PATRICK COUNTY, VA - COURT - Order Book "1" (Selected Entries, 1808) ----¤¤¤---- PATRICK CO., VA., ORDER BOOK 1 (SELECTED ENTRIES), 1808 JANUARY COURT (23 Jan. 1808) Josiah Farris, Jacob Critz, John Frans & Richard Harrison or any 3 of them are appointed to appraise the estate of Hannah Adams decd. & make report thereof to the Court. Wm. Jones, Robert Sharp, Gabriel Penn, Benjamin Philpott & John Newman, or any 3 of them are appointed to appraise the Estate of Wm. Barton decd. and make report thereof to the Court. Ordered that Elisabeth Vaughan heretofore being bound unto John Turner be rebound or transfered to Wm. Hancock according to law. FEBRUARY COURT (25 February 1808) On the Mo of Septemmy Barton Widow & relict of William Barton decd. by N. H. Claiborne her Atto. The said Widow appeared in Court and relinquished her Claim under her Husbands Will and takes her thirds agreeable to law & David Taylor, Wm. Jones, Robert Sharp, & Benja. Philpott or any 3 of them are appointed to lay off and assign to her her Dower and make report thereof to the Court. An Inventory of the Estate of William Barton decd. was retd. & O.R. John Hall, John Turner, & Richard Sharp are appointed Commissioners under the late replevy law to Value Property on that part of the County north of the Bull Mountain. Also Richard Harrison, Jacob Critz, and John Frans Sr. in that part of the County South of said Mountain up to a line Straight from Patrick Court house to the North Carolina line, & Charles Lewis, James L. Gaines & John A. Grigg in the upper dist. Benjamin Philpott v Charles Crutcher on a Mo. for executing Property as a Constable not within his District, Notice Proved & Contd. until Tomorrow. Nathl. Smith, William Collings, Elijah Collings & Andrew Joyce or any 3 of them are appointed to appraise the Estate of Thomas Hornsby decd. and make report thereof to the Court. On the Mo. of Thomas Reeves by his Atto. for an Injct to Stay the pre_____? g___? of a Judgment obtained by John Redd v him untill the same can be heard in equity and on hearing the bill and arguments thereon ___? the same was Granted him for the whole Amt. until the matter can be heard on equity and he together with Richd. Injn. Contd. MARCH COURT (31 March 1808) A report of the Gentlemen commissioners appointed to lay off and alott the lands of Isaac Adams decd. to Joseph Thomas & Elisha Adams heirs of the said decedant their equal shares was returned and O.R. An Inventory of Hannah Adamss estate returned & O.R. Also 4 Plats and Certificates of the land layd off and allotted to Joseph Thomas and Elisha Adams heirs of Isaac Adams decd. was also returned & Ordered to be recorded by the Court. Richard Harrison is Qualified as Commissioner to Value Property under the late Act of Assembly in that Case made & provided. William Fontaine Gent. Produced his license as an Atto. at law and also took the several oaths required by law in this Case. Matthew Sandefur is Appointed Constable from Peters Creek to aline leading with Corns Road by David Taylors, William Spencers, R. Hopkins, Clarks Mill, and thence Down Spoon Creek to the Henry line & he accordingly Qualified & entered into bond with Gabriel Penn & John Hughes his securities according to law. A report of a View of a Road from the foot of the Bull Mountain near Wm. Sharps into Rosss Road near Zaphaniah Tenisons. Noah Parr & John Hughes appeared in Court and Qualified as exors to the last Will and Testament of John Parr Senr. decd. and they together with Brett Stovall & Samuel Hughes their securities entered into and acknowledged bond according to law. Administration of the estate of William Deal deceased is Granted to Solomon Keaton who Qualified according to law & together with Gab. Penn his securitie entered into bond conditioned according to law. David Taylor, John Adams, John James & Townly Rigg or any 3 of them are appointed to appraise the estate of William Deal decd. and return an Inventory thereof to the Court. Matthew Sandifur Presented in Court an account against the Public for services rendered in Criminal Cases amounting to $4.94 cents is allowed 50 miles going and returning to Franklin Court house to compare(?) the Polls of an election of a member to congress also the same services rendered by Hardin Hairston all which were Ordered to be certified to the Auditor of Public Accounts. Jesse Corn Jr. Deputy Sheriff for this County appeared in Court and objected to the