George Lackey v William Ferrell, in an attachment the Deft. appeared in Court & offered his Brother James Ferrel in Spl. Bl. whereupon the said James acknowledged his recognizance accordingly. An account of sales of the estate of Francis Turner decd. was retd. & O.R. A Negro woman Belley the Property of M. Sandifur is exempted from the payment of County & Parish levies for the future. The Order of last Court discharging Nathl. Smith from his securitiship in the case of John Parr Jr. decd etc is hereby resinded. Wm. Carter, James L. Gaines & Saml. Administration of the Estate of Jesse Corn decd. is granted Nancy Corn widow & relict of the decedent who Qualified according to law & together with Richard Sharp, John A. Corn, Wm. Corn & Jesse Corn her securities entered into bond in Penal sum of three thousand dollars for the Administration of the same and accordingly the same was acknowledged. John Burnett, John Hall, Wm. Fuson, Thomas Reeves & Charles Foster Sr. or any 3 of them are appointed to appraise the said estate and make report thereof to the Court. John Hawks is appointed Surveyor of the Road from the No. Carolina line to the top of the Mountain at the Flower Gap & the list filed be his Gg. John Hall Jr. is appointed surveyor of the road from Shooting Creek to the forks by Bartletts in the Place of Hugh Boyd & the list filed be his gang etc. Joseph Willis is appointed surveyr. of the road from the Creek in Moors land to Abraham Penn's Store in the Place of William Cook & the list filed be his gang. John James, Townley Rigg, Joel Chitwood & James Taylor or any 3 of them are appointed to view a way to turn the road at the mouth of Jesse Reynolds lane to the roaring fork of Mayo & make rept. thereof to the Court. James Nowlin is appointed surveyor of the Road from the forks of the Road above Penn's Store to the schoolhouse near Capt. Sheltons & the list filed be his gang. To Gabriel Penn for services rendered in settlemt. with the Shff 4.00 To the same for summoning a inquest on the body of J. William Gaines is appointed surveyor the road in the Place of Aron Bowman from the forks of the Road b[e]low William Goings at or near Sandy Creek to the ford of Dan near Major Carters & the usual list of hands be his gang. Haman Bowman is appointed Surveyor of the road from the ford of big Dan near William Carters to the bell Spur road & it is Ordered that Wm. Carters hands, Harmon Bowman, Norman Bowman & Gilbert Bowman be his gang & that they do clear & keep the same in repair according to law. Aron Bowman is Appointed surveyor of the road from the foot of the bell Spur road to the Grayson line & it is Ordered that Robert Bowman, Solomon Puckett, John Bowman, Charles Bolt, David Rowark, Burwell Smith, Nathl. Young, Elias Bellar, John Cole, John Vancel Jr. & Samuel Bowman be his Gang. Stephen Chilton is Appointed Surveyor of the Road from the foot of bells spur to the Hollow Road in the room of John Strange & it is ordered that Joseph Brim, Robert Strange, Elias Vancil & Jacob Abshire(?) be his gang. Benjamin Mayo is appointed surveyor of the road from the branch in Foley's old field to the top of the bull Mountain in the Place of John A. Hancock & the list filed be his Gang. William Corn is appointed Surveyor of the road from the top of the bull Mountain to the ford of Sycamore near Richard Sharp & it is Ordered that John Harbour, Joseph Martain, Thomas Reeves, John Glassley (Glaspley?), Wm. Sharp Sr. & hands, Francis Spaulding, James Cheek, Widow Corns hands & Jesse Corn be his Gang. APRIL COURT (27 April 1809) ...a Deed from Lewis & John Hancock to Wm. Lyon Proved & O.R. Also a Deed from Wm. McAlexander & John Seay to James McAlexander the same. Also a Deed from John Seay to Wm. McAlexander Sr. the same. Also from Robert Sharp to Wm. Sharp Acknowledged & O.R. (28 April 1809) Robert Sharp is recommended to the Executive as a fit person to serve as Capt. of a Company of Riflemen of the 2d Batalion to supply the Vacancy of Capt. Jesse Tatum resigned. Also Frederick Shelton as Lieutenant to supply the Vacancy occasioned by the Promotion of the said Robert Sharp. George Carter Ensign to supply the Vacancy of Frederick Shelton Promoted. Smith v. Hanby W.E. set a side & the Defendant Pleads not