Richardson, Martin Weddle, John James, William D. Gaines, Samuel Howell, James Howell, Charles Foster Jr., James Woodrough, James Ferrell, William Witt, John Adams, Gabriel Hanby, William Hannah, John Hancock -- were sworn a grand Jury of Inquest for the Body of this county whereupon they withdrew to consult upon their presentments. Commonwealth v. Munford Smith, a Jury sworn to wit, Martin Miller, Washington Thomas, William Lyon, Jesse Mankins, Thomas Bartlett, David Cockram, William Burge, Daniel Martindelle, Stephen Poore, Jacob Critze, John Koger, and Daniel Ross. On the motion of John Turner by his attorney, nature of the motion Being proved for a Judgment on a Delivery bond the parties being called and not appearing, Judgment is therefore granted the sd. Turner against Jesse Corn, John Corn & Nancy Corn agreeable to specialty & costs. Watson against Morris, a Jury sworn to wit, William Moore, John Sharp, James Lackey, John Cassada, Abram Reynolds, Wm. Critze, Andrew Joyce, Benjamin Woodson, Joel Willis, John Smith, John Cardwill and Samuel Hanby. Verdict Returned for the Plaintiff for $23.00 Damages with Judgment Thereon accordingly. (28 February 1812) Samuel Aryes is exempted from paying county and Parish Levy during his inabillity. George Hairston Sr. vs. John Hughes Plea Waved. Judgment confessed according to specialty & Costs reserving Equity. Same vs. Robert Sharp. Plea waved. Judgment confessed according to specialty & Costs. James Hall vs. Robert Sharp. Plea waved & Judgment confessed acording to spe.... Moore vs. Mankin a Jury Sworn to wit, Thomas Reives, Martin Weddle, Harvey Fitzgerald, John James, Isaac Martin, A. Joyce, David Rea, Frd. (?) Shelton, German Baker, Stephen Poore, James Woodroff, & Robert Boaz. Verdct returned for the Defendant, & Judgment is therefore granted the Defendant vs the Plt. for all Costs etc. APRIL COURT (30 April 1812) Present: John Hall, John Turner, Robert Sharp, Richard Thomas -- Gentlemen Justices of the court Jesse Eddy produced a license as a Hawker & Pedlar & Ordered to be Recorded. James Purdy is exempted from the Payment of County & Parish levies in future. MAY COURT (28 May 1812) Ordered that Wm. Sharp Jr. and his gang do aid and assist John Tatum in clearing and cutting the road from Staples Brown place to the north carolina line & then to return to his respective road. Ordered that Saml. Staples convey to the Justices of Patrick & their successors the lot on which the office now stands & that he Immediately proceed to remove this Courthouse on the most eligible Place of the same & to set the same their in as good repair as it is now at this time agreeable to the Judgment of Wm. Carter, Adam Turner & John Hughes or any 2 of them & that they fix the Place for seting it on said lot, for Which the said Staples is to be paid $50 excepting What may hereafter be Allowed for repairs. An Inventory of the estate of John Cassada returned by the commisoners appointed to take the same and ordered to be recorded. JUNE COURT (25 June 1812) Frederick Critze is appointed survey of the road from Jacob Critzes to the Henry line in the room of George F. Critze -- & the usual hands to be his gang. Reuben Harris, Elijah Dehart, John Tuggle & Wm. Brammer or any three of them are appointed commisioners to review the old roads from Wm. Brammers into the old road below Reuben Harris & that they report to the court the same. On the motion of Elijah Dehart leave is given him to build a milll a mill on his own land in this county on little wigeon creek. Therefore a writ of adquadamum is ordered to issue. Nathan Hall is appointed Surveyor of the road in the room of Wm. Hancock from the forks of the branch by Joseph Reynolds, to James Bowlings & its ordered that the list of the hands filed be his gang. Present: Robert Sharp, John Tatum, Munford Smith & John Hughes & Richd. Harrison & Britt Stovall -- Gentlemen Justices Robert Sharp & Augustine Thomas are appointed Processioners in the bounds of Capt. E. Banks company, & Capt. Frederick Critzes company & that they report agreeable to law to the court. Wm. Carter, Andrew Joyce & John Tatum & George Fulcher are appointed Processioners in the bounds of Capt. Samuel Hanby & Frederick Sheltons companys & that they also report to the court agreeable to law. Munford Smith & Elihue Aryes are appointed Processioners in the bounds of Capt. Abr. Penns company, & report to the court the same. John Turner, Nathan Hall & Richd. Thomas are appointed processioners in the bounds of Capt. Jno. Turners company & report also to the ct. agreeable to law. Charles Thomas & John Hall are appointed Processioners in the bounds of Capt. Sneeds company, & report also to the ct. agreeable to law. Bernard Price & William Fuson are appointed Processioners in the bounds of Capt. Charles Fosters company & that they report the same to the ct. according to law. German Baker is recommended to the Executive as a proper & fit person to serve as 2d Lieutenant in Capt. Greensville Penns company of cavalry of the 18th Regiment. James Hall, first Lutenant & Thomas Baker, cornett. Wm. Carter, John