Hancock & David Harbour was duly elected as overseers of the Poore. Also from the Hollow district was returned by the superintendant and that Nathl. Smith, Thomas Branson, and Saml. Hanby was duly elected. A Deed from Rbt. Sharp to Leonard Sharp Acknowledged & O. to be Recorded. James Oneal father & next Friend to Jonathan Oneal & [sic] Infant v Jno. Allen, a Jury sworn, to Wit, Harvey Fitzgerald, Charles Rakes, Malchi Parmer, Saml. Corn, David M. Keaton, Charles Bolt, Pleasa[nt?] Dickinson, Thomas Joyce, Wm. Ware, Jno. Roberson, Francis Spaulding, & Thomas Branson. Verdcit returned for the Plaintiff for one hundred dollars Damages and Judgment thereon accordingly. Bartons exors. v Mathew Sandifur & Robt. MAY COURT (31 May 1810) Brett Stovall Gentleman Presented in court a commission from the Governor and council appointing him Major of the first Batallion & qualyfied according to law. John A. Corn as Lieutenant the same Elkanah Aryes the same, the same. Thomas Branson the same, the same Wm. Sneed as Captain the same Madison R. Hughes as Ensign the same Richard Thomas as Lieutenant the same. Richard Nowlin as Ensign the same Samuel Hanby as Captain the same. A report of an election of the overseers of the Poor at Josiah Farriss by Colo. G. Penn Superintendant was returned according to law. David Harbour & Richard Harrison Quallyfied as overseers of the Poor. A Deed from Burgis Brammer to Hugh Boyd was Proved in court by The witnesses thereto & Mildred The wife being privily examined relinquished her right of Dower, & the same was Ordered to be recorded. Also a Deed from Hugh Boyd to Mildred Brammer the same. William Hancok qualified as an Overseer of the Poor according to law. Henry Tuggle Sr. is appointed surveyor of the road in the place of Jno. Tugle from Reubin Burnetts to the top of the mountain at Mabrys Gap to the Montgomery line & the list filed be his gang. Cornelious Burnett is appointed surveyor of the road in the place of Moses Hurt from Mrs. Turners to Obediah Burnetts mill, & the list filed be his gang. James Hall is also appointed surveyor of the road in the place of John Hall Sr. from shooting creek to the forks of the road by Bartletts & the list filed be his gang. John Tuggle, Henry Tuggle, Isaral Wilks & Wm. Brammer or any three of them are appointed to view a way for a road from Mabrys path to montgomery line and make report thereof to the Court. John Hughes, Britt Stovall & John Turner are appointed Commissioners to fix on a Place for the Clerks Office and make report that it should stand adjoining the upper part of the publicc square upon a line with a the court house. Samuel Staples presented in court a commission from the governor & council appointing him Colo. Commandant of the 18th Regiment & 12th Brigade & first Division of Militia of the county of county of Patrick & took the usual oaths to the commonwealth & Federal Government. Present: Wm. Carter, Thomas Penn, Robert Sharp, Abraham Penn, Richard Thomas, G. Penn, Jno. Hughes -- Gentlemen Justices. Administration of the Estate of John Gates decd. is Granted Susanah Gates who Qualified according to law & She together with George Penn & S. Staples her securities entered into bond & acknowledged the same acordingly. Thomas Penn, Samuel Crutcher, Charles Crutcher & Richard Harrison are appointed to appraise the Estate of John Gates decd. they or any 3 of them and to make report thereof to the Court. Ordered that Thomas Ayres Jr. & his hands, John Stricklin, John Abshire (?), James Dickerson & his hands, Elisha Williams, Jacob Grigg & John Johnson be added to Elihu Ayers's Gang. Nathl. Shelton is appointed Surveyor of the road in Place of John Sharp from Mrs. Penn's to the Henry line and the former list be his gang. John Sharp is appointed also in Place H. Mankin from P. C.house to the forks below Tatums & the list filed formerly be his gang. JUNE COURT (28 June 1810) Present: William Banks, Charles Foster, Robert Sharp & John Tatum & Abram Penn -- Gentlemen