guilty & ______? demense (?) & a Jury sworn to wit William Keaton, William Sharp, Peter Bellar, H. MAY COURT (25 May 1809) Present: William Banks, Brett Stovall, John Hall & Robert Sharp & Adam Turner -- Gentlemen Justices An Inventory of the estate of Jesse Corn deceased was returned & O.R. A report of a View of a Road from the mouth of Jesse Reynold's lane to the Roaring fork of Mayo River returned & O.R. On mo. of Samuel Staples leave is Granted him to keep Ordinary in the town of Taylorsville at Patrick Courthouse & he together with John Hale as ...? security entered into bond & acknowledged the same according to law. Adam Turner, James Ferrell, John Burnett & W. Rowland or any 3 of them are appointed to view a way to turn the road from the Widow Duweeses to to the top of the hill between Richard Sharp's & Hairston's Store & make report thereof to the Court. Moses Harbour is Appointed Surveyor of the Road in the Place of James Ferrell from the forks near the Widow foleys to the forks below Benjamin Mayo's & the list filed be his Gang. Ordered that Samuel Staples have a press (?) made in a cheep Manner for the Clerks office, six convenient Benches for the Jury Room, one Table, & a minute record book he is to have procured & when done for Samuel Crutcher & David Perkins to fix the Prices which is hereby Ordered to be paid by the Shff out of the Depositums in his hands for the years 1807 & 1808 & the above Gent.mens Certificate on a copy of this Order shall be the Shffs Voucher for the same. Abraham Staples is permited and Qualified as Deputy Clerk of this Court and Qualified accordingly. JUNE COURT (29 June 1809) Present: Brett Stovall, Adam Turner, Robert Sharp & Edward Philpott -- Gentlemen Justices On the mo. of Malichi Parmer, by Jos. Chilton Gt. his atto. for a Judgment against Elijah Lyon & Samuel Carrell on a forthcoming bond the nature of such mo. having been proven & the Deft. Cal.d & not appearing It is therefore Considered by the Court that the Plt. recover agt. the Deft. & his security Judgment according to the said bond & Costs. A Dedimus for the Privy examination of Mary Hanby wife of Wm. Hanby relinquishing her claim to a certain tract of land convey[ed] by her Husband to Dandridge Slaughter was returned & O.R. John Hughes, Greensville Penn & Mathew Sandifur are appointed to settle with Burser & Clerk for monies that may have been recd. for fines etc. & make report thereof to the Court. On mo. of the Overseers of the Poor, on behalf of Larkin Worf (?), an apprent[ice] boy bound to James Dearman , Ordered that the said boy be delivered up to the Overseers of the Poor, & that they do rebind the said boy unto some other fit master. JULY COURT (27 July 1809) John Grady is exempted from paying County & Parrish levy & from working on the road. A negro man slave named Samuel belonging to the estate of Jarrard Banks decd. the same. David Harbour, Foreman, Jacob Critz, William Sharp Sr., Charles Foster Sr., Adrain Anglin, William Witt Jr., James Taylor (...?), Charles Bolt, Richard Pilson, David Taylor, Wm. Harris, Jesse Reynolds, Elijah Dehart, George Pigg, Paul C. Ingram & Thomas Beazley was sworn a Grant Jury of Inquest for the body of this county whereupon they withdrew to consult on their presentment. The last will & Testament of Robert Wright was exhibited in court by John Hall, [Sar?]y Wright, & George Pigg. Proved by the Witnesses thereto & ordered to be recorded by the court & the said John Hall & Sary Wright Ecx. of the said will named appeared in court, Qualified according to law, & they together with Gabl. Penn their security entered to bond & acknowldged the same accordingly. James Bartlett, William Sneed, William Fuson & Edward Pedigo or any three of them are appointed to appraise the said estate & make report thereof to the court. Present: William Carter, Thomas Penn, Robert Sharp. A Certificate from unto the hand of the Clerk of Jesamine County State of Kentuckey together with the seal of Office stating that Manoah Singleton & Richard Lafon is Justice of the Peace of said County who have taken the relinquishment of Miriam Walker's Dower in a certain undivided tract of land conveyed by her husband to Gabriel Penn, was returned and Ordered to be recorded by the