PATRICK COUNTY, VA - COURT - Order Book "2" (Selected Entries, 1815) ----¤¤¤---- JANUARY COURT (26 January 1815) Norman Staples appeared and quallifyed to his Commision appointing him a Justice of the peace in the county of Patrick. Philippinah Sharp appeared in Court and made application to administer upon her Husband Robt. Sharp decd.s estate, spec[i]ally & alone for the Collection of his pay as a soldier lately in service at Norfolk. The same is accordingly granted Her. The last Will and Testament of John C. Parrish decd. was presented to the Court by Greensville Penn, one of the Executors named therein and ordered to be certifyed for further proof. Present: Andrew Joyce, A. Turner, Norman Staples, Harvey Fitzgerald, Richd. Thomas, Charles Thomas & Thomas Penn, Saml. Hughes & Josiah Farris & Tho. Reives. Samuel Staples appeared in Court & resigned his Commision as Colo. Commandant of this Regmt. on account of bad health whereupon the Court proceeded to the appointment of a Successor and Greensville Penn was recommended to the Executive as a proper and fit person to serve as Colo. Commandant of the sd. 18th Regimt., Abrams Staples as Major of the sd. first Batalion in the room of Greensville Penn promoted, George Carter as Captain in the room of Abr. Staples promoted, Augustine Jones as Lut. in the room of Geo. Carter promoted and Danl Witt in the room of Augustine Jones promoted. MAY COURT (11 May 1815) A certificate from Jerman Baker of the quallification of Edward Philpott to a Commision appointing him a Lut. in the militia in the 18th Regiment was returned and ordered to be filed in office. Also a certificate from Thomas Penn of his quallifying Jerman Baker to a Commision appointing him a Captain of a troop of Horse in the 18th Regiment was also returned and ordered to be filed. An Inventory of the Estate of Joseph Newman decd. was returned in Court, Examined and ordered to be recorded. The motion at last Court or in fact at this Court against Wm. McAlexander for a fine to be imposed against him for refusing to give his list of taxable property and quallifying to the same to the Commisioner of the revenue of this County is annuled & set a side, upon condition that the sd. McAlexander pay all Costs accruing legally in the prosecution of this motion. On the motion of Jesse Corn for leave to keep an ordinary at his own house in the County of patrick, the same is granted him. Abram Penn is recommended to the Executive as a proper and fit person to serve as a Major in the 2nd Battalion of the 18th Regiment in the room of Major William Moore resigned. Martin Miller as a Captain of the 1st Battalion 18th Regiment in the room of Capt. Elijah Banks resigned, Pleasant Scales as Leutenant in the sd. Company of the sd. Batalion and 18th Regiment in the room of M. Miller promoted, Archibald Stovall as Ensign in the aforesaid Company. William Critze is also recommended to the Executive as a fit and proper person to serve as Captain of a Volenteer Riffle Company of the sd. 1st Battalion & 18th Regiment in the room of Capt. Critze Resigned, and Hamon Critze as a Leutenant in the sd. Company and William Chittwood as Ensign of the sd. Company, etc., and also Jeremiah Fuson is recommended as a fit and proper person to serve as an Ensign in Capt. Jno. A. Corns Company of the 1st Battalion & 18th Rifle and Thomas Harbour as Leut. in Capt. Thomas Company in the room of Richd. Nowlin resigned and also Jeremiah Burnett as an Ensign in sd. Company, and also Wm. Carter Sr. as a Captain of the 2nd Battalion & 18th Regt. in the room of Capt. Penn promoted, and James Smith Sr. as a Leut. in the sd. Company and Philip Anglin as an Ensign in sd. Company. JUNE COURT (15 June 1815) Rowan v. Sharp. Judgment is Granted the plaintiff against the sd. Defendant for the sum of Expressed (Expensed?) in the sd. attachment with Interest from this time that sd. amt was due, and Costs -- whereupon all proceedings against the Garnishee are Dismissed and discontinued. JULY COURT (13 July 1815) Cornelious Thomas is appointed a surveyor of a road in the room of Joseph Boyd from Shooting Creek to the fork of the road by Ratliffs, and it is ordered that the list of the hands filed be his gang. William Frans,s bound of road is Extended from the meeting house near Colo. Critzes to the Hollow road above Major Stovalls, and it is ordered that he does attend to the same in as full & complete manner as his said other road. William Lyon is admitted a Deputy Sheriff in the county of patrick who thereupon quallified according to law. AUGUST COURT (18 August 1815) A tract of land returned in the name of Thomas P. Jordan of 230 acres is released from the effects of the act of Assembly subjugating it to sale. Also one other tract in the name of Thomas M. Ruble of 415 acres, and also one other in the name of James Sharp of 181 acres, are released. OCTOBER COURT (12 October 1815) Present: Gabriel Penn, Jerman Baker, Adam Turner & Harvey Fitzgerald -- Gentlemen Justices of the Court. A Dedimus from Jemimah Sharp wife of Wm. Sharp, to Thomas Reives returned and ordered to be recorded. Louisa Penn, wife of P. Penn appeared in office before the Clerk as will appear by his the sd. Clerks Certificate and acknowledged her right of Dower in and to a Certain Tract of land Conveyed by the sd. P. Penn & Edmond Penn to Jesse Murphy, the same is ordered to be recorded accordingly. Jno Sharp v. Thomas Lockhart on an attachment contd. untill the next Court. Carrington Dillion, Thomas Sharp, Gabriel Penn, and James Pigg or 3 of them are appointed Commissioners to appraise the Estate of Jno. Rusk dcd. and make report thereof to the Court. DECEMBER COURT (14 December 1815) It is Ordered that the surveyor of the road, John Sharp, Change the rout of the road by his House to the place where it formerly run at or near the edge of the old field near his sd. House. Joseph Smith is authorized to call upon Adam Ahart, Jesse Mankin, Thomas Dillard, Aron Bowman and Bartlett Smith and their respective Gangs to aid and assist him in Cutting and Clearing a road from the Carolina line near Bakers mill to the Grayson line near the head of Johnson Creek and then to return to their respective roads again.