Justices. Daniel Booth is appointed surveyor of the road from Mrs. Rowans old store to Reubin Burnetts old plaice in place of Samuel Hilton and it is Ordered that the list filed be his gang. William Moore gentlement Presented in court a commission from the Governor and Council appointing him Major of the second Batallion and quallyfied according to law. John Turner also presented in court a commission appointing him Captain and quallified accordingly. Jno. East also as Leutenant who also quallyfied. William Keaton Senr. v Gabl. Penn & others in chancery deferred as to Pittman by order of the Plaintiffs attorney. Peter Frans and William Banks Sr. each quallifyed as overseers of the Poor for this county according to law. A Deed of trust from James Ferrell to Richard Sharp Proved and Ordered to be rd. An Inventory of the estate of Nicholas Thomas decd. returned and Ordered to be recorded. A View of a road from the forks of Mabrys road above Houchings to Reubin Burnetts old place returned and ordered to be recorded. A certifycate from under the hand of George Penn a Justice of the peace as to the qualleyfycation of Martin Miller as Leutenant was returned and Ordered to be recorded. Also as to the quallyfication of Elijah Banks as Captain the same. Elum Newman is appointed surveyor of the road from Gabl. Penns store to the forks of the road by the school house & it is ordered that the list filed be his gang. Frederick Shelton is appointed and recommended as Captain of a company of rifle in the place of Robert Sharp resigned of the 2d Batallion. Abraham Staples as Lieutenant in Place of said Shelton Promoted. Samuel Hanby Jr. is recommended as Lieutenant in Capt. Hanby's company of Militia in Place of John East being out of the bounds. James Howell Ensign in Place of Thomas Branson also out of the bounds. Charles Foster Jr. is recommended as Capt. of the Millitia of the 1st Batalion in Place of Wm. Adams resigned. Sampson Jones as Lieutnt. in Place of Charles Foster promoted. Edward Philpott Ensign in Place of the said Jones Promoted. A Dedimus for privy examination of Elisabeth Adams wife of Robert Adams relinquishing her right of Dower to a certain tract of land conveyed by her Husband to John Hughes was returned and Ordered to be recorded. A Deed from Robert Hall to Harvey Fitzgerald Proved & Ordered to be recorded. JULY COURT (26 July 1810) On Motion of Samuel Staples leave is granted him to Keep ordinary in the town of Taylorsville & he together with Britt Stovall entered into bond accordingly. Morgan Hopson Gentleman Produced his license permiting him to practice the Law, whereupon he quallyfied accordingly. An Inventory of the Estate of John Gates deceased returned & ordered to be recd. David Harbour, Foreman, Benjamin Landrith, Joel Willis, Henry Reynolds, Thomas Beazley, William McAlexander, Richard Pilson, William Harris, William Witt, John Newman, Jacob Critze, Thomas Aryes, Elijah Dehart, William Burge, Jesse Mankins and Pleasant Thomas were sworn a grand Jury of Enquest for the body of this county, whereupon they withdrew to consult upon their presentments the. Corn, administratrix v Richard Nowlin, John Turner Special Bl. & delivered the Defendant up whereupon he has prayed into custody & Judgement Confessed according to Specialty & costs. Execution stayed till 1st October next. Corn administratrix v. James Ferrell, Richard Sharp Special Bl. Judgment confessed according to specialty & costs. Stay execution eight months an.. abates as to....