Court. Hamon Critz, Brett Stovall, & Munford Smith are recommended to the Governor as Proper & fit Persons to serve as Sheriffs for this County. AUGUST COURT (31 August 1809) A View for a road from Reuben Burnetts to the top of the mountain to the Montgomery line returned & O.Recorded & it is Ordered that John Tuggle & his gang, Samuel Helton & his gang, Reubin Harris & his gang, Moses Hurt & his gang, M. Parmer & his gang, William Hancock & his gang, James Bartlett & his gang do cut & clear the road aforesaid under the direction of John Turner esquire According to law & when done to return to their respective roads again. James Sharp, Qualified as Deputy Sheriff of this county according to law. Paul C. Ingrum is appointed Surveyor of the road in the place of Barnard M. Price from the lower end of Sapphaniah Tenisons Plantations to the Franklin line & the list filed be his gang. Administration of the estate of Leathey Adams was granted to Britt Stovall, who Qualified according to law & he together with Greensville Penn his security in the sum of five hundred Dollars & acknowledged the same according to law. William Banks Sr.(?), Elijah Banks, Martin Miller & Joseph Stovall, or any three of them are appointed to Appraise the said estate & return a Inventory thereof to the court. Ordered that John Turner one of the Overseers of the Poor of this county do bind Out Shadrack Ozley (?) an Infant aged 12 years the 29th of January next according to law. Ordered that David Taylor one of the overseers of the Poore of this County bind out Willy Riddle[y] aged 18 months to John Turner, Jr., according to law, & it is further Ordered that David Taylor bind out Polley Riddly aged 12 years, Thomas Riddley 10 years & Rowland Riddly 4 years according to law. Ordered that an apprentice Boy James Redman heretofore bound to Ruth Penn be realeased & set at liberty by consent of each party. Britt Stovall, William Banks Jr., Martin Miller & David Parkins or any three of them are appointed to View a way for a road from near William Banks to the Henry Line near Gilmers also from the begining aforesaid to Jacob Critzs Ford on Mill Creek & make report thereof to the Court. John Tatum, Andrew Joyce, Nathl. Smith & William Smith Sr. or any three of them are appointed to View a way for a road from the Bank of the Creek on the side of David Hanbys to the north carolina line near Cardwells Mill & make report thereof to the Court. A Writ of Adquodammum is granted Jesse Corn to build a Mill, etc. SEPTEMBER COURT (28 September 1809) Sampson Jones is Qualifyed as Ensign of the Militia according to law. A power of Attorney from Nancy Corn widow of Jesse Corn Sr. to Jesse Corn Jr. Acknowledged & ordered to be recorded. A Deed from Greensville Penn in his own write & also as power of Attorney from Thomas & James Penn who intermaried with Catharine & Marthey Leath to Nathl. Cheeldon(?) was acknowledged in court by the within named Greensville Penn & Marthey & Catharine Leath wives of the said Thomas & James Penn was privily examined in court & they relinquished their writes of Dower in the sd. lands & same was Ordered to be certifyed to the court of Chesterfield County. A Deed from George Penn, Gabl. Penn, Polley Penn, Greensville Penn, Abraham Penn, James Penn, Edmond Penn & Phillip Penn to Thomas Penn was Proved & Jane the wife of Gabl. & Catharine the wife James relinquished their writes of dower & the same was Ordered to be recorded. Ordered that David Harbour & John Turner do bind out James Parmer to some fit person according to law, he being heretofore bound to Joel Harbour & has hereby discharged g...? Him the said boy being about 8 (18?) years old. George Lackey v. John Hudgings(?) on an Attachment Judgement for three pounds sixteen chillings & nine pense & costs. Francis Spaulding Garnishee being sworn says he oweth the Deft six chillings which was condemned towards Satisfying the Plts. Judgement & the same continued for other Garnishees. Mathew Sandifur conl. is allowed one dollar six eight cents his pr aut.(?) which was ordered to be certifyed to the auditor of Public Accts. Ordered that Richard Sharps gang be subject to the direction of John Turner in clearing of a road Viewed from Reuben Burnetts to the montgomery line.