Sufficienty of the County Jail. Samuel Staples, Robert Sharp, Charles Foster, Wm. Banks, John Turner, Peter Scales & George Penn them or a majority of them are appointed to View the County jail and report to the 2d. day of next Court whether or not the County Jail shall be repaired or a new one built and if a new one built in what manner & form etc. etc. APRIL COURT (28 April 1808) John & Elijah Edwards is exempted from paymt. of levies. Thomas Ayres Sr. exempted from paymt. of levies. ...a Deed from George Lackey to James Moles Proved & O.R. Dix Alexander & Co. v John Sharp Sr. Officl Judgment set aside Wm. Banks Sr. & O.R. ...a Deed from Wm. Sharp Sr. to James Sharp Acknowledged & O.R. Also a Deed from John Hall to Wm. Sharp Jr. the same. Richard Thomas is allowed 1 days Attendance for Lockhart v Sharp. Elisabeth Thomas the same. Charles Hatcher Presented in Court his license as Hawker & Pedlar issued the 14th Decr. 1807 & was Ordered to be recorded. MAY COURT (26 May 1808) Richard Sharp Qualified as second Lieutenant of a Troop of Cavalry according to law. An Inventory of the estate of Richard Powell decd. returned & O.R. William Sneed is recommended to the Executive as a proper & fit person to serve as Ensign in the Place of David Harbour resigned of a Company of Militia in the 1st Batalion. James Randals is also recommended as Lieutenant in the Place of Thomas Reeves resigned of the same Batalion. An Inventory of the estate of Thomas Hornsby decd. retd. & O.R. Ordered that Joseph Reynolds call on John Tuggle or the overseer in his bounds, Reubin Harris & his hands, Richard Sharp & his hands or gang & David Roberson Sr. & his Gang & that they do clear the road Viewed & Marked from Mabrays old Place to the Mountgomery line according to law & when done to return again to their respective roads again. David Taylor, John James, David Harbour & John Chitwood or any three of them being first sworn before a Justice of the Peace of said County are appointed to View the way for a road from the Mayo between Taylors & Corns into to Corns road and make report thereof to the Court. JUNE COURT (30 June 1808) Present: Gabriel Penn, Thomas Penn, Robert Sharp & John Hughes -- Gentlemen Justices. A Dedimus for the privy examination of Mrs. Elisabeth Frans, wife of Henry, relinquishing her right of dower in & to a Certain tract of land conveyed by her Husband to John Hughes was returned & O.R. A Deed from James Hall to Richard Sharp Proved & O.R. A report of the Gentlemen Commissioners appointed to lay off and allot to Lucy Deal, Widow of William Deal decd., her Dower in his lands was returned & Ordered to be recorded. Also 4 Plats and Certificate ascertaining the said Dower etc. was also returned & Ordered to be recorded by the Court. On the motion of Munford Smith by his Attorney for a Judgment against Benjamin Philpott, one of the Constables of this County, for failing to return his exon. etc. against David M. Keaton. On hearing the Arguments on both sides by their Coun...? the same was Overruled & Dismissd with ___? AUGUST COURT (25 August 1808) Ordered that the Sheriff pay William Fuson four dollars out of the Depositums in his hands for the year 1807 for so much allowd said Fuson as a former Processioner of this County. Ordered that Gabriel Penn, Robert Sharp, John Hughes, & John Tatum or any 2 of them are appointed to settle with all former sheriffs that have not settled there arrearges and make report thereof to the Court. Betsey & Lilley McMillian appeared to their recognizance as being bound to the Peace by Jane Hicks, the said Jane not appearing to comply with the requisites of the law in that case the same is dismissed. Enock Bridwell is appointed Surveyor of the Road from the top of the Bull Mountain to the bounds of John Gussett & it is Ordered that all lawfull hands in said bounds be his Gang. Joseph Newman is allowed 1 days attendance last Court as a witness for Ingram agt. Nowlin. SEPTEMBER COURT (29 Sept. 1808) A Deed from Benjamin Philpott to George Carter Acknowd. & O.R. Gilbert Rowland Qualified as a Collector of Clerks fees by Permission of the Sheriff of this County. Jesse Corn Jr. D.Shff. Presented in Court 3 lists of Insolvents to wit Insolvent lands Property & tithes each for the year 1807 which was examined allowed and Ordered to be certified to the Auditor of Public Accounts. James L. Gaines, John Hanby, Gabriel Hanby & Wm. Burge or any [3?] of them are appointed