(?) (27 July 1810) On the motion of Peter Adams assee & by his Attorney for a Judgement & award of Execution on a forth coming bond v. Samuel Harris, Richard Sharp, William Thompson & Henry Thompson the defendants having been called & not appearing Judgement is therefore granted the Plaintiff v. the said Defendants according to the said bond with Interest & costs. On the motion of John Reives by his attorney for a judgement on a forth coming bond v. Robert Sharp and John Hanby, notice having been proved & the defendants called & failing to appear Judgement is therefore granted the Plaintiff v the said Defendants according to the said bond with the Interest & costs. Hamon Critze, Britt Stovall & Munford Smith are recommended to the Executive as proper and fit persons to serve as Sheriffs. AUGUST COURT (30 August 1810) A Deed from Thomas Sneed to Jno. Spencer acknowledged & ordered to be recorded. Also a Deed from Nathl. Ross to Charles Sharp Proved & ordered to be Recorded. Samuel Corn Jr. & Susannah Corn infants & children of Jesse Corn decd. who are over the age of fourteen years came into court & Choosed William Hancock their Guardian whereupon the court Proceeded to appoint him. Accordingly he is also appointed Gardian of Nancy and Dicey Corn children of the said Corn decd. who is under the age of fourteen. On the motion of George Penn late high Sheriff of this county v. Jesse Corn his deputy, John A. Corn, George Lackey, Nancy Corn admr of Jesse Corn decd, Richard Sharp, Samuel Staples, Gabl. Penn & John James securitys for the said Jesse Corn Sr., notice of this motion having been Proven Judgement is therefore granted him against the sd. Jesse Corn & his securitys as aforesaid for the amount of the commonwealth Execution v. the Plaintiff to wit, the sum of three hundred and thirty six dollars and seventy one cents for the ballance of the revenue Taxes for the year 1809. Also sixteen dollars eighty three cents for Damages & twelve dollars & eighty six cents costs expended in the Genl. court with Interest thereon to be computed after the rate of five pr centum pr annum, from the 11th of June 1810 till paid. Also sixteen dollars & forty one cents commissions on the said commonwealth Execution with the legal costs etc. for entering this Judgement & Notices etc. [Transcriber's note: additional judgements and sums continue for two more paragraphs.] SEPTEMBER COURT (27 September 1810) William Banks Sr. is appointed commissioner for this county for the present year. Francis Nowlin is appointed surveyor of the road in the place of Burwell Johnson resigned & the list filed be his gang. Samuel Crutcher, William Willis, John Crum & Robert Sharp or Any three of them are appointed to View a way for a road from the Indian graves by Thomas Penns to Mrs. Penns & make report thereof to the court. Also from the first ford road at the lower end of Thomas Penns plantation to the Top of the hill near Mrs. Penns & also make report to the court. William Hancok appeared in Court with George Lackey, David Taylor, and Elijah Dehart his securitys and entered into bond as Gardian for the orphans of Jesse Corn decd. in the sum of two thousand dollars conditioned according to law. OCTOBER COURT (26 October 1810) On the motion of Joseph Alexander, Guardian of Samuel Cole By his Attorny for a Judgement and award of Execution on a forthcoming Bond against William Banks and Gabriel Penn. Notice of the motion having been proven as to Banks and acknowledged as to Penn the Defts. been called and failing to appear It is considered by the court that the plaintiff recover against the said Defendants according to the bond and Costs. Commonwealth v. Jane Allen a Jury sworn to Wit, Jesse Tatum, James Howell, Henry Reynolds, John Newman, Robert Boaz, John Bingman, John Corn, Wm. Sharp, Charles Crutcher, Thomas Beazley, Eliheu Aryes, and Anderson Allen. Verdcit returned finding the Defendant guilty and assess her fine to be six (?) dollars therefore it is considered by the court that the Plaintiff recover against the said defendant Judgmt. thereon for full costs. George Penn is appointed Escheator for the county of Patrick and It is Ordered that the same be certifyed to the Executive. A Deed of Trust from Robert Sharp to John Hughes proved & ordered to be recorded. Bartons Exors vs M. Sandifur & Robert Sharp. Plea waved & Judgment by non sum Informatus reserving equity. James Taylor, Invalid, is allowed two days attendance for Lawson ads Tatum. An