Hall & Thomas Penn or any two of them are appointed commisioners to let the building of the county Jail at the next court agreeable to the plan returned by the person appointed to take the same & the sd. Commisioners are darected to advertize the same Publicly, stating that two hundred dollars or nearly so, in the hands of Sam Hughes, belonging to the county, will be pd. in advance. Peachy R. Gilmer came into Court & resigned the office of state attorney for the court. AUGUST COURT (27 August 1812) Present: John Hughes, Samuel Hughes, John ___?, Robert Sharp -- Gentlemen Justices of the court Madison Frans is admitted a Deputy Sheriff of the county under Britt Stovall Gentlemen Shff., whereupon he quallyfied agreeable to Law. Wm. Brammer is appointed surveyor of the road in the room of Henry Tuggle, & it is ordered that the list of the hands filed be his gang, & its further ordered that they do clear and Keep the same in repair according to law. On the motion of Wm. Lee, Leave is granted him to build a mill on the north fork of Russells creek, therefore a writ of adquadm. is ordered to issue. SEPTEMBER COURT (24 September 1812) Present: John Hall, Adam Turner, Elijah Banks & Robert Sharp & Wm. Banks Sr. & Richd. Thomas -- Gentlemen Justices of the court James Taylor, Invalid, is admitted a collector of clerks fees in Patrick whereupon he has quallyied agreeable to law. Jesse Corn is appd. Surveyor of the road from the top of the Bull Mountain to the widow Foleys in the room of Wm. Corn - & it is ordered that the usual hands be his gang. Warren Massey is appd. Surveyr. of the Road from the blue falls to Capt. Charles Fosters and a list filed be his Gang. On the motion of David Harbour leave is granted him to build a Water Grist Mill on Sycamore Creek, he being owner on both sides thereof. William Jones is appd. Surveyr. of the Road in the room of Elum Newman & a list filed be his gang. Eliphaz Shelton is appointed to Convey the lotts in TaylorsVille to the Purchasers thereof that has not been hitherto conveyed & to all others that may hereafter Purchase any of the sd. lots. OCTOBER COURT (29 October 1812) Peter Scales, foreman, William Critze, Jerman Baker, John Clark, John Frans, John Finney, David Taylor, Carrington Dillion, Moses Harbour, Jeremiah Burnett, William Witt, John Sharp, Elijah Dehart, John Martindille, David Harbour & Wm. D. Gaines were worn a grand Jury of inquest for the body of this county whereupon they withrew to consult upon their presentments. (30 October 1812) Richard Thomas is recommended to the executive as a proper and fit person to serve as Captain in the room of John Turner resigned Promoted from the Liutenancy Richard Nowlin, Liutenant, and Cornelious Burnett as Ensign. NOVEMBER COURT (26 November 1812) George Penn, Josiah Farris & John Hughes or any two of them are appointed Commisioners to settle the Account Current of Wm. Barton decd. & it is Ordered that they make report thereof to the court. Administration of the estate of James Murphy decd. is granted Joseph Meridith who quallifyed according to law, and he together with Gabriel Penn & Abram Staples entered into bond & acknowledged the same according to law. Hamon Critze, George Fulcher, Richard Harrison & Mathew Sandifur or any three of them are appoointed to appraise the estate of James Murphy decd. and make report thereof to the court. Present: Richard Thomas, John Hall, Adam Turner, Gabriel Penn, Wm. Banks, John Tatum, John Hughes, Robert Sharp, Thomas Penn & William Carter, Greensville Penn -- Gentlemen Justices of the court Abram Staples is Recommended to the Executive as a Proper and Fit person to serve as Captain of the Rifle company of the Second Batalion in the room of Frederick Shelton Resigned. George Carter Sr. Lutenant and Augustine Jones Ensign all Promoted accept Jones. Phillip Penn is appointed Commisioner of the Revenue for the years 1812 & 1813, who therefore give Bond with his Securitys Andrew Joyce & quallyfied according to Law. Thomas Harbour is continued constable in his former bounds, & he together with Richard Thomas his security entered into bond conditioned agreeable to Law, & also quallyfied agreeable to Law. DECEMBER COURT (31 December 1812) Present: Gabriel Penn, Richard Thomas, Robert Sharp, John Tatum,& Wm. Carter, ____?, Richd. Thomas -- Gentlemen Justices of the Court Richard Thomas Presented in Court a Commision from under the seal of the Governor of the Commonwealth appointing him a Captain in the militia of the 18th Regiment and quallyfied to the same agreeable to law. Munford Smith Produced to the Court a Certifycate from the clerk of Stokes County North Carolina, certifying the execution of a bill of sale from Henry D. Gaines, administrator of the estate Ths. Gaines decd. to Munford Smith a Legatee of the sd Ths. Gaines decd., which was examined by the court and ordered to be recorded. Ordered that the sheriff summon John Bingman to appear here at the next Court to show cause why a Certain Isham Puckett bound to him should not be taken out of his hands. (Transcribed by Mary C.