to view a way for a Road from the North Carolina line near the King Spring to the Hollow Road between the 2 Dann's and make report thereof to the Court. James L. Gaines, Nathl. Smith, John Tatum & Wm. Burge or any 3 or them are appointed to view away for a Road from the Whole Plaines to Burwell Johnsons & make return thereof to the Court. Wm. Maddox, Benja. Hancock & Giles Martin & their respective Gangs are Ordered to clear a Road Viewed from the forks between Sharps & the B. Mountain to the Road near Tenisons & to make report to the Court & then to return to their respective Roads again. Richard Harrison, Wm. & E. Banks & Brett Stovall, H. Hairston or any 3 of [them] are appointed to settle the Account Current of Philip Penn decd. [&] make report thereof to the Court. OCTOBER COURT (28 October 1808) Lockhart agt. Sharp, by consent of the Parties the Plt. is permited to take the Depo. of Isaac Breden Debeneesse [De Bene Esse?]. David Harbour is Allowed 2 days Attendance for Sharp ads Lockhart. Richard Thomas is allowed 2 days attendance as a Witness for Robert Lockhart v Richard Sharp. John Chitwood is allowed 1 days attendance as a Witness for Sharp at the suit of Lockhart. Francis Pilson is allowed 2 days attendance as a Witness for Lockhart agt. Sharp. William Burnett is allowed 2 days for the same. NOVEMBER COURT (24 November 1808) Nancy Hughes widow & relict of Beveridge Hughes decd. appeared in Court and Qualified as an Administrator of the said estate entered into bond with Richard Sharp & Others her securities & acknowledged the same according.... John Turner, Wm. Burnett, William Hancock, David & Moses Ha.... or any 3 of them are appointed to appraise the said estate & make report thereof to the Court. John Turner, Wm. Burnett, Thomas Reeves, Jesse Corn Sr. & George Lackey & James Ferrell, Wm. Fuson & John Corn or any 5 of them are appointed to review a road formerly Viewed from Reubin Bu[rnetts ?] to the Montgomery line up Maberrys Gap & make report of their Proceedings thereof to the Court. DECEMBER COURT (29 December 1808) Present: Gabriel Penn, Brett Stovall, Robert Sharp, John Turner & John Tatum -- Gentlemen Justices. Hezekiah Stout Presented in Court his license Permiting to sell goods in this state of foreign groth & manufacture as a Hawker & Pedlar dated the 25th October 1808, Which was Ordered to be recorded. A Deed from James Via & Salley his wife to John Slaughter acknowedged & Saley the Wife being Privily examined relinquished her right of Dower & the same was Ordered to be recorded. James Oneal is appointed Surveyor of the Road from the No. Carolina line to top of the Mountain at the Good Spur at the Grayson line in the Place of Joseph Johnson & the list filed be his Gang. An Inventory of the Estate of Wm. Deal was returned & Ordered to be recorded. Administration of the Estate of Frederick Clusman (?) is Granted Hardin Hairston who Qualified according to law & together with Wm. Adams his security entered into bond & acknowledged the same according to law. A Power of Attorney from Jane Williams to Samuel Packwood acknowledged & O.R. A Deed from Richard Stockton for Robert Stockton to Ezekiah Purdy Proved & Ordered to be recorded. John Hughes, Robert Sharp, E. Banks, Peter Scales & Robert Adams or any 3 of them are appointed to settle the Account Current of John Parr Sr. decd & make report thereof to the Court. Also to appraise the said estate. The County of Patrick for the year 1808 is made Dr. $ & [cents] To the Sheriff his Annual Salery 25.00 " the Clerk the same 25.00 " ditto services to Commissioners 40.00 To the Deputy States Atto. his salery 30.00 " Richard Sharp 48 hours Patroll 3.00 " John Chitwood same 3.00 " Hugh Boyd for one old Woolfs head 6.00 " Newman Prator 1 ditto for benefit John Turner 6.00 ______ 138.00 To Samuel Staples for boarding Switzler Jackson etc & a/c 7.74 ______ 145.74 Jacob Critz, William Banks Jr., Thomas Brown & Washington Thomas or any 3 of them are appointed to appraise the Estate of Frederick Closeman decd. & make report thereof to the Court. Joseph Newman is allowed 1 days attendance for Ingram v Nowl[in]. Nathl. Smith one of the securities to the Executorship of John Parr Jr. decd. came into Court and refused to conti[nue] any longer as security & it is Ordered that the Estate of the said John Parr Jr. decd. be Inventoried & put into the hands of the Shff of this County & when the same are done then said Nathl.