account current of the estate of William Barton decd. returned and Ordered to be recorded. On the motion of George Penn late high Sheriff of this county stating that his deputy Jesse Corn had made returns on three Executions to Wit Dix Alexander & Co. v. Jno Sharp and James B. Gilmer assese. of Jno. Redd, in two cases against the same and it appearing to the satisfaction of the Court that the same was erroneous therefore it is considered that he be permited to alter the same agreable to the true statement of the case. William Sharp Jr. is allowed one days attendance for Hall ads Duweeze. (27 October 1810) William Sharp Jr. is allowed 1 days attendance for James Hall ads Duweeze. NOVEMBER COURT (29 November 1810) Present: William Banks, Thomas Penn, Robert Sharp, Richard Thomas, Britt Stovall & John Tatum -- Gentlemen Justices. A Deed from Richard Sharp & Wife to John Burnett Proved & O.R. Also a Deed of Trust from Samuel Harris & Benjamin Mayo to Wm. Lyon Proved & Ordered to be recorded. A Deed from Richard Sharp & Ux, John A. Corn, Wm. Corn, James Sharp & Mary his Wife, Samuel Corn, Susanah Corn, Nancy Corn & Disey Corn to Jesse Corn, Proved & Ordered to be recorded. Jesse Corn late Deputy Sheriff for George Penn, Presented in Court 3 Drafts on him for Militia Claims to wit, William James Mayo late Clerk of the Court of Enquiry of $25, ditto Thomas Penn, Capt. for a Drum $7, ditto Wm. James Mayo as Clerk for 1799 $25. Which was examined by the Court, and it appearing that the said Amount had been actually paid by the said Jesse Corn & that the CommonWealth exon. now was in the Sheriffs hands for Militia fines against him It is therefore Ordered that the Clerk Certify to the Auditor of Public Accounts, a statement relative to the same. Ordered that the overseers of the poor bind out Wm. Gibson, according to law & that the Sherif take the said Gibson & deliver him to one of the Overseers for that purpose. Nathl. Smith is appointed Guardian for John Edmonds Parr, & Tamy (?) Parr, Infant Orphans of John Parr Jun. decd. & together with Britt Stovall his security entered into bond for the amount of twelve hundred dollars conditioned according to law. Nathl. Shelton, James Pigg & Thomas Watson are appointed Comners. to lay off and allot to Elisabeth Trent Widow & relict of Alexander S. Trent decd. and make report thereof to the Court according to law. Administration of the Estate of Henry Tuggle is granted to John Tuggle who qualified according to law & he together with James Turner & David Harbour his securities entered into bond & acknowled. the same according to law. Jesse Mankin is appointed Surveyor of the Road from A. Penns Store to the Grayson line at wards Gap in the Place of Wm. Russey and the formers list of hands be his gang or, that is, all within the former bounds and that they do clear & keep the same in repair according to law. Thomas Harbour is appointed Constable north of the bull Mountain & he together with Richard Thomas his security entered into bond conditioned according to law & also qualified accordingly. George Penn, Wm. Banks Sr., Josiah Farris & Martin Miller or any three of them are appointed to settle the Account Current of Isaac Adams decd. & make report thereof to the Court. DECEMBER COURT (27 December 1810) A report of the Cutting & Cleardg a Road from the forks above G. Penns Store to the Carolina line near the Widow Webb's was retd. & O.R. & Thomas Fraizer is appointed overseer of the said Road & the list filed be his gang. Charles Crutcher is appointed Surveyor of the Road in the Room of William Adams, from the top of the back bone Ridge near Farris to Jacob Critz's & the list filed be his gang. A report of a View of a Road from the forks of Mabray's Gap Road above Houchings to Reubin Burnetts old Place was Returned & O.R. & Adam Turner is appointed to superintend the same and that Neeley Burnett & Richard Sharps Gang be called on to cut out the same, & when done to return again to their respective roads.
