the same. William Clark Gent. Produced his License as an Atto. at law & Qualified accordingly. Barton assee v Tuggle. Reuben Burnett Special Bail. (26 April 1806) Turner v Lyon Dismissed the Pl. not further Prosecuting. Robert Sharp is allowed 1 days attendance for Smith (?) v Keaton. MAY COURT (29 May 1806) William Sharp, John Koger, & George Lackey are appointed to View away to turn the road from the town end of Moles's Plantation to the first Nobb of the Bull Mountain and that they do make report thereof to the Court. Samuel Hanby Senr. is appointed Surveyor of the road from Peters Creek in Hanbys lane to little Dann in the Place of David Picklesimer & the list filed be his Gang. An Inventory of the Estate of Shadrick Going deced. was returned & O.R. An Inventory of the Estate of Stephen Akers decd. retd. & O.R. Present: Joseph Stovall, John Turner, John Hall, Gabriel Penn, Wm. Banks, George Penn, Charles Thomas, Samuel Packwood, James S. Gaines, Robert Sharp, William Carter, Haman Critz, Samuel Hughes & Brett Stovall, Gentlemen Justices. Joseph Stovall & Peter Scales Gent. Justices appeared in Court and resigned as Majistraits. A Deed of Gift from Henry Frans Senr. to John Adam Proved by 1 Witness & O.R. Also a Deed of Gift from the same to Peter Henry Adam, the same. Greensville Penn, Thomas Penn, Abraham Penn, E. Banks, Josiah Farris, John Tatum, William Adams, Edward Philpott, Mitchell Thompson, Richard Thomas and Adam Turner, Gent., are recommended to the Executive as Proper and fit persons to serve as Majistraits in the County in addition to the former. Samuel Packwood resigned as Justice of the Peace. Samuel Hughes is recommended as a Capt. of the Artilery in the Place of John Hughes resigned, & Hardin Hairston 2d Lieutenant in the Place of the said Samuel Hughes Promoted. Gabriel Penn is appointed Surveyor of the road from the Widow Penn's to Scritchfields old Place on Blackbury & the list filed be his Gang. Thomas Reaves is recommended to the Governor as a fit person to serve as Lieutenant in the Place of Charles Foster resigned 1st Batalion, & James Randals Ensign in the Place of of James Mize resigned 1st Batalion. Jona. Hanby, Wm. Carter, Wm. Banks, Charles Foster, George Penn, Haman Critz, Brett Stovall, Charles Thomas, Thomas Whitlock, Gabriel Penn, Munford Smith, John Hughes, James S. Gaines, Wm. Cloud, John Turner, John Hall, Saml. Hughes, Robert Sharp, John A. Grigg -- Are considered all the Acting Justices in the County of Patrick & it is Ordered that the same be Certified to the Governor and Councill agreeable to their Circular letter to this Court. AUGUST COURT (28 August 1806) Present: William Banks, Brett Stovall, Gabriel Penn, James S. Gaines & Robert Sharp -- Gentlemen Justices Moses Hurt is appointed Surveyor of the road from the Widow Turners to Obadiah Burnett's Mill and the list filed be his gang. Robert Sharp Appointed Overseer of the Poor in the Place of Robert Hudspeth who Qualified according to Law. Greensville Penn, Josiah Farris, William Adams, Mitchell Thompson, Richard Thomas & Adam Turner, Gent. each took the Oath of Fidelity to the Commonwealth & Federal Government, the Oath of a Justice of Peace & Justice in Chancery according to law. Also John Tatum. Robert Sharp, William Frans, Thomas Reaves, Samuel Hanby Sr. are each Qualified as Lieutenants of the Militia & Frederick Critz also Qualified as Ensign of a company of Riflemen of the first Batalion, according to law. John Tuggle, Reuben Burnett, Newman Helton & Saml. Helton or any 3 are appointed to View away from Reuben Burnetts to the top of the Mountain & make rept thereof to the Court. OCTOBER COURT (1 Nov. 1806) Present: William Banks, George Penn, Brett Stovall & Robert Sharp -- Gentlemen Justices. Archebald Shelton v George Lackey. Dismised the Plt paying 15/ of the Costs, the deft. to pay the Balance. Ordered that Brett Stovall, John Tatum & Robert Sharp or any 2 of them let to the lowest bidder the repairing of the County Jail at the next Court, and make report thereof etc. NOVEMBER COURT (27 November 1806) The last will & Testament of Isaac Adams decd further proved & O.R. Mary Parr came into Court & relinquished her right to Administer on the Estate of Mark Parr decd. who died intestate whereupon Administration of the said estate is granted to Smith Parr who made oath according to law & with Munford Smith & Jesse Tatum his securities entered into and ackd. bond. Gabriel Penn, John Hughes, Matthew Sandifur, Robert Sharp & John Tatum or any three of them are appointed to Inventory & appraise the Estate of Park [sic] Parr decd. & make return to Court. Mary Parr one of the executors named in the last will & Testament of John Parr, decd, qualified as exor. & together with Nathaniel Smith, Jesse Tatum & Charles Collier her securities entered into & acknowledged bond according to law in the sum of $5,000. The same commissioners who were appointed to appraise the estate of Mark Parr decd. are appointed to inventory & appraise the estate of John Parr decd. & make return to Court -- or any three of them. The last will & Testament of Wm. Roberson decd. was exhibited in Court proved by 1 witness & ordered to be certified. Brett Stovall & Wm. Adams Senr executors of Isaac Adams decd. qualified as executors & with Wm. Hanks & Gabriel Penn their securities entered into and ackd. bond according to law. Saml. Clark, Josiah Farris, John Frans & Thos. Banks or any three of them are appointed to inventory & appraise the said estate & make report to Court. Richard Sharp is appointed Surveyor of the road from Francis Turners to Foleys in the place of Adam Turner & the list filed be his gang. On the motion of Charles Foster Gent. Sheriff, Matthew Sandifur took the usual oath of Deputy Sheriff according to law. John Strange is appointed surveyor of the road from the foot of Ball(?) Spur to the fork of the road above Peter Bellars & the list filed be his gang. Levy Atkins Senr. is appointed surveyor of the road from the foot of Ball(?)
